Patel, learned advocate for the petitioners and Ms. Mini<br \/>\nNair, learned Assistant Government Pleader for the respondent-State.\n<\/p>\n<p>\tThe<br \/>\nlearned advocate for the petitioners, relying upon the decisions of<br \/>\nthis Court in the case of Vasantilal R. Kansara vs. Viramgam<br \/>\nMunicipality &amp; Ors. reported in 1995 (2) GLH 436 and <a href=\"\/doc\/1224000\/\">R.C. Gajjar<br \/>\n&amp; Anr. vs. State of Gujarat &amp; Ors<\/a> reported in 1996 (1) GLH<br \/>\n276 contended that the respondent No.2, District Collector, was under<br \/>\n obligation to hear the present petitioners as the present<br \/>\npetitioners are the direct beneficiaries of the resolution which is<br \/>\nstayed by the Collector under section 258 of the Gujarat<br \/>\nMunicipalities Act, 1963 [hereinafter referred to as the Act].\n<\/p>\n<p>\tThis<br \/>\nCourt is of the view that ordinarily petition under 226 of the<br \/>\nConstitution challenging the Collector&#8217;s order staying the resolution<br \/>\nunder section 258 of the Act need not be entertained.  However the<br \/>\npeculiar facts of this case go to show that the Collector, respondent<br \/>\nNo.2 herein, appears to have acted on the application by the newly<br \/>\njoined respondent, Mr. Sadiya Keshav Jina and has heard the<br \/>\nNagarpalia.  When the Nagarpalika was thought fit to be heard, it was<br \/>\nthe bounden duty cast upon the Collector to hear the direct<br \/>\nbeneficiaries of the resolution. The Court is, therefore, of the view<br \/>\nthat let there be notice for final disposal, returnable on 25th<br \/>\nJuly 2011.\n<\/p>\n<p>\tIt is<br \/>\nexpected of the respondents to be ready with  reply affidavit, if<br \/>\nany.\n<\/p>\n<p>\tIn<br \/>\nthe meantime, it is directed that the Collector&#8217;s order dated 2nd<br \/>\nJuly 2011 is stayed.\n<\/p>\n<p>\tDirect<br \/>\nService to respondents No.2, 3 and 4.
