Justice V.RAMKUMAR\n\n Dated :13\/07\/2010\n\n O R D E R\n                     V.RAMKUMAR, J.\n                ---------------------------------\n                 Tr.P.(Crl)No.35 of 2010\n                ----------------------------------\n          Dated this the 13th day of July, 2010\n\n                            ORDER\n<\/pre>\n<p>     Heard both sides.\n<\/p>\n<p>     Petitioner who is the wife of the second respondent<\/p>\n<p>herein is the applicant in M.C.No.30\/2010 on the file of<\/p>\n<p>the Chief Judicial Magistrate, Kozhikode under Section 12<\/p>\n<p>of the Protection of Women from Domestic Violence Act,<\/p>\n<p>2005. According to the petitioner even at the time of<\/p>\n<p>accepting the complaint the learned Magistrate openly<\/p>\n<p>declared that he will not allow the application as the<\/p>\n<p>same is an abuse of the process of Court and even after<\/p>\n<p>appearance of the second respondent husband the<\/p>\n<p>Magistrate was persistently compelling the petitioner to<\/p>\n<p>give-up the claim and go and reside with the respondent,<\/p>\n<p>inspite of the fact that she had been incessantly harassed<\/p>\n<p>(both physically and mentally) and assaulted and abused.<\/p>\n<p>The petitioner would have it that when her learned<\/p>\n<p>Tr.P.Crl.No.35\/2010<br \/>\n<span class=\"hidden_text\">                              : 2 :<\/span><\/p>\n<p>counsel made a submission about the impossibility of a<\/p>\n<p>re-union, the learned Magistrate accused the counsel by<\/p>\n<p>saying that he is standing in between. According to the<\/p>\n<p>petitioner she apprehends that the second respondent<\/p>\n<p>taking advantage of the situation will endanger the life of<\/p>\n<p>the petitioner. Going by proximity as well as the place<\/p>\n<p>where the petitioner resides the Magistrate at Mattannur<\/p>\n<p>in Kannur District is the appropriate court. She will not<\/p>\n<p>get a fair trial or justice from the Chief Judicial<\/p>\n<p>Magistrate, Kozhikode.\n<\/p>\n<p>      2.     This Court called for the remarks of the Chief<\/p>\n<p>Judicial Magistrate who has submitted his detailed<\/p>\n<p>remarks. He has wound up by saying that he had no<\/p>\n<p>special interest in the case, except the welfare and well-<\/p>\n<p>being of an innocent tiny child and he wished the re-union<\/p>\n<p>of the parents of the unfortunate child and that the<\/p>\n<p>allegations made against him in paragraph &#8216;4&#8217; of the<\/p>\n<p>transfer petition are false.\n<\/p>\n<p>Tr.P.Crl.No.35\/2010<br \/>\n<span class=\"hidden_text\">                               : 3 :<\/span><\/p>\n<p>      3.     I see no reason why the remarks of the learned<\/p>\n<p>Magistrate should not be accepted since he only wanted<\/p>\n<p>a    rapproachment       between     the  marital  partners.<\/p>\n<p>According to the Magistrate the petitioner who was filing<\/p>\n<p>interlocutory      applications    one  after  another  had<\/p>\n<p>eventually agreed to settle the matter and she had got<\/p>\n<p>two of the petitions dismissed as &#8220;not pressed&#8221; as<\/p>\n<p>evidenced by the endorsements made by her counsel.<\/p>\n<p>But thereafter she filed a complaint before the Kasaba<\/p>\n<p>Police Station against the second respondent for an<\/p>\n<p>offence under Section 498 A of I.P.C.           It was the<\/p>\n<p>petitioner who precipitated matters thereby rendering<\/p>\n<p>chance of reconciliation difficult. It is true that she is<\/p>\n<p>residing in Kannur District.        But then the property in<\/p>\n<p>respect of which residence order was claimed and the<\/p>\n<p>second respondent are all in Kozhikode. The petitioner<\/p>\n<p>also was of the view that the second respondent who<\/p>\n<p>belongs to Idukki District will not be available at<\/p>\n<p>Tr.P.Crl.No.35\/2010<br \/>\n<span class=\"hidden_text\">                              : 4 :<\/span><\/p>\n<p>Kozhikode. That was why she opted to file the application<\/p>\n<p>before the Chief Judicial Magistrate, Kozhikode. There is<\/p>\n<p>no case that the Chief Judicial Magistrate, Kozhikode has<\/p>\n<p>no jurisdiction to entertain this case.   Merely because<\/p>\n<p>some other court has also jurisdiction it cannot be said<\/p>\n<p>that the proceedings before the Kozhikode cannot be<\/p>\n<p>continued.        Any way, the Court of the Chief Judicial<\/p>\n<p>Magistrate, Kozhikode was a forum which was willingly<\/p>\n<p>chosen by the petitioner.
