Mr.H.L.Jani,<br \/>\n\tlearned Additional Public Prosecutor waives service of Rule on<br \/>\n\tbehalf of the State.  In the facts and circumstances of the case and<br \/>\n\tby consent of both the sides, this petition is taken up for hearing<br \/>\n\ttoday.\n<\/p>\n<p>\tThis petition is<br \/>\n\tpreferred under Section 439 of the Code of Criminal Procedure for<br \/>\n\tregular bail in connection with FIR registered as CR No. I? 56 of<br \/>\n\t2008 registered with Aanklav Police Station, District-Anand for the<br \/>\n\toffences punishable under Sections 302, 324, 323, 504, 506(2) and<br \/>\n\t114 of the Indian Penal Code.\n<\/p>\n<p>\tThe learned advocate<br \/>\n\tfor the petitioner submitted that petitioner has not played any role<br \/>\n\tin the commission of offence alleged against him and therefore it is<br \/>\n\ta fit case to release the petitioner on bail.  The learned advocate<br \/>\n\tfurther submitted that the false case is foisted on the petitioner<br \/>\n\tand therefore, the prayers as set out in the application may be<br \/>\n\tgranted.\n<\/p>\n<p>\tLearned APP<br \/>\n\tMr.H.L.Jani, opposing the bail application, submitted that<br \/>\n\tconsidering the FIR at Annexure-A to the petition and role played by<br \/>\n\tthe petitioner in the commission of offences punishable under<br \/>\n\tSections 302, 324, 323, 504, 506(2) and 114 of the Indian Penal<br \/>\n\tCode, the petitioner is not required to be released on bail.  The<br \/>\n\tlearned APP has also placed reliance on the statement of the<br \/>\n\twitnesses namely Vimlaben and Govindbhai and submitted that in view<br \/>\n\tof the statement of the witnesses, the application deserves to be<br \/>\n\trejected.\n<\/p>\n<p>\tHeard learned<br \/>\n\tadvocate Mr.B.D.Karia for the petitioner and Mr.H.L.Jani, learned<br \/>\n\tAdditional Public Prosecutor at length and in great detail.  I have<br \/>\n\talso perused the averments made in the application as well as the<br \/>\n\tFIR produced on the record.  Having considered the rival submissions<br \/>\n\tand on perusal of the documents on record as well as FIR at<br \/>\n\tAnnexure-A to the petition, petitioner is booked for the offences<br \/>\n\tpunishable under Sections 302, 324, 323, 504, 506(2) and 114 of the<br \/>\n\tIndian Penal Code.  I have also considered the involvement of the<br \/>\n\tpetitioner in the alleged offences and the gravity of the offences.\n<\/p>\n<p>\tConsidering the<br \/>\n\tabove, prima facie there is no direct involvement of the petitioner<br \/>\n\tin the commission of offences and therefore, I am of the view that<br \/>\n\tthe petitioner is required to be enlarged on regular bail at this<br \/>\n\tstage, without discussing the evidence in detail.\n<\/p>\n<p>\tIn the peculiar facts<br \/>\n\tand circumstances of the case, the petition is allowed and the<br \/>\n\tpetitioner is ordered to be enlarged on bail in connection with CR<br \/>\n\tNo. I? 56 of 2008 registered at Aanklav Police Station on executing<br \/>\n\ta bond of Rs.10,000\/- [Rupees ten thousand only] with one surety of<br \/>\n\tthe like amount to the satisfaction of the Trial Court and subject<br \/>\n\tto the conditions that he shall:\n<\/p>\n<p>\t[a]\tnot take undue<br \/>\n\tadvantage of his liberty or abuse his liberty;\n<\/p>\n<p>\t[b]\tnot act in a<br \/>\n\tmanner injurious to the interest of the prosecution;\n<\/p>\n<p>\t[c]\tsurrender his<br \/>\n\tpassport, if any, to the lower Court within a week;\n<\/p>\n<p>\t[d]\tnot leave the<br \/>\n\tState of Gujarat without the prior permission of the Sessions court<br \/>\n\tconcerned;\n<\/p>\n<p>\t[e]\tmark his presence<br \/>\n\tat the concerned Police Station on any day of every first week of<br \/>\n\tEnglish calendar month between 9.00 AM and 2.00 PM. till the trial<br \/>\n\tis over;\n<\/p>\n<p>\t[f]\tfurnish the<br \/>\n\tpresent address of his residence to the I.O. and also to the Court<br \/>\n\tat the time of execution of the bond and shall not change his<br \/>\n\tresidence without prior permission of this Court;\n<\/p>\n<p>\t[g]\tmaintain law and<br \/>\n\torder.\n<\/p>\n<p>\tIf breach of any of<br \/>\n\tthe above conditions is committed, the Sessions Judge concerned will<br \/>\n\tbe free to issue warrant or to take appropriate action in the<br \/>\n\tmatter.\n<\/p>\n<p>\tBail bond to be<br \/>\n\texecuted before the lower Court having jurisdiction to try the case.\n<\/p>\n<p>\tAt the trial, the<br \/>\n\tTrial Court shall not be influenced by the observations of<br \/>\n\tpreliminary nature, qua the evidence at this stage, made by this<br \/>\n\tCourt while enlarging the petitioner on bail.\n<\/p>\n<p>\tRule is made absolute<br \/>\n\tto the aforesaid extent.
