2\/   07\/12\/2010             Heard learned counsel for the petitioner, State<\/p>\n
                  and for respondent No.23, one of the members of the<\/p>\n
                  Panchayat, who has appeared suo motu.\n<\/p>\n
                            The petitioner is stated to be the Up Pramukh<\/p>\n
                  of the Asthawa Panchayat Samiti, Block- Asthawa,<\/p>\n
                  District- Nalanda. He is aggrieved by the notice dated<\/p>\n
                  20.10.2010 issued by the Executive Officer-cum-Block<\/p>\n
                  Development Officer convening a special meeting on<\/p>\n
                  28.10.2010 for discussion of the No Confidence Motion<\/p>\n
                  tabled against him by the requisite number of members.<\/p>\n
                            Learned counsel for the petitioner submits that<\/p>\n
                  Section-44(3)(v)   of   the    Bihar   Panchayat    Raj   Act<\/p>\n
                  (hereinafter referred to as the Panchayat Act) states the<\/p>\n
                  reasons\/charges on basis of which No Confidence Motion<\/p>\n
                  has to be moved against the Up Pramukh shall be clearly<\/p>\n
                  mentioned in the notice summoning the meeting for<\/p>\n
                  consideration of the No Confidence Motion. The notice<\/p>\n
                  dated   20.10.2010      does    not    meet   the   statutory
\n                   -2-<\/span><\/p>\n
requirements. It does not contain, mention or the reasons<\/p>\n
and\/or charges on which the No Confidence Motion was<\/p>\n
proposed to be tabled. He submits that if the statutory<\/p>\n
provisions require a particular act to be done in a<\/p>\n
specified manner mentioned in the Statute Book, the act<\/p>\n
can be done only in that manner and other modes of<\/p>\n
performance are necessarily forbidden. The notice dated<\/p>\n
20.10.2010 itself being illegal, the No Confidence Motion<\/p>\n
passed on 28.10.2010 is clearly non est and the<\/p>\n
respondents cannot be permitted to go ahead with the<\/p>\n
fresh meeting on 11.12.2010 for election of a Pramukh<\/p>\n
afresh.\n<\/p>\n
          Learned counsel for the State and respondent<\/p>\n
No.23 point out that the notice does satisfy the<\/p>\n
requirements of Section-46(4) of the Panchayat Act as it<\/p>\n
gives clear seven days notice for the holding of the<\/p>\n
meeting. Learned counsel for the respondents, however<\/p>\n
find it difficult to satisfy the Court from the notice dated<\/p>\n
20.10.2010     that     it   contains   details    of   the<\/p>\n
reasons\/charges on basis of which          No Confidence<\/p>\n
Motion was proposed to be tabled.\n<\/p>\n
          Learned counsel for the State submits that if a<\/p>\n
No Confidence Motion has been tabled on the Floor of the<\/p>\n
House in the Panchayat, even if there be procedural<\/p>\n
infirmities, only the Courts can interfere with the same,
\n                   -3-<\/span><\/p>\n
not the State Government.\n<\/p>\n
          This Court has come across more than one<\/p>\n
order where the Block Development Officer-cum-Chief<\/p>\n
Executive Officer in different Panchayats have issued<\/p>\n
notices for convening special meeting to discuss a No<\/p>\n
Confidence Motion without complying with the statutory<\/p>\n
provisions, both with regard to the time period stipulated<\/p>\n
in the Act for holding of the meeting as is required to be<\/p>\n
mentioned in the notice and also the requirement of the<\/p>\n
Law with regard to the contents of the notice as<\/p>\n
discussed above. Those constituting the Panchayat at the<\/p>\n
grassroots level may not necessarily have the same<\/p>\n
educational background and understanding as a Block<\/p>\n
Development Officer-cum-Chief Executive Officer who is<\/p>\n
recruited after a competitive examination conducted by<\/p>\n
the   Bihar   Public   Service   Commission.   There   is   a<\/p>\n
presumption that the Executive Officer understands the<\/p>\n
Law and being able to read the statutory provisions is<\/p>\n
aware of the nature of his powers, the manner of exercise<\/p>\n
and limitations upon the same. If he is not, he may have<\/p>\n
very serious questions to answer with regard to his own<\/p>\n
employment and status.\n<\/p>\n
          A No Confidence Motion is tabled by members<\/p>\n
of the Panchayat in an effort to make grassroots<\/p>\n
democracy work. The Executive Officer throttles the same
\n                     -4-<\/span><\/p>\n
by issuing a notice in exercise of his Statutory powers in<\/p>\n
teeth of the provisions notwithstanding the fact that he<\/p>\n
has the benefit of a Government Pleader also in the<\/p>\n
