Justice R.BASANT\n\n Dated :17\/01\/2008\n\n O R D E R\n                              R.BASANT, J\n                       ------------------------------------\n                         B.A.No.258 of 2008\n                      -------------------------------------\n              Dated this the 17th day of January, 2008\n\n                                   ORDER\n<\/pre>\n<p>      Application for anticipatory bail. Petitioner faces allegations<\/p>\n<p>of matrimonial cruelty of the culpable variety punishable under<\/p>\n<p>Section 498 I.P.C. Crime has been registered on the basis of a<\/p>\n<p>private complaint filed by the defacto complainant before the<\/p>\n<p>learned Magistrate. The learned Magistrate referred the same to<\/p>\n<p>the police under Section 156(3) Cr.P.C. Investigation is in<\/p>\n<p>progress. The petitioner, who is the 2nd accused and mother in<\/p>\n<p>law of the defacto complainant apprehends imminent arrest.<\/p>\n<p>      2.    The marriage had taken place on 13.09.2006.          The<\/p>\n<p>spouses are not blessed with any children. Cognizance has been<\/p>\n<p>taken on a private complaint referred to the police.<\/p>\n<p>      3.    The learned counsel for the petitioner prays, the<\/p>\n<p>learned Public Prosecutor does not oppose the said prayer and I<\/p>\n<p>am satisfied that the petitioner can be granted anticipatory bail.<\/p>\n<p>In coming to this conclusion, I take note of the fact that<\/p>\n<p>admittedly the victim had not suffered any external physical<\/p>\n<p>injuries. I take note of the reality that arrest and incarceration of<\/p>\n<p>the petitioner is likely to close the doors of all possibilities of<\/p>\n<p><span class=\"hidden_text\">B.A.No.258 of 2008                2<\/span><\/p>\n<p>harmonious settlement of the matrimonial disputes.     Appropriate<\/p>\n<p>conditions can of course be imposed in the interests of a fair,<\/p>\n<p>efficient and expeditious investigation.\n<\/p>\n<p>      4.   In the result, the Bail Application is, allowed.    The<\/p>\n<p>following directions are issued under Section 438 Cr.P.C.<\/p>\n<p>      i)   The petitioner shall appear before the learned<\/p>\n<p>Magistrate at 11 a.m on 24.01.2008. She shall be enlarged on<\/p>\n<p>regular bail on her executing bond for Rs.25,000\/- (Rupees<\/p>\n<p>Twenty Five thousand only) with two solvent sureties each for the<\/p>\n<p>like sum to the satisfaction of the learned Magistrate;<\/p>\n<p>      ii)  The petitioner shall make herself available for<\/p>\n<p>interrogation before the Investigating Officer between 10 a.m and<\/p>\n<p>3 p.m on 25.01.08 and 28.01.08.           During that period, the<\/p>\n<p>Investigating Officer shall be at liberty to interrogate the<\/p>\n<p>petitioner in custody and take all necessary for the proper<\/p>\n<p>conduct of the investigation. Thereafter the petitioner shall make<\/p>\n<p>herself available for interrogation before the Investigating Officer<\/p>\n<p>between 10 a.m and 12 noon on all Mondays for a period of one<\/p>\n<p>month and subsequently         the petitioner shall make herself<\/p>\n<p>available for interrogation as and when directed by the<\/p>\n<p>Investigating Officer in writing to do so;\n<\/p>\n<p><span class=\"hidden_text\">B.A.No.258 of 2008                3<\/span><\/p>\n<p>     iii)  If the petitioner does not appear before the learned<\/p>\n<p>Magistrate as directed in clause (i), directions issued above shall<\/p>\n<p>thereafter stand revoked and the police shall be at liberty to<\/p>\n<p>arrest the petitioner and deal with her in accordance with law as if<\/p>\n<p>those directions were not issued at all;\n<\/p>\n<p>     iv)   If the petitioner were arrested prior to her surrender on<\/p>\n<p>24.01.2008 as directed in clause (1) above, she shall be released<\/p>\n<p>from custody on her executing a bond for Rs.25,000\/- (Rupees<\/p>\n<p>Twenty Five thousand only) without any sureties undertaking to<\/p>\n<p>appear before the learned Magistrate on 24.01.2008.<\/p>\n<p>                                             (R.BASANT, JUDGE)<br \/>\nrtr\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Lakshmi Amma vs State Of Kerala on 17 January, 2008 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl No. 258 of 2008() 1.
