The document is<br \/>\nordered to be taken on record.\n<\/p>\n<p>2.\tThe<br \/>\npetitioner-original complainant has preferred this Revision<br \/>\nApplication under section 397 read with Section 401 of Criminal<br \/>\nProcedure Code, 1973 and challenged the order passed  by learned<br \/>\nAdditional Sessions Judge, Fast Track Court No.6, Bharuch below<br \/>\nExh-26 on 18.6.2008 in Criminal Appeal No.67 of 2007.\n<\/p>\n<p>3.\tThe<br \/>\npetitioner complainant lodged complaint under Section 138 of<br \/>\nNegotiable Instruments Act. After hearing, the trial Court convicted<br \/>\nthe respondents accused and sentenced them.\n<\/p>\n<p>4.\tFeeling<br \/>\naggrieved by the said decision, the respondents preferred Criminal<br \/>\nAppeal No.67 of 2007 before learned Additional Sessions Judge and<br \/>\nFast Track Court, Bharuch. The respondents filed application Exh-26<br \/>\nfor a direction to Nazir of the Court to accept Rs.75,000\/- being the<br \/>\namount of cheque contending that they were prepared to pay cheque<br \/>\namount of Rs.75,000\/- to the complainant but on account of their<br \/>\nfinancial condition, could not pay the same. It is also averred in<br \/>\nthe application that the respondents accused are prepared to deposit<br \/>\nthe amount of cheque in the Court and have no objection if the said<br \/>\namount is paid to the complainant.\n<\/p>\n<p>5.\tAfter<br \/>\nhearing, the learned Additional Sessions Judge, by his impugned<br \/>\norder, allowed the application and permitted the respondents accused<br \/>\nto deposit the amount. Being aggrieved by the said decision, the<br \/>\npetitioner complainant has preferred this Revision Application.\n<\/p>\n<p>6.\tI<br \/>\nhave heard learned advocate Mr.B.A.Surti for learned advocate<br \/>\nMr.Kunal S. Shah for the petitioner.\n<\/p>\n<p>7.\tIt<br \/>\nappears from the impugned order that the respondents accused showed<br \/>\ntheir desire to deposit the amount of cheque in the Court and the<br \/>\nCourt permitted them to deposit the amount. Learned advocate Mr.Surti<br \/>\nhas submitted that by the impugned order petitioner is compelled to<br \/>\ncompound the offence. The copy of the application does not indicate<br \/>\nthat the amount was sought to be deposited with a view to compel the<br \/>\npetitioner to compound the offence. Even compounding of offence can<br \/>\nnot be unilateral. Therefore, by merely permitting the respondents<br \/>\naccused to deposit the amount,it cannot be said that the petitioner<br \/>\nis compelled to compound the offence. The impugned order except<br \/>\npermitting deposit of amount does not finally decide any right  of<br \/>\npetitioner. Therefore order under challenge is an interlocutory<br \/>\norder. In the decision of Amar Nath and others Vs. State of Haryana<br \/>\nand others reported in AIR 1977 SCC 2185 Hon&#8217;ble Supreme Court held<br \/>\nas under:-\n<\/p>\n<p>?SThe<br \/>\nterm ?Sinterlocutory order?? in Section 397(2) has been used in a<br \/>\nrestricted sense and not in any broad or artistic sense. It merely<br \/>\ndenotes orders of a purely interim or temporary nature which do not<br \/>\ndecide or touch the important rights or the liabilities of the<br \/>\nparties. Any order which substantially affects the right of the<br \/>\naccused, or decides certain rights of the parties cannot be said to<br \/>\nbe an interlocutory order so as to bar a revision to the High Court<br \/>\nagainst that order, because that would be against the very object<br \/>\nwhich formed the basis for insertion of this particular provision in<br \/>\nSection 397. Thus, for instance, orders summoning witnesses,<br \/>\nadjourning cases, passing orders  for bail , calling for reports and<br \/>\nsuch other steps in aid of the pending proceeding, may no doubt<br \/>\namount to interlocutory orders against which no revision would  lie<br \/>\nunder Section 397(2). But orders which are matters of moment and<br \/>\nwhich affect or adjudicate the rights of the accused or a particular<br \/>\naspect of the trial cannot be said to be interlocutory order so as to<br \/>\nbe outside the purview of the revisional jurisdiction of the High<br \/>\nCourt.?S <\/p>\n<p>8.\tIn<br \/>\nview above legal preposition laid down by the Hon&#8217;ble Supreme Court,<br \/>\nthe order under challenge being interlocutory order, no Revision<br \/>\nApplication would lie. Therefore, the present application cannot be<br \/>\nentertained.\n<\/p>\n<p>9.\tIt<br \/>\nis observed in the impugned order that it is for the complainant to<br \/>\nsettle the matter or not and whether to withdraw the amount deposited<br \/>\nin the Court. Therefore, the Court has only permitted the respondents<br \/>\naccused to deposit the amount and has not compelled the petitioner<br \/>\ncomplainant either to  compound the offence or to withdraw the<br \/>\namount. Therefore by the impugned order, no prejudice is likely to be<br \/>\ncaused to the petitioner complainant.\n<\/p>\n<p>10.\tIn<br \/>\nview of above,this application does not merit acceptance. Hence,<br \/>\napplication fails and stands dismissed.\n<\/p>\n<p>(Bankim<br \/>\nN.
