Justice K.HEMA\n\n Dated :27\/01\/2009\n\n O R D E R\n                           K.HEMA, J.\n\n               -----------------------------------------\n                       B.A.No. 6626 of 2008\n               -----------------------------------------\n\n             Dated this the 27th January, 2009\n\n                            O R D E R\n<\/pre>\n<p>      This petition is for anticipatory bail.\n<\/p>\n<p>      2. The alleged offences are under Sections 341, 294(b),<\/p>\n<p>323, 324, 308 and 427 read with 34 of the Indian Penal Code.<\/p>\n<p>According to prosecution, petitioners 1 to 3, in furtherance of<\/p>\n<p>common intention allegedly assaulted de facto complainant<\/p>\n<p>and he sustained a fracture to his arm.\n<\/p>\n<p>      3. learned counsel for petitioners submitted that<\/p>\n<p>petitioners are students and office bearers of the National<\/p>\n<p>Students Congress. There was a State level meeting and there<\/p>\n<p>was some confrontation with the opposite group of students<\/p>\n<p>and de facto complainant fell down and sustained injury.<\/p>\n<p>Offence under Section 308 IPC is included only for the<\/p>\n<p>purpose of deliberately harassing petitioner, it is submitted. It<\/p>\n<p>is also submitted that offence under Section 308 IPC is not<\/p>\n<p>attracted.\n<\/p>\n<p>      4. This petition is strongly opposed. Learned Public<\/p>\n<p>Prosecutor submitted that second accused has used a stone to<\/p>\n<p><span class=\"hidden_text\">   BA.6626\/08                       2<\/span><\/p>\n<p>inflict injury and accused 1 and 3 assaulted by fisting and<\/p>\n<p>kicking and thereby de facto complainant sustained a fracture.<\/p>\n<p>It is not a fit case to grant anticipatory bail, it is submitted.<\/p>\n<p>      5. On hearing both sides, considering the nature of<\/p>\n<p>allegations made, I am not inclined to grant anticipatory bail.<\/p>\n<p>At this stage, I am not prepared to come to a conclusion that<\/p>\n<p>offence under Section 308 IPC is not attracted. The mere<\/p>\n<p>assertions by the accused are not sufficient to arrive at a<\/p>\n<p>conclusion. No special circumstance is pointed out for this<\/p>\n<p>Court to invoke Section 438 Cr.P.C. The incident occurred as<\/p>\n<p>early as on 10.10.2008 and petitioners have not co-operated<\/p>\n<p>with the investigation.\n<\/p>\n<p>      6.
