JOSEPH FRANCIS, J.\n                  - - - - - - - - - - - - - - - - - - - - - -\n                    Crl.R.P.No. 236 of 2003\n                  - - - - - - - - - - - - - - - - - - - - - -\n            Dated this the 21st day of December, 2010\n\n                               O R D E R\n<\/pre>\n<p>        This Crl.R.P. is filed by the accused in C.C.No. 135 of<\/p>\n<p>1999 on the file of the Chief Judicial Magistrate Court,<\/p>\n<p>Thodupuzha.     The cheque amount was Rs.10,000\/-                  In the<\/p>\n<p>trial court the accused were convicted under Section 138 of the<\/p>\n<p>N.I. Act and sentenced to undergo S.I. for one month each. The<\/p>\n<p>appeal filed by them         as Crl.A.No. 62 of 2001 before the<\/p>\n<p>Sessions Court,     Thodupuzha was dismissed.                 Against that<\/p>\n<p>conviction and sentence the accused filed this revision petition.<\/p>\n<p>      2.   Heard learned counsel for the revision petitioners,<\/p>\n<p>learned counsel for the complainant and the learned Public<\/p>\n<p>Prosecutor.\n<\/p>\n<p>       3.   The learned counsel appearing for the revision<\/p>\n<p>petitioners reiterated the same contentions raised before the<\/p>\n<p>Crl.R.P.No. 236 of 2003<\/p>\n<p><span class=\"hidden_text\">                                  2<\/span><\/p>\n<p>trial Court and the appellate court.       Learned counsel for the<\/p>\n<p>complainant supported the judgment of the court below.<\/p>\n<p>      4. The courts below have concurrently held that the cheque<\/p>\n<p>in question was drawn by the petitioners in favour of the<\/p>\n<p>complainant, that the complainant had validly complied with<\/p>\n<p>clauses (a) and (b) of the proviso to Section 138 of the N.I. Act and<\/p>\n<p>that the Revision petitioners\/accused failed to make the payment<\/p>\n<p>within 15 days of receipt of the statutory notice. Both the courts<\/p>\n<p>have considered and rejected the defence set up by the revision<\/p>\n<p>petitioners while entering the conviction. The said conviction has<\/p>\n<p>been recorded after a careful evaluation of the oral and<\/p>\n<p>documentary evidence.       I do not find any error, illegality or<\/p>\n<p>impropriety in the conviction so recorded concurrently by the<\/p>\n<p>courts below and the same is hereby confirmed.<\/p>\n<p>Crl.R.P.No. 236 of 2003<\/p>\n<p><span class=\"hidden_text\">                                   3<\/span><\/p>\n<p>      5. In the decision reported in <a href=\"\/doc\/1594211\/\">Damodar S. Prabhu v. Sayed<\/p>\n<p>Babalal H<\/a> (2010 (2) KHC 428 (SC)), it was held that in a case of<\/p>\n<p>dishonour of cheques, compensatory aspect of the remedy should<\/p>\n<p>be given priority over the punitive aspect. Considering the facts<\/p>\n<p>and circumstances of the case, I am of the view that sentencing the<\/p>\n<p>accused to pay a fine of Rs.5,000\/- each would meet the ends of<\/p>\n<p>justice. The said fine shall be paid as compensation under Section<\/p>\n<p>357(1) of Cr.P.C. The revision petitioners are permitted either to<\/p>\n<p>deposit the said fine amount before the Court below or directly pay<\/p>\n<p>the compensation to the complainant within one month from today<\/p>\n<p>and to produce a memo to that effect before the Trial Court in case<\/p>\n<p>of direct payment. If they fail to deposit or pay the said amount<\/p>\n<p>within the aforesaid period, they shall suffer simple imprisonment<\/p>\n<p>for one month by way of default sentence. The amount, if any,<\/p>\n<p>deposited in the trial court by the accused can be given credit to.<\/p>\n<p>Crl.R.P.No. 236 of 2003<\/p>\n<p><span class=\"hidden_text\">                                4<\/span><\/p>\n<p>     6.    Accordingly this Revision Petition is disposed of<\/p>\n<p>confirming the conviction entered and by modifying the sentence<\/p>\n<p>imposed on the revision petitioners.\n<\/p>\n<\/p>\n<p>                                  (M.L.
