PUBLIC PROSECUTOR\nfor Applicant(s) :\n1, \nMR.FAIYAZ I SHAIKH for Respondent(s) : 1 -\n2. \n=========================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE Z.K.SAIYED\n\t\t\n\t\n\n \n\nDate\n: 21\/01\/2011\n \n\nORAL\nORDER<\/pre>\n<p>By<br \/>\n\tway of present application, the applicant-State of Gujarat has inter<br \/>\n\talia prayed to cancel the order of granting regular bail to the<br \/>\n\trespondents-accused vide order dated 15th April 2010<br \/>\n\tpassed by the learned Additional Sessions Judge, Court No.18,<br \/>\n\tAhmedabad City in Criminal Miscellaneous Application No.1266 of<br \/>\n\t2010.\n<\/p>\n<p>Heard<br \/>\n\tMr.H.L. Jani, learned Additional Public Prosecutor and Mr.Faiyazi<br \/>\n\tShaikh, learned counsel for the respondents-accused.\n<\/p>\n<p>Mr.Faiyazi<br \/>\n\tShaikh produced on record order dated 01st November 2010<br \/>\n\tpassed by the learned Additional Sessions Judge, Court No.16,<br \/>\n\tAhmedabad whereby the condition No.6 i.e. &#8220;applicants are<br \/>\n\tdirected to mark their presence before the concerned Police Station<br \/>\n\ttill the trial is over&#8221; imposed<br \/>\n\tby the learned Additional Sessions<br \/>\n\tJudge, Court No.18, Ahmedabad is deleted and exempted the<br \/>\n\trespondent No.1-Mohammed Hanif @ Annubhai Abdulbhai Sheikh from<br \/>\n\tmarking his presence on every 5th day of the calendar<br \/>\n\tmonth.\n<\/p>\n<p>In<br \/>\n\tview of order dated  01st November 2010 passed by the<br \/>\n\tlearned Additional Sessions Judge, Court No.16, Ahmedabad produced<br \/>\n\ton record by Mr.Shaikh, Mr.Jani, learned Additional Public<br \/>\n\tProsecutor, does not press the present application qua the<br \/>\n\trespondent No.1- Mohammed Hanif @ Annubhai Abdulbhai Sheikh.\n<\/p>\n<p>In<br \/>\n\tview of above, present application is disposed of as not pressed qua<br \/>\n\trespondent No.1- Mohmmed Hanif @ Annubhai Abdulbhai Sheikh. Rule is<br \/>\n\tdischarged qua respondent No.1.\n<\/p>\n<p>Mr.Jani,<br \/>\n\tlearned Additional Public Prosecutor, has contended that the the<br \/>\n\trespondent No.2 was released on regular bail by the learned trial<br \/>\n\tJudge on several conditions, one of which is &#8220;applicants<br \/>\n\tare directed to mark their presence before the concerned Police<br \/>\n\tStation till the trial is over&#8221;. He<br \/>\n\thas further contended that despite the condition imposed upon him,<br \/>\n\tthe present respondent No.2 has never bothered to mark his presence<br \/>\n\tbefore the concerned Police Station till today. Mr.Jani has also<br \/>\n\tcontended that the respondent No.2 is involved in a serious offence<br \/>\n\tpunishable under Sections 307, 143, 147, 149, 323, 324, 294(B) of<br \/>\n\tthe Indian Penal Code read with Section 135(1) of the Bombay Police<br \/>\n\tAct. Mr.Jani has contended that to maintain law and order situation<br \/>\n\tand to secure his presence<br \/>\n\tat the time of trial, the said condition is imposed upon the<br \/>\n\trespondent No.2, but respondent No.2 has never bothered to follow<br \/>\n\tthe condition imposed upon him. He, therefore, contended that the<br \/>\n\torder dated 15th<br \/>\n\tApril 2010 passed by the learned Additional Sessions Judge, Court<br \/>\n\tNo.18, Ahmedabad City in Criminal Miscellaneous Application No.1266<br \/>\n\tof 2010 is required to be cancelled qua the respondent No.2.\n<\/p>\n<p>\tMr.\n<\/p>\n<p>\tFaiyazi Shaikh, learned counsel for the respondents-accused, has<br \/>\n\tcontended that it is true that respondent No.2 has never appeared<br \/>\n\tbefore the concerned Police Station as per the condition imposed<br \/>\n\tupon him. He has also contended that at the same time it is also<br \/>\n\ttrue that the respondent No.2 is not involved in any other offence<br \/>\n\ttill date. Mr.Shaikh has also contended that the respondent No.2 is<br \/>\n\tregularly appearing before the trial Court. He, therefore, contended<br \/>\n\tthat some lenient view is required to be taken and the present<br \/>\n\tapplication is required to be dismissed.\n<\/p>\n<p>\tI<br \/>\n\thave gone through the papers produced before me as well as<br \/>\n\tsubmissions advanced by the learned counsel for the parties. I have<br \/>\n\talso gone through the order passed by the learned trial Judge.\n<\/p>\n<p>Looking<br \/>\n\tto the papers, it appears that while enlarging the respondent<br \/>\n\tNo.2-accused on bail, certain conditions were imposed upon him by<br \/>\n\tthe learned trial Judge and the respondent No.2-accused has never<br \/>\n\tbothered to follow the same.\n<\/p>\n<p>\tIt also appears from the order dated 01st<br \/>\n\tNovember 2010 passed by the learned Additional Sessions Judge, Court<br \/>\n\tNo.16, Ahmedabad passed in Criminal Miscellaneous Application<br \/>\n\tNo.3689 of 2010, application filed by the respondent No.2 for<br \/>\n\texemption from marking presence is rejected. Looking to the<br \/>\n\tsubmissions advanced by the learned counsel, it appears that the<br \/>\n\trespondent No.2 has never marked his presence before the concerned<br \/>\n\tPolice Station. It also appears from the papers that the respondent<br \/>\n\tNo.2 is involved in a serious offence punishable under Section 307<br \/>\n\tof the Indian Penal Code and he is a head strong person. Hence, I<br \/>\n\tpass following order:\n<\/p>\n<p>&#8220;order<br \/>\ndated 15th April 2010 passed by the learned<br \/>\nAdditional Sessions Judge, Court No.18, Ahmedabad City in Criminal<br \/>\nMiscellaneous Application No.1266 of 2010 is hereby cancelled and set<br \/>\naside qua respondent No.2-Mohmmed Imran Mohmmed Hanif Sheikh.<br \/>\nRespondent No.2 is hereby directed to surrender himself immediately<br \/>\nbefore the Police Authority.&#8221;\n<\/p>\n<p>\tIn<br \/>\n\tview of above observations, present application is partly allowed.<br \/>\n\tRule is made absolute qua respondent No.2.\n<\/p>\n<p>(Z.\n<\/p>\n<p>K.
