Leave granted.\n<\/p>\n<p>2.The  respondent  is an Executive Engineer working  in\t the<br \/>\nDepartment  of Water Resources of the  appellant-Government.<br \/>\nHe  worked as Assistant Engineer from 3.6.89 to\t 25.7.92  at<br \/>\nBhopal\tand after a short spell of six months again  he\t was<br \/>\ntransferred  to\t Bhopal in the promoted\t post  of  Executive<br \/>\nEngineer and he continued at Bhopal from 19.10.92 to 9.7.93.<br \/>\nThe Department initiated orders of transfer at the  instance<br \/>\nof   the  Chief\t Engineer.   The  respondent  came   to\t  be<br \/>\ntransferred from Bhopal to Jagdalpur vide proceedings  dated<br \/>\n9.7.93.\t He  challenged the correctness\t thereof  by  filing<br \/>\nO.A.No.489\/93 before the Administrative Tribunal at  Bhopal.<br \/>\nThe   Tribunal\tby  its\t order\tdated  7.8.93  allowed\t the<br \/>\napplication, quashed the order of transfer and directed that<br \/>\nit  would  be  open to the Government  to  pass\t appropriate<br \/>\norders\tfor  transfer on the administrative grounds  as\t per<br \/>\nrules  and  law.  It has also directed that  the  respondent<br \/>\nwould not be transferred during the period of ban.   Calling<br \/>\nin question the above order, this appeal, by special  leave,<br \/>\ncame to be filed.\n<\/p>\n<p>3.The main ground on which the Tribunal quashed the order of<br \/>\ntransfer was that since there was a ban imposed for transfer<br \/>\nof the officers during the period of President&#8217;s Rule  until<br \/>\nprior  approval of the Governor was obtained which  was\t not<br \/>\ndone  in  this case.  Therefore, the transfer  without\tsuch<br \/>\napproval  is bad in law.  The learned counsel appearing\t for<br \/>\nthe  State has placed before us the proceedings of  transfer<br \/>\ninitiated in File No.3(B)\/160\/93\/P\/31 which would show\tthat<br \/>\non  the\t recommendation\t made by  the  Chief  Engineer,\t the<br \/>\nrespondent  was\t proposed  to be  transferred  as  Executive<br \/>\nEngineer  from\tHydromateorology Division at Bhopal  to\t the<br \/>\noffice of the Supdtg.  Engineer, W.R.Circle, Jagdalpur in  a<br \/>\nvacant post.  When it was submitted to the Secretary,  after<br \/>\ngiving\tapproval, the Secretary despatched the file  to\t the<br \/>\nAdvisor\t to the Governor.  The Adviser to the  Governor\t has<br \/>\ngiven his approval on 9.7.93 and on the same day the  orders<br \/>\nof transfer came to be issued.\n<\/p>\n<p>4.\t It  is\t contended  for\t the  respondent  that\t the<br \/>\nrespondent had already worked at Jagdalpur from 1982 to 1989<br \/>\nand  when  he  was  transferred\t to  Bhopal,  there  was  no<br \/>\njustification  to  retransfer him again\t to  Jagdalpur.\t  We<br \/>\ncannot\tappreciate these grounds.  The courts  or  Tribunals<br \/>\nare not appellate forums to decide on transfers of  officers<br \/>\non  administrative  grounds.  The wheels  of  administration<br \/>\nshould\tbe allowed to run smoothly and the courts or  tribu-<br \/>\nnals  are  not\texpected to interdict  the  working  of\t the<br \/>\nadministrative system by transferring the officers to proper<br \/>\nplaces.\t  It is for the administration to  take\t appropriate<br \/>\ndecision  and  such decisions shall stand  unless  they\t are<br \/>\nvitiated either by malafides or by extraneous  consideration<br \/>\nwithout any factual background foundation.  In this case  we<br \/>\nhave  seen that on the administrative grounds  the  transfer<br \/>\norders came to be issued.  Therefore, we cannot go into\t the<br \/>\nexpediency of posting an officer at a particular place.\n<\/p>\n<p><span class=\"hidden_text\">500<\/span><\/p>\n<p>5.It is next contended that the approval of the Governor  is<br \/>\na  condition precedent.\t Unless the Governor gives  his\t ap-<br \/>\nproval,\t the  order of transfer is bad in law.\tWe  find  no<br \/>\nforce  in  the\tcontention.  Under the\tbusiness  rules\t the<br \/>\npowers\tof the Governor during emergency would be  delegated<br \/>\nto  various officers to be exercised on his behalf, We\thave<br \/>\nseen the proceedings that the papers have been placed before<br \/>\nthe  Adviser (A.S.). Obviously, the Adviser(A.S.)  had\tbeen<br \/>\ngiven  power  to appeal all the orders of transfer  and\t the<br \/>\nAdministrator  had given his approval on 9.7.1993.  When  he<br \/>\nhad given his approval, it should be deemed that he acted on<br \/>\nbehalf\tof the Governor in exercising the statutory  powers.<br \/>\nTherefore,  it\tis not necessary that  the  Governor  should<br \/>\npersonally  sign the orders.  Under the business rules\tonly<br \/>\nfiles in certain cases will be submitted to the Governor for<br \/>\nhis   personal\t consideration\tbut  not  all\tmatters\t  of<br \/>\nadministrative\troutine.  In this -view, the transfer  order<br \/>\nbeing an administrative routine, delegation has been made to<br \/>\nthe  adviser(A.S.).  Therefore,\t the order  of\ttransfer  is<br \/>\nperfectly legal and valid.\n<\/p>\n<p>6.It  is further contended that in an unfortunate  situation<br \/>\nthe  respondent&#8217;s  wife\t committed  suicide  leaving   three<br \/>\nchildren and he would suffer extreme hardship if has to work<br \/>\nin the tribal area.  This court cannot go into that question<br \/>\nof relative hardship.  It would be for the administration to<br \/>\nconsider  the  facts of a given case and mitigate  the\treal<br \/>\nhardship   in\tthe   interest\t of   good   and   efficient<br \/>\nadministrator.\t If there is any such hardship, it would  be<br \/>\nopen  to  the  respondent to make a  representation  to\t the<br \/>\nGovernment and it is for the Government to consider and take<br \/>\nappropriate decision in that behalf\n<\/p>\n<p>7.The\tappeal\t is   accordingly  allowed   but,   in\t the<br \/>\ncircumstances, without costs.\n<\/p>\n<p><span class=\"hidden_text\">501<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India State Of Madya Pradesh &amp; Ors vs Sri S.S.
