Justice K.HEMA\n\n Dated :21\/06\/2010\n\n O R D E R\n                                K.HEMA, J\n                            -----------------------\n                        B.A No.3396 OF 2010\n                       --------------------------------\n                Dated this the 21st day of June 2010\n\n                                  ORDER\n<\/pre>\n<p>           This petition is for anticipatory bail.\n<\/p>\n<p>      2. The alleged offences are under Sections 403, 404, 409,<\/p>\n<p>417 and 418 of IPC. According to prosecution, petitioner<\/p>\n<p>misappropriated money entrusted by his father&#8217;s brother for<\/p>\n<p>construction of class rooms in a Government School.<\/p>\n<p>      3.   Learned counsel for petitioner submitted that the<\/p>\n<p>complaint is in respect of Rs.12,00,000\/- which is entrusted by<\/p>\n<p>petitioner&#8217;s uncle with petitioner for the purpose of constructing<\/p>\n<p>four class rooms in a school. Money is still safe with petitioner<\/p>\n<p>and he has not misappropriated the same. But, a complaint is<\/p>\n<p>made alleging false allegation against petitioner.         Petitioner is<\/p>\n<p>innocent and he explained his innocence to Investigating Officer<\/p>\n<p>when he surrendered before the Investigating Officer, as per the<\/p>\n<p>direction of this court, it is submitted.\n<\/p>\n<p>      4.   Learned Public Prosecutor submitted that petitioner<\/p>\n<p>surrendered and he was interrogated by Investigating Officer. He<\/p>\n<p>is not required for interrogation.\n<\/p>\n<p>      5. On hearing both sides, I am satisfied that anticipatory<\/p>\n<p>bail can be granted to petitioner. Hence the following order is<\/p>\n<p>passed:\n<\/p>\n<p><span class=\"hidden_text\">B.A No.3396 OF 2010           2<\/span><\/p>\n<blockquote><p>         (1) Petitioner shall surrender before the Magistrate<\/p>\n<p>              Court concerned within seven days from today.<\/p>\n<p>        (2) On such surrender, petitioner shall be released on<\/p>\n<p>             bail on his executing a bond for Rs.10,000\/-<\/p>\n<p>             (Rupees ten thousand only) each with two solvent<\/p>\n<p>             sureties each for the like sum to the satisfaction<\/p>\n<p>             of the learned Magistrate on the         following<\/p>\n<p>             conditions:\n<\/p><\/blockquote>\n<blockquote><p>                     (i)   Petitioner shall report before the<\/p>\n<p>                          Investigating Officer as and when<\/p>\n<p>                          directed    and   co-operate    with<\/p>\n<p>                          investigation.\n<\/p><\/blockquote>\n<blockquote><p>                   (ii)    Petitioner shall not influence or<\/p>\n<p>                          intimidate any witnesses or tamper<\/p>\n<p>                          with any evidence.\n<\/p><\/blockquote>\n<blockquote>\n<p>                 Petition is allowed.<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>                                                 K.HEMA<br \/>\n                                                  JUDGE<\/p>\n<p>vdv<\/p>\n<\/blockquote>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Susil Kumar vs State Of Kerala on 21 June, 2010 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 3396 of 2010() 1.
