Justice ANTONY DOMINIC\n\n Dated :24\/11\/2010\n\n O R D E R\n                     ANTONY DOMINIC, J.\n                   ================\n                W.P.(C) NO. 34936 OF 2010\n               =====================\n         Dated this the 24th day of November, 2010\n\n                          J U D G M E N T\n<\/pre>\n<p>     Petitioners   completed    MBBS     course    from    the<\/p>\n<p>Government Medical College in the State of Kerala. They got<\/p>\n<p>admission in the merit Quota, in terms of the prospectus<\/p>\n<p>and bonds were executed agreeing to do rural service.<\/p>\n<p>     2. On completion of the course, petitioners are required<\/p>\n<p>to do rural service for one year. Although, petitioners do not<\/p>\n<p>dispute the liability for rendering rural service, contention<\/p>\n<p>raised is that since they are preparing for the entrance<\/p>\n<p>examination for post graduate courses, they should not be<\/p>\n<p>compelled to render rural service, atleast till their P.G.<\/p>\n<p>admission process is completed. Seeking such relaxation,<\/p>\n<p>they filed Ext.P4 representation before the first respondent.<\/p>\n<p>But there was no reply to the said representation. It is in<\/p>\n<p>these circumstances Writ Petition has been filed seeking<\/p>\n<p>relaxation from the bond obligation to the extend       stated<\/p>\n<p><span class=\"hidden_text\">W.P.(C) NO. 34936 OF 2010     2<\/span><\/p>\n<p>above.\n<\/p>\n<p>     3.   Learned     Government    Pleader    has  obtained<\/p>\n<p>instructions in the matter. It is stated that although the<\/p>\n<p>government is willing to relax the bond obligation to those<\/p>\n<p>who secure admission to post graduate courses, the<\/p>\n<p>Government is unwilling to exempt the doctors like the<\/p>\n<p>petitioners from the bond obligation at this stage.<\/p>\n<p>     4. Admittedly, the petitioners have the liability to<\/p>\n<p>render rural service on completion of their medical course.<\/p>\n<p>This is covered by the provisions of the prospectus and also<\/p>\n<p>the bond executed by the students. Any relaxation or<\/p>\n<p>modification of such obligation can only be on agreement,<\/p>\n<p>Government cannot be compelled by this court to grant any<\/p>\n<p>relaxation from the aforesaid obligation of the petitioners.<\/p>\n<p>Therefore, this court cannot require the government to<\/p>\n<p>relieve petitioner from the bond obligations.<\/p>\n<p>     5.
