Petitioner deposed as\n\nAPW:-i1_,5nti\"'--\u00ab_enxa'ifrviia~'hed Dr.B.K.Sudhakanth as PW--2. Ex.P--1\n\n _ to Ex---,P--:;4'3'.'were marked. No evidence was adduced by\n\n Vngthe,rr_esp'o\"ndents. Upon appreciation of the evidence placed\n\n r._on_n'r'e-cord, the Tribunal held that, the accident has taken\n\n mace on account of rash and negligent act on the part of\n\nR\n\n\/T.\n\nK\n\n\n\ndriver of Tata Sumo vehicle and as a result, the petitioner\n\nsustained injuries.\n\n3. - Considering the nature of injur.ie\u00bbs\"'..su'sftained,'~:\n\nthe treatment obtained, expenditure etc.',' and the.:_restiVl:t'a'Vnt \n\neffect, the tribunal has passed, the ayv..ard._ for Ry's\";y2:,34',OV0.C))2 it\n\nwith interest at 6% p.a from\"'1ii.\u00a7:'.\"O2.2i)O'O_V_ till j\"'.2sI1ii2;'2ooo\nand from 11.11.2003 tii:l~..p\ufb01ayF\"l'i'e'nl::i--:'jyylyhetaward\"passed by\nthe Tribunal has not been respondents.\nRespondents  trie  The appeal is\nby the  oilicompensation. Hence,\nit is issue relating to the\nactionable  of the driver of offending\nvehic|e_._V  ii i A it \n\n  _Lea._rned counsel appearing for the appellant\n\n the tribunal has not awarded just\n\nV it _ com'p'ensv--a't'ion\", after proper appreciation of the evidence on\n\n.recor_d and hence the record may be reconsidered and just\n\n i._co_m'pe'nsation awarded. Sri Sowri Raju, learned advocate\n\nndfapipearing for the first respondent insurance company\n\nt\n\n..\/\n\n,,,\u00bb\n\n\n\ncontended that, the tribuna! has taken into consideration\n\nevery minute detaiis of the matter, has ccnirectiy\n\nappreciated the evidence placed on its record:._a'nAd\"V-'.3-ftAe'a'~._._T'i.\n\nproper assessment of the injuries and the re'sd'i't-a_r:.tV\"effe,\u00a2t,c._ \"\n\nhas awarded the just compens.atio\"riA.'t'antd_\n\nenhancement is caiied for.\n\n5. In view of th\"e.__riva'.i'i'c'ohtenti'ons a\u00e9indvithei record,\nwhich we have perused,  is:\n   by the\n   ?\"\n6.1\" \"\"\"   \"._Wd'eVtJosed as PW--1.\nor.a.:&lt;.P-105 are the medical biiis. Ex.P~106 to\n\nA &#039;~:Ey&lt;.P~139 to Ex.P~143 are the\n\nt\n\nK,\n\n\n\n(3\n\noutpatient file and )(--rays. There is no dispute that,\n\naccident has occurred on account of negligent acts..o&#039;n__thVe\n\npart of the driver of the offending vehicle and  _\n\nthe appellant sustained injuries andmhas ta_Ew--2 has specifically\n\na\"d_m~liftted\" never conducted the surgery to the\n\n _ petiti'oneis.f\u00a7' -hlowever from the documents, it is clear that,\n\nu\"\":\".v4.4\"*--Vthe]app'e'llant had suffered anterior wedge compound\n\n._fr'a_Vctu~i~'e of D5 (thoracic) vertebrae with scalp laceration\n\nit  has taken treatment as an inpatient for about 11 days\n\n\n\n\n\nfrom 11.06.1998 to 19.06.1998 and thereafter from\n\n07.88.1998 upto 18.09.1998 and on 19.O6.1998','_\"Vh_Ve\n\nunderwent skin grafting, The amount \n\nhospitalisation are borne out of the records.,...w'ii2iVchi.::vv.hen'\"\n\ncaicuiated, would amount about \n\ntribunal has awarded. Conside-r_i4_ng the_\"period,,oi'~\nas an inpatient and  'towards\nnourishment, attendant'-r._&amp;  charges, the\ntribunal has awarded  &amp;\nRs.3,000\/-- resp\"eci'j;ixr.eiy.,:i-_which: isjtuvstl'aindireasonable. The\n\ninjuries must hiave 'n1ad'e3ffth:e'~-appieilant to lose income\n\nduring the __periVo'd.,--of\"tireaitrriveri't ~98: recovery and hence the\n\namount awardedV\"-at\".V,Rsi2Q,9OO\/-- is just compensation.\n\nV Considering the'inv_aVtVure:of injuries sustained, the amount\n\n the head 'pain and suffering' at\n\n appears to be marginaiiy low, but,\n\n _consi\"derir_i'gj \"the amount awarded under the head 'loss of\n\nfuture income', under which head appellant is not entitled\n\n best the appellant is only entitled to the\n\n..'_4\"coa--npensation towards 'loss of amenities', the Eow amount\n\n\n\nawarded under the head 'pain and suffering' is made up\n\nfrom the amount awarded under the head 'loss \n\nincome'.\n\n7. It is evident from the  \n\nthe appeiiant that, even after the~..Aa\"ccident,.\".;\"saia'ry'f=.,\n\nincome has not come down, w'he:reas, \"more\nthan the amount, which 'he wafs\"Veair.F}iVrig..\u00e9as onhthiew date of\naccident. If that be so, :a'bip'eii'an.t._:'ig.x_'rsd_t,i,.entitled to be\nawafded an'!  tt;iev~'he'aAd'i'i'i.ifCSs__,:of:future income'.\nThe amount?\"  Essie'.-'atitied to be awarded\nis oniyi\"'u'n'd'e.ri,i,thieiffwhead.,:'.\"!oss'_\"V'o'fVV: amenities and future\nunhappiriessiif,  awarded at Rs.30,000\/--,\n\nwhich in thie\"~fa'cts_}--anAc;', circumstances of the Case, is not\n\nthe sam'e\"'*cou|d be made up from the amount\n\n head 'Eoss of future income'. There is\n\nor.i'I=,{\"erro.r.in'i.Vaoportionment under different heads. When\n\n\"the overaiii picture is taken into consideration, the amount\n\ni'~1ia'ward~\u00abed at Rs.2,,34,000\/w by the tribunai is just\n\n compensation. Since there is no Eoss of future income, the\n\n'i\n\n.\/'\n\n\n\nI 0\n\nORDER\n<\/pre>\n<p>i. Appeai is ailowed in part.\n<\/p>\n<p>ii. The compensation awarded by the tribima:i&#8217;\u00ab\u00ab..&#8217;_i&#8217;at<\/p>\n<p>Rs.2,34,000\/&#8211; with interest at 6% <\/p>\n<p>compensation, is maintained.\n<\/p>\n<p>iii.
