The State of Bihar through the Secretary, Government of Bihar,\n   Patna.\n2. The Commissioner, Purnea Division, Purnea at District Purnea.\n3. The Collector, Katihar, District Katihar.\n4. D.G.P. and I.G. Karmik Department, Bihar, Patna.\n5. Superintendent of Police (Rail), Katihar, District Katihar.\n                                               -------- Respondents\n                             -----------\n<\/pre>\n<p>2       4.4.2011                 No   one    appears       on       behalf        of   the<\/p>\n<p>                     petitioner. Counsel for the State is present<\/p>\n<p>                     and    would     draw     attention            of     this       Court<\/p>\n<p>                     towards the resolution passed by the District<\/p>\n<p>                     Compassionate          Appointment         Committee             dated<\/p>\n<p>                     15.10.2007        (Annexure-A             to        the      counter<\/p>\n<p>                     affidavit),      wherein,       the       Committee,          having<\/p>\n<p>                     perused the documents on record, had passed<\/p>\n<p>                     an unanimous resolution for considering the<\/p>\n<p>                     case   of    appointment        of    the       petitioner         on<\/p>\n<p>                     compassionate          ground        on        the        post      of<\/p>\n<p>                     Constable,       subject    to       his       fulfilling          the<\/p>\n<p>                     minimum     prescribed       criteria               and    physical<\/p>\n<p>                     fitness.\n<\/p>\n<p>                                 Mr. Arora, learned counsel for the<\/p>\n<p>                     respondents would submit that he has got no<\/p>\n<p>                     further     instruction     as       to    what       action       has<\/p>\n<p>                     been taken on such recommendation made by the<\/p>\n<p>                     District Compassionate Appointment Committee.<br \/>\n<span class=\"hidden_text\">                      2<\/span><\/p>\n<p>                  This Court believes that the absence<\/p>\n<p>      of    the    counsel          for    the        petitioner        is<\/p>\n<p>      meaningful,         inasmuch         as,        on    the        said<\/p>\n<p>      recommendation, the process for appointment<\/p>\n<p>      must have been taken up.\n<\/p>\n<p>                  This Court, however, would not like<\/p>\n<p>      to go into the merit of the claim of the<\/p>\n<p>      petitioner, inasmuch as, the Committee has<\/p>\n<p>      made a qualified recommendation subject to<\/p>\n<p>      the   petitioner          being      physically           fit     and<\/p>\n<p>      fulfilling         the        prescribed        criteria          for<\/p>\n<p>      appointment        on    the     post      of    Constable        in<\/p>\n<p>      Police Department.\n<\/p>\n<p>                  That being so, this Court would only<\/p>\n<p>      direct the competent authority amongst the<\/p>\n<p>      respondents        to     ensure      that       if       a     final<\/p>\n<p>      decision on the said recommendation of the<\/p>\n<p>      Committee     has       not    already     been       taken,      the<\/p>\n<p>      same must be taken within a period of three<\/p>\n<p>      months from the date of receipt\/production of<\/p>\n<p>      a copy of this order.\n<\/p>\n<pre>                  With               the              aforementioned\n\n      observations,        this       application          is   disposed\n\n      of.\n\n\nRsh                                        (Mihir Kumar Jha, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Kanhaiya Lal vs The State Of Bihar &amp;Amp; Ors on 4 April, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA CWJC No.7068 of 2007 Kanhaiya Lal, son of late Hari Shanker Pandit, resident of Village Dumari Khal, P.O.
