Advocate\n\nHon'ble Ravindra Singh,J.\n<\/pre>\n<p>Heard\u00a0learned\u00a0counsel\u00a0for\u00a0the\u00a0applicants\u00a0and\u00a0learned\u00a0A.G.A.<br \/>\nThis\u00a0application\u00a0has\u00a0been\u00a0filed\u00a0by\u00a0the\u00a0applicants\u00a0Mahadev\u00a0and\u00a0two\u00a0<br \/>\nothers \u00a0 against \u00a0 the \u00a0 order \u00a0 dated \u00a0 22.12.2009 \u00a0 passed \u00a0 by \u00a0 C.J.M.\u00a0<br \/>\nChandauli\u00a0in\u00a0case\u00a0No.\u00a0259\u00a0of\u00a02009\u00a0whereby\u00a0the\u00a0application\u00a0under\u00a0<br \/>\nsection \u00a0 156(3) \u00a0 has \u00a0 been \u00a0 allowed \u00a0 and \u00a0 the \u00a0 Officer \u00a0 Incharge \u00a0 of \u00a0 the\u00a0<br \/>\npolice\u00a0station\u00a0concerned\u00a0has\u00a0been\u00a0directed\u00a0to\u00a0register\u00a0the\u00a0case\u00a0and\u00a0<br \/>\ninvestigate\u00a0the\u00a0same\u00a0in\u00a0exercise\u00a0of\u00a0powers\u00a0conferred\u00a0under\u00a0section\u00a0<br \/>\n156(3)\u00a0Cr.P.C.\u00a0\n<\/p>\n<p>It \u00a0 is\u00a0 contended\u00a0 by\u00a0 the\u00a0 learned\u00a0 counsel\u00a0 for \u00a0 the\u00a0 applicants \u00a0 that\u00a0 the\u00a0<br \/>\nimpugned\u00a0order\u00a0is\u00a0illegal,\u00a0it\u00a0has\u00a0not\u00a0been\u00a0passed\u00a0in\u00a0accordance\u00a0with\u00a0<br \/>\nthe\u00a0provisions\u00a0of\u00a0law.\n<\/p>\n<p>It\u00a0has\u00a0been\u00a0rebutted\u00a0by\u00a0the\u00a0learned\u00a0A.G.A.\u00a0by\u00a0submitting\u00a0that\u00a0there\u00a0is\u00a0<br \/>\nno \u00a0 illegality \u00a0 in \u00a0 the \u00a0 impugned \u00a0 order \u00a0 because \u00a0 on \u00a0 the \u00a0 basis \u00a0 of \u00a0 the\u00a0<br \/>\nallegations\u00a0made\u00a0in\u00a0the\u00a0application\u00a0under\u00a0section\u00a0156(3)\u00a0Cr.P.C.\u00a0a\u00a0<br \/>\nprima\u00a0facie\u00a0cognizable\u00a0offence\u00a0is\u00a0made\u00a0out\u00a0and\u00a0the\u00a0allegations\u00a0are\u00a0of\u00a0<br \/>\nsuch\u00a0nature\u00a0which\u00a0requires\u00a0investigation.\u00a0There\u00a0is\u00a0no\u00a0illegality\u00a0in\u00a0the\u00a0<br \/>\nimpugned\u00a0order.\n<\/p>\n<p>Considering\u00a0the\u00a0submissions\u00a0made\u00a0by\u00a0the\u00a0learned\u00a0counsel\u00a0for\u00a0the\u00a0<br \/>\napplicants \u00a0 and \u00a0 the \u00a0 learned \u00a0 A.G.A. \u00a0 and \u00a0 from \u00a0 the \u00a0 perusal \u00a0 of \u00a0 the\u00a0<br \/>\napplication\u00a0under\u00a0section\u00a0156(3)\u00a0Cr.P.C.,\u00a0it\u00a0appears\u00a0that\u00a0on\u00a0the\u00a0basis\u00a0<br \/>\nof\u00a0the\u00a0allegation\u00a0made\u00a0therein\u00a0a\u00a0prima\u00a0facie\u00a0cognizable\u00a0offence\u00a0is\u00a0<br \/>\nmade\u00a0out\u00a0and\u00a0the\u00a0allegations\u00a0are\u00a0of\u00a0such\u00a0a\u00a0nature\u00a0which\u00a0requires\u00a0<br \/>\ninvestigation,\u00a0the\u00a0impugned\u00a0order\u00a0is\u00a0not\u00a0suffering\u00a0from\u00a0any\u00a0illegality\u00a0or\u00a0<br \/>\nirregularity,\u00a0therefore,\u00a0the\u00a0prayer\u00a0for\u00a0quashing\u00a0the\u00a0impugned\u00a0order\u00a0is\u00a0<br \/>\nrefused.\n<\/p>\n<p>It\u00a0is\u00a0further\u00a0contended\u00a0that\u00a0the\u00a0applicants\u00a0are\u00a0men\u00a0of\u00a0peace\u00a0loving.\u00a0<br \/>\nThey\u00a0shall\u00a0cooperate\u00a0with\u00a0the\u00a0investigation.\u00a0In\u00a0case,\u00a0the\u00a0applicants\u00a0<br \/>\nare\u00a0arrested\u00a0and\u00a0sent\u00a0to\u00a0jail\u00a0during\u00a0investigation,\u00a0the\u00a0applicants\u00a0shall\u00a0<br \/>\nsuffer\u00a0irreparable\u00a0loss.\u00a0Therefore,\u00a0the\u00a0applicants\u00a0may\u00a0not\u00a0be\u00a0arrested\u00a0<br \/>\nduring\u00a0investigation.\n<\/p>\n<p>Considering \u00a0 the \u00a0 facts, \u00a0 circumstances \u00a0 of \u00a0 the \u00a0 case \u00a0 and \u00a0 the\u00a0<br \/>\nsubmissions\u00a0made\u00a0by\u00a0the\u00a0learned\u00a0counsel\u00a0for\u00a0the\u00a0applicants\u00a0and\u00a0the\u00a0<br \/>\nlearned \u00a0 A.G.A, \u00a0 it \u00a0 is \u00a0 directed \u00a0 that \u00a0in \u00a0 case\u00a0 the \u00a0 FIR \u00a0 has \u00a0 not \u00a0 been\u00a0<br \/>\nregistered\u00a0till\u00a0today,\u00a0if\u00a0it\u00a0is\u00a0lodged\u00a0subsequently,\u00a0in\u00a0pursuance\u00a0to\u00a0<br \/>\nthe \u00a0 impugned \u00a0 order, \u00a0 the \u00a0 applicants \u00a0 shall \u00a0 not \u00a0 be \u00a0 arrested \u00a0 during\u00a0<br \/>\n investigation\u00a0of\u00a0the\u00a0case\u00a0but\u00a0the\u00a0applicants\u00a0shall\u00a0cooperate\u00a0with\u00a0the\u00a0<br \/>\ninvestigation.\n<\/p>\n<p>With\u00a0this\u00a0direction\u00a0this\u00a0application\u00a0is\u00a0finally\u00a0disposed\u00a0of.<br \/>\nOrder Date :- 21.1.2010<br \/>\nRPD\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Mahadev And Others vs State Of U.P.
