THE BLOCK DEVELOPMENT OFFICER, TANKUPA, DISTT.- GAYA\n\n          For the Petitioners:-      Mr. Sidhundra Narayan Singh, Advocate\n          For the State:-            Mr. Devendra Kumar Singh, A.A.G.-II &amp;\n                                     Mr. Swapnil Kumar Singh, A.C. to A.A.G.-II\n                                              -----------\n<\/pre>\n<p>03.   04.04.2011                 Heard learned counsel for the petitioners and for<\/p>\n<p>                    the State.\n<\/p>\n<p>                                 The petitioners are aggrieved by the suspension<\/p>\n<p>                    of their P.D.S. license on grounds of institution of a<\/p>\n<p>                    criminal prosecution against them under the Essential<\/p>\n<p>                    Commodities Act.\n<\/p>\n<p>                                 Learned counsel for the petitioners submits that<\/p>\n<p>                    under Clause 7 (5) of the Fair Price Shop Order 2007,<\/p>\n<p>                    framed under the Public Distribution System (Control)<\/p>\n<p>                    Order 2001, the suspension of the license can be for a<br \/>\n<span class=\"hidden_text\">                  2<\/span><\/p>\n<p>maximum period of 90 days only. Cancellation is an<\/p>\n<p>entirely different issue and in absence of which the<\/p>\n<p>petitioners are entitled to resumption of supply. He<\/p>\n<p>submits that there is no separate provision for exclusion of<\/p>\n<p>the period for which a criminal case may be pending under<\/p>\n<p>the Essential Commodities Act in calculating this period of<\/p>\n<p>90 days.\n<\/p>\n<p>           The Court finds it difficult to uphold the<\/p>\n<p>submission on behalf of the petitioners. From the scheme<\/p>\n<p>of Clause 7, it is apparent that a license may be suspended<\/p>\n<p>or cancelled by a written order under Clause 7 (2). Clause<\/p>\n<p>7 (3) provides a separate ground for suspension of a license<\/p>\n<p>on institution of a criminal case under the Essential<\/p>\n<p>Commodities Act. Clause 7 (4) obviously has to be read<\/p>\n<p>down as limited in its applicability to Clause 7 (2). If the<\/p>\n<p>grounds for suspension and cancellation are other than a<\/p>\n<p>criminal case, a show cause notice is mandatory. If the<\/p>\n<p>suspension is on account of institution of a criminal case<\/p>\n<p>in exercise of powers under Clause 7 (3), no prior show<\/p>\n<p>cause notice is necessary. The suspension under Clause 7<\/p>\n<p>(3) shall continue till the continuance of the criminal<\/p>\n<p>process. If what learned counsel for the petitioners<\/p>\n<p>contends be correct, there shall be a direct clash between<\/p>\n<p>the Clause 7 (3) and Clause 7(5) rendering Clause 7 (3)<\/p>\n<p>completely nugatory.\n<\/p>\n<p><span class=\"hidden_text\">                         3<\/span><\/p>\n<p>                The   principles   of   interpretation   mandate   a<\/p>\n<p>      harmonious reading rather than a stultifying interpretation<\/p>\n<p>      rendering one statutory provision in effective.<\/p>\n<p>                The court finds no merit in this application.
