Justice R.BASANT\n\n Dated :13\/11\/2008\n\n O R D E R\n                          R.BASANT, J.\n                       ----------------------\n                     Crl.M.C.No.4240 of 2008\n                   ----------------------------------------\n           Dated this the 13th day of November 2008\n\n                              O R D E R\n<\/pre>\n<p>     Petitioner&#8217;s vehicle was allegedly used for the commission<\/p>\n<p>of an offence punishable under &#8216;The Kerala Protection of River<\/p>\n<p>Banks and Regulation of Removal of Sand Act. The petitioner<\/p>\n<p>applied for release of the vehicle. The learned Magistrate, by<\/p>\n<p>the impugned order, rejected the same on the ground that the<\/p>\n<p>vehicle was earlier involved in a similar incident.<\/p>\n<p>     2.    The learned counsel for the petitioner submits that<\/p>\n<p>the allegations are not correct. On both occasions, the vehicle<\/p>\n<p>was not so used. In appropriate proceedings, the petitioner shall<\/p>\n<p>be able to establish that his vehicle was not so involved. But at<\/p>\n<p>any rate, the vehicle may not be permitted to be exposed to sun<\/p>\n<p>and rain and suffer any avoidable damage and deterioration.<\/p>\n<p>Subject to any appropriate conditions the vehicle may be ordered<\/p>\n<p>to be released to the petitioner, it is prayed.<\/p>\n<p>     3.    Notice was given to the learned Public Prosecutor.<\/p>\n<p>The learned Public Prosecutor submits that the State has no<\/p>\n<p>objection against release of the vehicle subject to appropriate<\/p>\n<p>conditions as are normally imposed by this court in respect of<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.4240\/08                2<\/span><\/p>\n<p>vehicles which are allegedly involved in a second occasion for<\/p>\n<p>such violation.\n<\/p>\n<p>      4.    I am satisfied that the vehicle can be directed to be<\/p>\n<p>released. In coming to the conclusion, the concerns which were<\/p>\n<p>adverted to by the Supreme Court in <a href=\"\/doc\/25703131\/\">Sunderbhai Ambalal<\/p>\n<p>Desai v. State of Gujarat<\/a> [SC 2003(2) KLT 1089] do weigh<\/p>\n<p>with me.<\/p>\n<pre>\n\n      5.    In the result,\n\n      a)    This petition is allowed.\n\n      b)    It is directed that the vehicle, Mini Lorry No. KL-6\n\n<\/pre>\n<p>5229 shall be released to the petitioner on the following terms<\/p>\n<p>and conditions.\n<\/p>\n<p>      i)    The petitioner shall produce before the learned<\/p>\n<p>Magistrate all documents to show that he is the person entitled<\/p>\n<p>to possession of the vehicle.\n<\/p>\n<p>      ii)   He shall execute a bond for an amount equal to the<\/p>\n<p>value of the vehicle as may be determined by the learned<\/p>\n<p>Magistrate with two solvent sureties each for the like sum to the<\/p>\n<p>satisfaction of the learned Magistrate.<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.4240\/08                3<\/span><\/p>\n<p>      iii)  The petitioner shall deposit an amount of Rs.50,000\/-<\/p>\n<p>(Rupees fifty thousand only) as cash security before the court<\/p>\n<p>below.\n<\/p>\n<p>      iv)   The petitioner shall, in the bond to be executed by<\/p>\n<p>him, undertake that the vehicle shall not be used or permitted to<\/p>\n<p>be used by him under the &#8216;The Kerala Protection of River Banks<\/p>\n<p>and Regulation of Removal of Sand Act&#8217; for commission of any<\/p>\n<p>offence while it is in his possession on the strength of this order.<\/p>\n<p>      6.
