JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 22\/09\/2011  \nORAL ORDER<\/pre>\n<p>1.\tThis<br \/>\npetition under Article 226 of the Constitution of India has been<br \/>\nfiled, with the following prayers :\n<\/p>\n<p>&#8220;(A)\tThis<br \/>\nHon&#8217;ble Court may be pleased to issue a writ of mandamus of any other<br \/>\nappropriate writ or direction to respondent no.2 to 6 for<br \/>\nconducting\/appear to 100 students in B.Ed. Examination start from<br \/>\n21.04.2011 and allotment of Examination center to petitioner\/students<br \/>\nB.Ed. College at Veraval and cancel B.Ed. Examination center no.021<br \/>\nat Saraswati Mahila B.Ed. College, Talala (Gir).\n<\/p>\n<p>(B)\tPending<br \/>\nhearing and final disposal of the petition, this Hon&#8217;ble Court may be<br \/>\npleased to direct to respondent no.2 to 6 for conducting\/appear to<br \/>\n100 students in B.Ed. Examination start from 21.04.2011 and allotment<br \/>\nof examination center to petitioner\/students B.Ed. College at Veraval<br \/>\nand cancel B.Ed. Examination center no.021 at Saraswati Mahila B.Ed.<br \/>\nCollege, Talala (Gir).\n<\/p>\n<p>(C)\tAd-interim<br \/>\nrelief in terms of Prayer (B) above may be granted.\n<\/p>\n<p>(D)\tThis<br \/>\nHon&#8217;ble Court may be pleased to initiate necessary action against the<br \/>\nrespondents, and officers of SNDT University for above mentioned<br \/>\nillegalities and irregularities, in the interest of students and<br \/>\njustice.\n<\/p>\n<p>(E)\tGrant<br \/>\nany other and further reliefs as this Hon&#8217;ble Court may deem just and<br \/>\nproper in the interest of justice.&#8221;\n<\/p>\n<p>2.\tToday<br \/>\nwhen the matter is taken up, Mr.Y.C.Contractor, learned advocate for<br \/>\nrespondents Nos.2 to 6 states, upon instructions, that respondent<br \/>\nNo.2-University will announce the examination schedule within<br \/>\nseven days from today. All the eligible students will be allowed to<br \/>\nappear in the examination on production of the relevant documents<br \/>\npertaining to the students. Respondent No.7-College shall<br \/>\nsubmit all the relevant documents pertaining to the students<br \/>\nappearing in the said examination, five days prior to the<br \/>\ncommencement of the examination.\n<\/p>\n<p>3.\tMr.Ramesh<br \/>\nSavania, learned advocate for Ms.Anuja S. Nanavati, learned counsel<br \/>\nfor respondent No.7- College, states, upon instructions, that<br \/>\nrespondent No.7 &#8211; College shall submit all the papers<br \/>\npertaining to students, who are to appear in the said examination,<br \/>\nfive days prior to the date of the examination.\n<\/p>\n<p>4.\tIn<br \/>\nview of the statements made by the learned counsel for respondents<br \/>\nNos.2 to 6 and respondent No.7, Mr.Kirit R. Patel, learned advocate<br \/>\nfor the petitioners, states that he may be permitted to withdraw the<br \/>\npetition.\n<\/p>\n<p>5.\tPermission<br \/>\nto withdraw the petition, is granted.\n<\/p>\n<p>\tThe<br \/>\npetition is disposed of, as withdrawn.\n<\/p>\n<p>\tNotice<br \/>\nis discharged.
