BASANT, J.\n              -------------------------------------------\n                       B.A. NO. 6819 of 2007\n               -------------------------------------------------\n        Dated this the 12th day of November, 2007\n\n                                ORDER\n<\/pre>\n<p>      Application for regular bail.                  The petitioner faces<\/p>\n<p>allegations for offences punishable, inter alia, under Secs.<\/p>\n<p>364A and 120B of the IPC.            The petitioner was arrested on<\/p>\n<p>24\/10\/07. He continues in custody from that date.<\/p>\n<p>      2. The crux of the allegations against the petitioner is<\/p>\n<p>that the de facto complainant had a monitory dispute with the<\/p>\n<p>1st accused.   Because of such strain in their relationship, the<\/p>\n<p>1st accused had entered into a conspiracy along with other<\/p>\n<p>accused.    Accused 2 to 10 were engaged                       to perform the<\/p>\n<p>physical act of taking away the victim in a Qualis car to a<\/p>\n<p>place where he was detained secretly.                 He had attempted to<\/p>\n<p>escape from custody.        He was allegedly manhandled.                 The<\/p>\n<p>petitioner had come to this Court earlier with an application<\/p>\n<p>for   anticipatory    bail.      By      order       dated       16\/10\/07  in<\/p>\n<p>B.A.No.6152\/07, that application was dismissed.                          The<\/p>\n<p><span class=\"hidden_text\"> B.A. NO. 6819 of 2007        -: 2 :-<\/span><\/p>\n<p>petitioner had later surrendered before the learned Magistrate<\/p>\n<p>on 24\/10\/07. He continues in custody from that date. He was<\/p>\n<p>given over to the police custody. He was allegedly interrogated<\/p>\n<p>and some recoveries were effected also, it is submitted.<\/p>\n<p>Altogether, there are 13 accused persons. Accused 1, 7 and 11<\/p>\n<p>to 13 alone have been apprehended so far. Investigation is in<\/p>\n<p>progress.\n<\/p>\n<p>      2. The learned counsel for the petitioner submits that the<\/p>\n<p>petitioner is absolutely innocent.    He prays that he may be<\/p>\n<p>enlarged on bail.\n<\/p>\n<p>      3. The learned Public Prosecutor opposes the application<\/p>\n<p>for regular bail. The learned Public Prosecutor submits that the<\/p>\n<p>co-accused have not been arrested so far.   The police have had<\/p>\n<p>no reasonable and sufficient time, after the arrest of the<\/p>\n<p>petitioner, to complete the investigation. It is true that two of<\/p>\n<p>the accused persons i.e., accused 12 and 13 have already been<\/p>\n<p>granted regular bail by this Court.   They were released on bail<\/p>\n<p>after they spent a long period of time in custody.      In these<\/p>\n<p>circumstances, the petitioner may not be enlarged on bail now<\/p>\n<p><span class=\"hidden_text\"> B.A. NO. 6819 of 2007          -: 3 :-<\/span><\/p>\n<p>submits the learned Public Prosecutor.\n<\/p>\n<p>      4. I have considered all the relevant inputs. While I find<\/p>\n<p>merit in the submission of the learned Public Prosecutor that the<\/p>\n<p>police is entitled for reasonable time after the arrest of the<\/p>\n<p>petitioner to complete the investigation, I am not persuaded to<\/p>\n<p>agree that the petitioner must be compelled to remain in custody<\/p>\n<p>endlessly   to   facilitate  completion    of   the  investigation.<\/p>\n<p>Reasonable further time can be granted           to the police to<\/p>\n<p>complete the investigation.    The petitioner can now be granted<\/p>\n<p>regular bail subject to appropriate conditions, I am satisfied.<\/p>\n<p>      5.   In the result:\n<\/p>\n<p>      (a) This application is allowed.     The petitioner shall be<\/p>\n<p>released on bail on the following terms and conditions:<\/p>\n<p>      (i) The petitioner shall not be released from custody on the<\/p>\n<p>strength of this order prior to 22\/11\/07. The Investigator shall,<\/p>\n<p>in the meantime,       make every endeavour to complete the<\/p>\n<p>investigation.\n<\/p>\n<p>      (ii) The petitioner shall execute a bond for Rs.1,00,000\/-<\/p>\n<p>(Rupees one lakh only) with two solvent sureties each for the<\/p>\n<p><span class=\"hidden_text\">  B.A. NO. 6819 of 2007         -: 4 :-<\/span><\/p>\n<p>like sum to the satisfaction of the learned Magistrate.<\/p>\n<p>      (iii) The petitioner shall make himself available        for<\/p>\n<p>interrogation before the Investigating Officer on all Mondays and<\/p>\n<p>Fridays between 10 a.m. and 12 noon for a period of three<\/p>\n<p>months     and  thereafter    as   and   when      directed by the<\/p>\n<p>Investigating Officer in writing to do so.<\/p>\n<p>                                                     Sd\/-\n<\/p>\n<p>\n                                              (R.
