  by providing’ facilities of playing indoor games,<\/p>\n

biiliarfdsv  if-‘iit1ey also specifically say that no games of<\/p>\n
Q chance or eVents’of public amusement are conducted in their<\/p>\n
 “..ji=.premises. It is their case that on 16.9.2009 at about 4.30<\/p>\n

if Wconducted raid on the premises of 1*'-1 petitioner on false<\/p>\n
accusation that the members of 13* petitioner society are<\/p>\n

game. In the process, he seized the propexftiiesiig 0-<\/p>\n
Rs.18,890\/\u00bb~ cash, 260 playing card_s,..3__3 m;:bi1e’gai:ehesf,.VVe0_ <\/p>\n
plastic chairs, 1 T.V, 1 table. 2   :3:\n<\/p>\n
small stools. Thereafter, he fil_ed__F’IR”‘against’2\ufb01{3g:.petiti.oner <\/p>\n
under Sections 79 and 80 of the___i{arnattaka “Follicle <\/p>\n
4. In the said  3(a) which
\nrefers to occurre:’i:ce_ of  time, it is stated
\nthat the off\u20ace1’lrf!e4__  .\u00a7.}n.. on 16.09.2009.
\nIn the said  stated that information of
\noffencegwas’  station at 7.30 p.m., on\n<\/p>\n
16.o9.2oo9r’_’_e_-ed  entered into general diary at<\/p>\n
7.30 “i’heV”pa_,r1chariama said to have drawn in respect of<\/p>\n
.Atl1e,conci’ucted on the premises of W’ petitioner is drawn<\/p>\n
 5 p.m. and 7  which is at<\/p>\n
Ann’exure\u00a5H;”‘ states that on the same day after getting<\/p>\n
 .Tir1fo_rrnation regarding some illegal activity going on in the<\/p>\n
i  ‘premises of 1*” petitioner, 591 respondent with posse of police<\/p>\n
  -\u00abraided the premises of 15′ petitioner at 4.45 p.m., seized the<\/p>\n
articles referred to above and arrested 2″” petitioner.<\/p>\n

5. The counsel for petitioner bring to the notice of this<\/p>\n
court the copy oi complaint given by the 2nd petitioner<\/p>\n
respondent, wherein he has made serious allegations ~<\/p>\n
the way in which respondents 2 to _5~haVe behaireid;  it V’<\/p>\n
on 16.9.2009 and also the earlier’:.ninsta1’ices~_W3’ierex i’i1eg}:ij<\/p>\n
demand for graft is made ‘o_V\\_(v””respontierits  .3’I’he <\/p>\n
contents of said complaint and__ai_icgations rnadpe therein are
\ntoo serious in nature to”–b’e.igno-red ‘4b3fp’vihigher officer, much<\/p>\n
less ist respondent-4   _  V<\/p>\n
statement of the said objections, there is an<\/p>\n
attempt tovaissert  “(:o:ndiict of respondents 2 to 6 on<\/p>\n
 n_ 16.932009 and aiso____on earlier occasions regarding the raid<\/p>\n
 ‘C,!()VE1\u20ac1i1Ct_vC”(“l on””th_e premises of 151 petitioner and registration<\/p>\n
“of:AF’I–R  petitioner. In the objections statement filed<\/p>\n
by respondents though the respondents tried to substantiate<\/p>\n
 therconducted by them the essential document which<\/p>\n
 “empowers them to conduct raid that is the warrant to be<\/p>\n
 “issued under Rule 81(2) of Karnataka Police Rules is not<\/p>\n
produced. However, at the time of arguments, for the first<\/p>\n

