Mehndiratta, Advocate, for<br \/>\n                respondent No.2.\n<\/p>\n<\/p>\n<pre>                           .     .      .\n\n\nAJAI LAMBA, J (Oral)\n\n<\/pre>\n<p>                This petition seeks quashing of complaint<\/p>\n<p>No.3\/2 dated 4.1.2007 (Annexure P-1) titled &#8216;Charanjit<\/p>\n<p>Dua vs. Rohit Madan &amp; Others&#8217; lodged for commission of<\/p>\n<p>offences under Sections 420, 120-B, 34 IPC and Sections<\/p>\n<p>138\/142 of the Negotiable Instruments Act, 1881 (for<\/p>\n<p>short,   `the     Act&#8217;),   and    order      of   summoning      dated<\/p>\n<p>4.1.2007 (Annexure P-2) vide which the accused have<\/p>\n<p>been summoned to stand trial for offences under Section<\/p>\n<p>138 of the Act.\n<\/p>\n<p>                Contention of the learned counsel for the<\/p>\n<p>petitioner   is     that   complaint        was   filed   with     the<br \/>\n Crl. Misc. No. M-30221 of 2007                                          [2]<\/p>\n<p>allegations            that      younger       brother      of         complainant<\/p>\n<p>(Charanjit Dua) was to be sent abroad i.e. Canada. The<\/p>\n<p>allegation        has    been     made       against     petitioner,          Rupesh<\/p>\n<p>Malhotra who was known to the complainant as well as<\/p>\n<p>the    other      accused        namely,      Rohit      Madan.    As     per    the<\/p>\n<p>allegations in the complaint, the petitioner suggested<\/p>\n<p>the complainant to contact the other accused i.e. Rohit<\/p>\n<p>Madan. It was in the presence of Rohit Madan that the<\/p>\n<p>petitioner         discussed           the     matter,      considered          the<\/p>\n<p>passport and other related documents of the brother of<\/p>\n<p>the complainant during the first week of April, 2006.<\/p>\n<p>Complainant was thereafter induced that the brother of<\/p>\n<p>the complainant would be sent abroad if Rs.3 lac were<\/p>\n<p>paid. The complainant did not have such a huge amount.<\/p>\n<p>He therefore collected the money from his friends. The<\/p>\n<p>complainant handed over the money to the petitioner on<\/p>\n<p>3.4.2006 in the presence of witnesses. After receiving<\/p>\n<p>the money, the petitioner promised the complainant that<\/p>\n<p>his brother would be sent abroad within two months from<\/p>\n<p>the    date       of    receipt        of    the    money.        In    case     the<\/p>\n<p>petitioner         failed        to     send       the     brother        of    the<\/p>\n<p>complainant abroad, the entire amount would be returned<\/p>\n<p>within       15        days.     The        complainant      demanded           some<\/p>\n<p>guarantee.\n<\/p>\n<p>                   The        allegation        further      is         that     the<\/p>\n<p>petitioner handed over three cheques (post dated) of<\/p>\n<p>the value of Rs.30,000\/- each of different dates which<\/p>\n<p>had been issued by the other accused i.e. Rohit Madan.<\/p>\n<p>The cheques subseqnelty were dishonoured whereupn the<br \/>\n Crl. Misc. No. M-30221 of 2007                                       [3]<\/p>\n<p>proceedings as noticed above, were initiated.<\/p>\n<p>                   Learned counsel contends that even if the<\/p>\n<p>allegations are taken to be true at their face value,<\/p>\n<p>no offence under Section 138 of the Act can be said to<\/p>\n<p>have been committed by the petitioner in so much as,<\/p>\n<p>admittedly, the petitioner had not issued the cheque.<\/p>\n<p>It   was    co-accused,          Rohit    Madan,     who     had    issued      the<\/p>\n<p>cheques from his account.\n<\/p>\n<p>                   I have considered the contentions of the<\/p>\n<p>learned counsel for the petitioner and respondent.<\/p>\n<p>                   Perusal        of     the        order     of     summoning<\/p>\n<p>indicates that both the accused have been summoned for<\/p>\n<p>commission of offence under Section 138 of the Act. It<\/p>\n<p>is however the admitted case of the complainant that<\/p>\n<p>cheques      had    been      issued     by   the    co-accused         from    the<\/p>\n<p>Kotak Mahindra Bank, Account No.01720120001872 of the<\/p>\n<p>co-accused         as   has      been    pleaded      in    Para    6      of   the<\/p>\n<p>complaint. The petitioner had not issued the cheque.<\/p>\n<p>                   This being the admitted position that the<\/p>\n<p>petitioner is not the signatory of the cheques, in view<\/p>\n<p>of the provisions of Section 138 of the Act, he could<\/p>\n<p>not have been summoned to stand trial for commission of<\/p>\n<p>offence under Section 138 of the Act.\n<\/p>\n<p>                   In   view      of    the   above,       this    petition      is<\/p>\n<p>allowed.\n<\/p>\n<p>                   Complaint No.3\/2 dated 4.1.2007 (Annexure<\/p>\n<p>P-1) titled &#8216;Charanjit Dua vs. Rohit Madan &amp; Others&#8217;<\/p>\n<p>lodged for commission of offences under Sections 420,<\/p>\n<p>120-B, 34 IPC and Sections 138\/142 of the Negotiable<br \/>\n Crl.