district   and    the   level   of    understanding    where    a<\/p>\n
presumption arises of his full awareness of his Statutory<\/p>\n
powers. This Court has already discussed that the<\/p>\n
Executive Officer is recruited through a competitive<\/p>\n
public examination in which inheres a certain level of<\/p>\n
intelligence.\n<\/p>\n
           This Court today on the record as it stands<\/p>\n
could have directed stay of the notice dated 20.10.2010<\/p>\n
and any further action taken or proposed to be taken in<\/p>\n
pursuance thereof while issuing notice to the other<\/p>\n
members      of   the   Panchayat       impleaded     as   private<\/p>\n
respondents, as only one of them has appeared. At this<\/p>\n
stage, the Court is not concerned with the correctness or<\/p>\n
falsity of the No Confidence Motion that was proposed to<\/p>\n
be moved. The Court is concerned with working of the<\/p>\n
grassroots      democracy.      The    Panchayat    wants      the<\/p>\n
democracy to work, the Executive Officer by one stroke of<\/p>\n
pen throttles it. The Court shall then grant stay.<\/p>\n
Grassroots democracy shall not work till such time that<\/p>\n
all the parties have appeared before this Court and filed<\/p>\n
their affidavits. In the meantime, a person whom the<\/p>\n
Panchayat does not want to function shall continue to
\n                     -5-<\/span><\/p>\n
function.    Nothing      stated       herein   shall   mean   any<\/p>\n
indictment of the petitioner with regard to the No<\/p>\n
Confidence Motion as it has already been observed<\/p>\n
hereinabove that this Court is not concerned with the<\/p>\n
correctness or incorrectness of the No Confidence Motion<\/p>\n
which has to be tested on its own merits in the<\/p>\n
Panchayat      pursuant     to     a    meeting    summoned     in<\/p>\n
accordance with law. Perhaps, it is time for the State<\/p>\n
Government to wake up and realize its duties to enable<\/p>\n
grassroots democracy to work keeping in mind the<\/p>\n
constitutional mandate.\n<\/p>\n
            No useful purpose is going to be served by<\/p>\n
staying the operation of the orders, letting the writ<\/p>\n
petition be pending here for years as similar writ petitions<\/p>\n
will keep coming as they have kept coming.<\/p>\n
            Let the petitioner file an application before the<\/p>\n
State Government under Section-154 of the Bihar<\/p>\n
Panchayat Act. It vests power in the State Government on<\/p>\n
its own motion or on an application made by any person<\/p>\n
interested to call for and examine the records of a<\/p>\n
Panchayat or a Standing Committee in respect of any<\/p>\n
proceedings to satisfy itself as to the correctness, legality<\/p>\n
or propriety of any decision or order passed therein or as<\/p>\n
to the regularity of the said proceedings and take action<\/p>\n
appropriately in accordance with law after hearing the
\n                       -6-<\/span><\/p>\n
concerned.     This    Court   does   not     concur   with   the<\/p>\n
submission on behalf of the State that Section-154 of the<\/p>\n
Act does not empower the State Government to interfere<\/p>\n
with grassroots democracy and motions tabled on the<\/p>\n
Floor of the House notwithstanding the fact that they<\/p>\n
may be in teeth of the statutory provisions and may<\/p>\n
suffer from gross illegality and irregularity of proceedings.<\/p>\n
The Court expects the State Government to take<\/p>\n
appropriate action so that orders of the present nature do<\/p>\n
not continue to be passed notwithstanding repeated<\/p>\n
orders of this Court holding that such notices were illegal<\/p>\n
in more than one case.\n<\/p>\n
            Liberty is granted to the petitioner to also seek<\/p>\n
interim relief under Section-154(2) of the Act before the<\/p>\n
State Government and which is required to be disposed<\/p>\n
off without any delay before 11.12.2010 so as not to<\/p>\n
frustrate his representation in view of the fresh elections<\/p>\n
proposed to be held on 11.12.2010 in light of the present<\/p>\n
discussion that the learned counsel for the State has not<\/p>\n
been able to satisfy the Court that the notice dated<\/p>\n
20.10.2010 based on the recitals contained therein fulfils<\/p>\n
the requirement of Section-44(3)(v) of the Panchayat Act.<\/p>\n
            Learned counsel for the State submits that the<\/p>\n
petitioner may be advised to file his application before the<\/p>\n
Principal    Secretary,     Department   of    Panchayati     Raj,
\n                       -7-<\/span><\/p>\n
     Government of Bihar.\n<\/p>\n
              The writ application stands disposed with the<\/p>\n
     aforesaid observations and directions.<\/p>\n
