PUBLIC PROSECUTOR for Respondent(s) :\n1, \n=========================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE Z.K.SAIYED\n\t\t\n\t\n\n \n\nDate\n: 08\/09\/2011\n \n\nORAL\nORDER<\/pre>\n<p>By<br \/>\n\tway of present application, filed under Section 439 of the Code of<br \/>\n\tCriminal Procedure, 1973, the applicant has prayed to release him on<br \/>\n\tregular bail in connection with CR No.I-38 of 2011 registered with<br \/>\n\tNakhatrana Police Station, Kachchh for the offence punishable under<br \/>\n\tSections 302, 365 and 34 of the Indian Penal Code.\n<\/p>\n<p>Heard<br \/>\n\tMr.S.V. Raju, learned senior counsel for the applicant and Mr.Maulik<br \/>\n\tNanavati, learned Additional Public Prosecutor for respondent-State.\n<\/p>\n<p>Mr.Raju,<br \/>\n\tlearned senior counsel for the applicant, has contended that the<br \/>\n\tdoctor has opined in the postmortem note that the deceased had died<br \/>\n\tbecause of failure of cardio respiratory and not because of the<br \/>\n\tinjury sustained by the deceased. It also appears from the<br \/>\n\tpostmortem report that there is no serious injury caused to the<br \/>\n\tdeceased which can have any nexus with the death of the deceased. He<br \/>\n\thas also read the statement of the witnesses and contended that<br \/>\n\tlooking to the facts of the case and overall circumstances,<br \/>\n\tapplicant may kindly be released on bail.\n<\/p>\n<p>Mr.Maulik<br \/>\n\tNanavati, learned Additional Public Prosecutor, has vehemently<br \/>\n\topposed the present application and contended that the applicant is<br \/>\n\tinvolved in a serious offence. Even prima-facie case is made out<br \/>\n\tagainst the applicant.\n<\/p>\n<p>In<br \/>\n\tthe facts and circumstances of the case and considering the nature<br \/>\n\tof allegations and role attributed to the applicant and now the<br \/>\n\tcharge-sheet is filed, without entering into the merits of the case,<br \/>\n\tprima facie, this Court is of the opinion that this is a fit case to<br \/>\n\texercise the discretion to enlarge the applicant on bail.\n<\/p>\n<p>Hence,<br \/>\n\tthe applicant is ordered to be released on bail in connection with<br \/>\n\tCR No.I-38 of 2011 registered with Nakhatrana Police Station,<br \/>\n\tKachchh, for the offence alleged against him in this application on<br \/>\n\this executing a bond of Rs.10,000\/- (Rupees ten thousand only) with<br \/>\n\tone solvent surety of the like amount to the satisfaction of the<br \/>\n\ttrial Court and subject to the conditions that he shall &#8211;\n<\/p>\n<p>a)\tnot<br \/>\ntake undue advantage of his liberty or\tabuse \this liberty;\n<\/p>\n<p>b)\tnot<br \/>\nto try to tamper or pressurise the prosecution \twitnesses or<br \/>\ncomplainant in any manner;\n<\/p>\n<p>c)\tmaintain<br \/>\nlaw and order and should cooperate the \tInvestigating Officer;\n<\/p>\n<p>d)\tnot<br \/>\nact in a manner injurious to the interest of\tthe prosecution;\n<\/p>\n<p>e)\tnot<br \/>\nleave the State of Gujarat without prior\tpermission of the Sessions<br \/>\nJudge concerned;\n<\/p>\n<p>f)\tfurnish<br \/>\nthe address of their residence to the\tInvestigating Officer\tand also<br \/>\nto the Court at the \ttime of execution of \tthe bond and shall<br \/>\nnot\tchange the residence without prior permission of\tthis Court;\n<\/p>\n<p>g)\tsurrender<br \/>\ntheir passport, if any, to the lower\tCourt within a week.\n<\/p>\n<p>If<br \/>\n\tthe breach of any of the above conditions is committed, the<br \/>\n\tconcerned Court will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>Bail<br \/>\n\tbefore the lower Court having jurisdiction to try the case. It would<br \/>\n\tbe open to the trial Court concerned to give time to furnish the<br \/>\n\tsolvency certificate if prayed for.
