Justice K.HEMA\n\n Dated :\/  \/\n\n O R D E R\n                                K.HEMA, J\n                            -----------------------\n                        B.A No.3628 OF 2010\n                       --------------------------------\n                Dated this the 18th day of June 2010\n\n                                  ORDER\n<\/pre>\n<p>          This petition is for anticipatory bail.\n<\/p>\n<p>      2. The alleged offences are under Sections 505(1)(b) and<\/p>\n<p>507 of IPC. According to prosecution, petitioner instigated first<\/p>\n<p>accused to make a phone call to certain persons stating that a<\/p>\n<p>bomb is kept in a hall wherein marriage is to be conducted and<\/p>\n<p>thereby cause panic among public.               First accused accordingly<\/p>\n<p>made phone calls to several persons as instructed by first<\/p>\n<p>accused and thereby caused panic in the public. On a complaint,<\/p>\n<p>first accused was arrested and on investigation, it is revealed that<\/p>\n<p>second accused also committed the offences.<\/p>\n<p>      3. Learned counsel for petitioner submitted that petitioner<\/p>\n<p>is the daughter of a freedom fighter.               Certain people are on<\/p>\n<p>inimical terms with her and she is falsely implicated in the case.<\/p>\n<p>First accused made calls from his grandfather&#8217;s number and her<\/p>\n<p>phone was not used by first accused. There is absolutely nothing<\/p>\n<p>to connect petitioner with the crime. Offence under Section 505<\/p>\n<p>is not attracted, since the calls made are to private individuals.<\/p>\n<p>The only non-bailable offence alleged is under Section 505, but<\/p>\n<p>that is not attracted, it is submitted..\n<\/p>\n<p><span class=\"hidden_text\">B.A No.3628 OF 2010                2<\/span><\/p>\n<p>      4.    This petition is opposed.    Learned Public Prosecutor<\/p>\n<p>submitted that petitioner is a relative of first accused and<\/p>\n<p>petitioner went to house of first accused and asked him to make<\/p>\n<p>the calls. First accused is aged only 18 years and petitioner is<\/p>\n<p>aged 36 years. According to first accused, she had told him that<\/p>\n<p>some amount is due from one Balaji to her and that is why phone<\/p>\n<p>calls were to be made. Petitioner&#8217;s interrogation will be required<\/p>\n<p>to find out why she has committed the offence.<\/p>\n<p>      5. On hearing both sides and on going through Case Diary, I<\/p>\n<p>am satisfied of the submissions made by the Learned Public<\/p>\n<p>Prosecutor.     Investigation is in progress and I am satisfied that<\/p>\n<p>petitioner is required for interrogation. This is not a fit case to<\/p>\n<p>grant anticipatory bail. As per Section 505 IPC, whoever makes<\/p>\n<p>or circulates any statement or rumor with intend to cause or<\/p>\n<p>which is likely to cause fear or alarm to the public or to any<\/p>\n<p>section of people, whereby any person may be induced to commit<\/p>\n<p>an offence against the State or against public tranquility will be<\/p>\n<p>liable under Section 505 IPC.        The only non-bailable offence<\/p>\n<p>involved in this case is under Section 505 IPC and other offences<\/p>\n<p>are, admittedly bailable.     On a reading of Section 505 IPC, it<\/p>\n<p>appears that petitioner has a strong and arguable case regarding<\/p>\n<p>involvement of the said Section in the case, in the light of the<\/p>\n<p><span class=\"hidden_text\">B.A No.3628 OF 2010                3<\/span><\/p>\n<p>expression contained in Section 505 IPC, &#8220;whereby any person<\/p>\n<p>may be induced to commit an offence against the Stage or<\/p>\n<p>against the public tranquility&#8221; etc. In the above circumstance, the<\/p>\n<p>following order is passed.\n<\/p>\n<p>         (1) Petitioner shall surrender before the Investigating<\/p>\n<p>              Officer within seven days from today.\n<\/p>\n<p>        (2) On such surrender, if petitioner is arrested, Section<\/p>\n<p>             505 of IPC will be treated as not included, for the<\/p>\n<p>             purpose of bail.\n<\/p>\n<p>                   Petition is disposed of accordingly.\n<\/p>\n<\/p>\n<p>                                                  K.HEMA<br \/>\n                                                   JUDGE<\/p>\n<p>vdv<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Miss Jaya Devi vs The Sub Inspector Of Police IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 3628 of 2010() 1.
