The presence of the other parties to the proceedings may<br \/>\n\tnot be required at this stage.\n<\/p>\n<p>\tThis<br \/>\n\tCourt on 20.1.2011 had passed the following<br \/>\n\torders:-\n<\/p>\n<p>&#8221;\tRule<br \/>\n\treturnable on 3rd March 2011. Stay of operation,<br \/>\n\timplementation and execution of the award on condition that the<br \/>\n\tapplicant-appellant Insurance Company deposits the amount of<br \/>\n\tcompensation awarded with costs and interest with the Tribunal<br \/>\n\twithin four weeks.&#8221;\n<\/p>\n<p>\tIt<br \/>\n\thas been declared by Mr.Meena, learned Counsel appearing for the<br \/>\n\tapplicant, that the amount has been deposited.\n<\/p>\n<p>\tUnder<br \/>\n\tthese circumstances, the ad-interim relief granted earlier shall<br \/>\n\tstand confirmed.  It is clarified that the present interim order<br \/>\n\tshall operate to the extent of execution and implementation of the<br \/>\n\taward against the applicant Insurance Company only.\n<\/p>\n<p>\tConsidering<br \/>\n\tthe facts and circumstances, out of the total amount deposited, 20%<br \/>\n\tof the amount shall be permitted to be withdrawn by the original<br \/>\n\tclaimants, save and except that the share of the minor concerned<br \/>\n\tshall be invested in FDR until the minor attains the age of<br \/>\n\tmajority, but the guardians of the minor would be entitled to the<br \/>\n\tperiodical interest.  It is further observed that upon attaining the<br \/>\n\tage of majority, the minor would be entitled to encash the FDR<br \/>\n\twithout there being any specific order of this Court.\n<\/p>\n<p>\tThe<br \/>\n\tremaining amount of 80% shall be invested by the Tribunal with a<br \/>\n\tnationalized Bank in FDR initially for a period of three years and<br \/>\n\tsuch investment shall be renewed from time to time until the appeal<br \/>\n\tis finally disposed of, but the original claimant(s) shall be<br \/>\n\tentitled for the periodical interest as and when it becomes due.<br \/>\n\tThe original FDR(s) shall be retained by the Nazir Department of the<br \/>\n\tTribunal.\n<\/p>\n<p>\tThe<br \/>\n\tapplication is allowed to the aforesaid extent.
