Considering the  role attributed to the<br \/>\napplicant No.1 who is the mother-in-law and applicant No.2 who is the<br \/>\nsister-in-law  as reflected in the FIR, police papers as well as  the<br \/>\nprovisions of the aforesaid sections, quantum of punishment and the<br \/>\ngravity of offence and also the fact that the  applicants have<br \/>\nabetted  in the commission of  offences and except the aforesaid, no<br \/>\nother role is attributed to the applicants,  I am of the view that<br \/>\nthe applicants deserve to be enlarged on bail.   The application is<br \/>\nallowed accordingly. The applicants are ordered to be enlarged on<br \/>\nbail in connection with aforesaid offences on executing a bond of<br \/>\nRs.10,000\/- [Rupees ten thousand only] with one surety each of the<br \/>\nlike amount to the satisfaction of the Trial Court and subject to the<br \/>\nconditions that they shall:\n<\/p>\n<p>[a]\tnot<br \/>\ntake undue advantage of their liberty or abuse their liberty;\n<\/p>\n<p>[b]\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>[c]\tsurrender<br \/>\ntheir passport, if any, to the lower Court within a week;\n<\/p>\n<p>[d]\tnot<br \/>\nleave the State of Gujarat without the prior permission of the<br \/>\nSessions court concerned;\n<\/p>\n<p>[e]\tfurnish<br \/>\nthe present address of his residence to the I.O. and also to the<br \/>\nCourt at the time of execution of the bond and shall not change his<br \/>\nresidence without prior permission of this Court;\n<\/p>\n<p>[f]\tmaintain<br \/>\nlaw and order.\n<\/p>\n<p>3.\t\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or to take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>4.\t\tBail<br \/>\nbond to be executed before the lower Court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p>5.\t\tAt<br \/>\nthe trial, the Trial Court shall not be influenced by the<br \/>\nobservations of preliminary nature, qua the evidence at this stage,<br \/>\nmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p>6.\t\tRule<br \/>\nis made absolute to the aforesaid extent.\tDirect Service is<br \/>\npermitted.\n<\/p>\n<p>\t\t\t\t\t\t\t\t[H.B.ANTANI,<br \/>\nJ.]<\/p>\n<p>msp<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Kamlaben vs State on 19 July, 2010 Author: H.B.Antani,&amp;Nbsp;
