He submitted that there is no role of<br \/>\n\tabetment by act or ommission, and, therefore, present application<br \/>\n\tmay be allowed. He referred to the judgment of the Hon&#8217;ble Apex<br \/>\n\tCourt reported in AIR 2005 SC 1775 and submitted that in view<br \/>\n\tof observation made in the above judgment, present application may<br \/>\n\tbe allowed.\n<\/p>\n<p>\tLearned<br \/>\n\tA.P.P., Mr.Shivang Shukla resisted the present application.\n<\/p>\n<p>\tHaving<br \/>\n\theard Mr.Abhiraj Trivedi, learned advocate for the applicant and<br \/>\n\tMr.Shivang Shukla, learned APP for respondent State and having<br \/>\n\tconsidered the nature of offence, manner in which it is alleged to<br \/>\n\thave been committed, role attributed and also considering other<br \/>\n\tpapers including the suicide note and also considering the aspect of<br \/>\n\tabetment in light of provisions of section 306 of Indian Penal Code,<br \/>\n\tpresent application deserves to be allowed.\n<\/p>\n<p>\tAccordingly,<br \/>\n\tpresent application stands allowed. The applicant is ordered to be<br \/>\n\treleased on regular bail in connection with I-C.R.No.76\/2010 at City<br \/>\n\tPolice Station, Dist.Vadodara, on her executing a bond of Rs.5,000\/-<br \/>\n\t(Rupees Five Thousand Only) with one solvent surety of the like<br \/>\n\tamount to the satisfaction of the lower Court and subject to the<br \/>\n\tconditions that she shall:\n<\/p>\n<p>(a)\tnot<br \/>\ntake undue advantage of her liberty or abuse her liberty.\n<\/p>\n<p>(b)\tnot<br \/>\nto try to tamper or pressurize the prosecution witnesses or<br \/>\ncomplainant in any manner.\n<\/p>\n<p>(c)\tnot<br \/>\nact in any manner injurious to the interest of the prosecution.\n<\/p>\n<p>(d)\tmaintain<br \/>\nlaw and order and should cooperate the investigating officers.\n<\/p>\n<p>(e)\tfurnish<br \/>\nthe address of her residence to the Investigating Officer and also to<br \/>\nthe Court at the time of execution of the bond and shall not change<br \/>\nher residence without prior permission of the Court.\n<\/p>\n<p>(f)\tsurrender<br \/>\nher passport, if any, to the lower Court, within a week.\n<\/p>\n<p>\tIf<br \/>\n\tbreach of any of the above conditions is committed, the concerned<br \/>\n\tSessions Judge will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>\tBail<br \/>\n\tbefore the lower Court having jurisdiction to try the case. It would<br \/>\n\tbe open to the trial Court concerned to give time to furnish the<br \/>\n\tsolvency certificate if prayed for.\n<\/p>\n<p>\tRule<br \/>\n\tis made absolute to the aforesaid extent.