issuing such warrant regairiing  alle’ged’:4_v.offence <\/p>\n
committed by petitioners and alHs’o_’does not say  and at
\nwhat time the Warrant  issiied.  ~ <\/p>\n
7. If thecopy  d:atedV~ 1\u00abe.”o9.2oo9, the FIR
\nwhich is at.  the efpanchanama, which is at
\nAnnexiitee\ufb02illlare :ii;\u00ab:;;_)1.:ed_j’in:to,\ufb01 it.._is.5seen that the allegation
\nmade by 9′ the ” the raid conducted by<\/p>\n
respondents-._i2~vto’  is  cannot be disbelieved. The<\/p>\n
  cor_1t.i*\u00ab%adi__ctions vifhich…are seen in the said documents speak<\/p>\n
 ‘v,olume,’a’bouitA”‘the behaviour and conduct of respondents 2<\/p>\n
t’ol\u00ab.G.W  made in complaint dated 19.9.2009,<\/p>\n
 Annexni’e–J also supports the contention of petitioners.<\/p>\n
9 \u00bb  ‘T  8. The counsel for petitioner submits that immediately<\/p>\n
after charge sheet was filed, he had filed criminal petition<\/p>\n

tried to substantiate before  Court;’–  to be
\nconcocted. It is  respondents while
\nconducting the raid has_not_  to seize the
\nmoney used  aJl.eged_act   used for the
\ngame like    They appear to have
\nseized   otherlarticie from the premises<\/p>\n
of petitioner without” “ju:s’ti’fsication.<\/p>\n
  The <'–$n'ti.r_e__yexercise of respondents 2 to 6 in this<\/p>\n
  but an act of extortion by respondents 2<\/p>\n
t'oi.6'  grati\ufb01cation and the conduct of 1st<\/p>\n
 respondenthin not looking into the complaint of 2nd petitioner<\/p>\n
 riated 19.9.2009 and not conducting an enquiry into the<\/p>\n
  and not taking any action in this behalf further<\/p>\n
it "strengthens the contention that he is also supportive of that.<\/p>\n
Therefore, this Court strongly note that the entire conduct of<\/p>\n

respondents 2 to 6 does not infuse any con\ufb01dence ‘this<\/p>\n
Court about the legitimacy oi’ raid conducted by the_ti_”i.onj;!<\/p>\n
petitioner premises on 16.09.2009.\n<\/p>\n
11. However, it suffice to say  <\/p>\n
State Government shall hold  4_enqu1’ry0 into tleei  *’<\/p>\n
conducted by respondents  Ir\u00a7~_thg..V-iprerr\ufb02ses of
\npetitioner and submit’  report  findings of
\nsuch enquiry and actionpgtaken  2 to 6 in
\nthis behalf a_\u00a7id”‘s_ubn1iit  court within 3
\nmonths   dated 16.09.2009
\ninvolving’   in fact several such instances<\/p>\n
have aisollllcsrne to._the”11o\u20acice of this Court by way of writ<\/p>\n
 })etiti’onsA,’ where’ii–1.s_e_rious allegations are made against the<\/p>\n
 ‘p:t)’l’iC\u20ac rig12t’frorn_’Constable to that of Commissioner of Police<\/p>\n
‘co\ufb01auc’\ufb01ng: raids on these clubs in the guise of<\/p>\n
‘V controllinghalleged illegai and irregular activity conducted in<\/p>\n
 such. clubs which are more in the nature of extortion. The<\/p>\n
 lg-{orne secretary is directed to issue necessary guidelines<\/p>\n
 “regarding the procedure to be followed by the officer before<\/p>\n
conducting such raid and the nature of materials to be<\/p>\n

seized in such raid. The Home Secretary should also<\/p>\n
nominate a designated officer to receive comp1aints”*aga_.ir1st<\/p>\n

12. With these observations  <\/p>\n
petition is disposed of. While disposing of  l’ V<\/p>\n
the Home Secretary is also  to-.ppsuitablyinstruct its
\nofficers not to take   either against the
\npetitioners or pe:fso.ns vghici  in bringing to
\nthe notice   illegal::.hi.ghlhan(led behaviour of
\npolice  to send a copy of this
\norder to ‘Horne  proper implementation of<\/p>\n
direcftion;~ issuedin this order with reference to holding of<\/p>\n
 .enqni1ylagpai.nstrespondent 2 to 6 and to submit his report<\/p>\n
