NO. 322 OF 2011 O\n              ------------------------------------------------------\n              Dated this the 1st day of February, 2011\n\n\n                                 JUDGMENT\n<\/pre>\n<p>       The petitioner filed O.S.No.395 of 2010 on the file of the Court<\/p>\n<p>of the Munsiff of Taliparamba against the respondents for a<\/p>\n<p>permanent prohibitory injunction restraining the defendants from<\/p>\n<p>trespassing into the plaint schedule property and taking possession<\/p>\n<p>of the same or assigning the same or making any obstruction to the<\/p>\n<p>plaintiff in possessing and enjoying the plaint schedule property. It is<\/p>\n<p>stated in the plaint that the possession of the plaintiff is sought to be<\/p>\n<p>disturbed as if the property is a part of the property directed to be<\/p>\n<p>taken possession of in the proceedings of the Taluk Land Board as<\/p>\n<p>excess land. The case of the plaintiff is that neither the plaintiff nor<\/p>\n<p>his assignor was a party to the proceedings before the Taluk Land<\/p>\n<p>Board and that the plaintiff is not bound by the order passed by the<\/p>\n<p>Taluk Land Board. The plaintiff has also raised a contention that the<\/p>\n<p>property of the declarant is lying elsewhere and it is situated in a<\/p>\n<p>survey number having vast extent of property.<\/p>\n<p>O.P.(C) NO.322 OF 2011 O<\/p>\n<p>                                    :: 2 ::\n<\/p>\n<\/p>\n<p>       2. Along with the suit, I.A.No.2479 of 2010 was filed by the<\/p>\n<p>petitioner for a temporary injunction. The grievance of the petitioner<\/p>\n<p>is that I.A.No.2479 of 2010 is not disposed of by the court below. No<\/p>\n<p>ad interim order was granted and therefore, the petitioner is<\/p>\n<p>aggrieved by the non-disposal of the application for temporary<\/p>\n<p>injunction.\n<\/p>\n<\/p>\n<p>       3.   The reliefs prayed for in the Original Petition are the<\/p>\n<p>following:\n<\/p>\n<\/p>\n<blockquote><p>       &#8220;a)   Issue a direction or any other appropriate order<\/p>\n<p>             commanding the Munsiff&#8217;s Court, Taliparamba to<\/p>\n<p>             dispose of the Injunction petition to pending as<\/p>\n<p>             I.A.No.2479 of 2010 in O.S.No.395 of 2010<\/p>\n<p>             pending on its file on merits as expeditiously as<\/p>\n<p>             possible at any rate within a time limit prescribed<\/p>\n<p>             by this Hon&#8217;ble Court.<\/p><\/blockquote>\n<p>        b)   Issue a direction or any other appropriate order<\/p>\n<p>             restraining the respondents, their men agent and<\/p>\n<p>             servant from trespass into the property and taking<\/p>\n<p>             possession of the property and assign the same<\/p>\n<p>O.P.(C) NO.322 OF 2011 O<\/p>\n<p>                                      :: 3 ::\n<\/p>\n<p>\n            and making any obstruction to the petitioner in<\/p>\n<p>            possession and enjoying the property and from<\/p>\n<p>            commit any waste in the property in Resurvey<\/p>\n<p>            No.14\/1A      of   Taliparamba    Taluk,  Pariyaram<\/p>\n<p>            amsom, Vayadu desom till final orders are passed<\/p>\n<p>            in I.A.No.2479 of 2010 in O.S.No.395 of 2010 on<\/p>\n<p>            the files of the Munsiff&#8217;s Court, Taliparamba.<\/p>\n<p>       c)   Any other appropriate order or direction as this<\/p>\n<p>            Hon&#8217;ble Court may deem fit on the facts and in the<\/p>\n<p>            circumstances of the case. And allow this petition<\/p>\n<p>            with all costs.&#8221;\n<\/p>\n<\/p>\n<p>      4. Relief (b) cannot be granted as the question whether any<\/p>\n<p>such order should be granted shall be decided by the trial court.<\/p>\n<p>However, relief (a) is liable to be granted.<\/p>\n<p>      Accordingly, the Original Petition is partly allowed.    The<\/p>\n<p>Munsiff&#8217;s Court, Taliparamba shall consider and dispose of<\/p>\n<p>I.A.No.2479 of 2010 in O.S.No.395 of 2010 as expeditiously as<\/p>\n<p>possible and, at any rate, within a period of one month, after<\/p>\n<p>affording an opportunity of being heard to the petitioner and the<\/p>\n<p>respondents. The petitioner would be free to submit before the court<\/p>\n<p>O.P.(C) NO.322 OF 2011 O<\/p>\n<p>                                   :: 4 ::\n<\/p>\n<p>\nbelow for the grant of an ad interim order of injunction and the Court<\/p>\n<p>shall consider the same in accordance with law and on the merits of<\/p>\n<p>the case.
