Justice V.GIRI\n\n Dated :17\/12\/2007\n\n O R D E R\n                              V.GIRI, J\n\n                            -------------------\n\n                       W.P.(C). 35323\/2007\n\n                            --------------------\n\n        Dated this  the   17th  day of December, 2007\n\n\n                            JUDGMENT\n<\/pre>\n<p>             Petitioner   was   compulsorily   retired     from   the<\/p>\n<p>service     of   the   Electricity   Board   with   effect   from<\/p>\n<p>30.6.1999.     Aggrieved   by   the   delay   in   the   disbursal     of<\/p>\n<p>retirement       benefits   due   to   him,   petitioner     had<\/p>\n<p>approached   this   Court     earlier   in  W.P.(C).6111\/2005<\/p>\n<p>which   was   disposed   of   directing     the   respondents     to<\/p>\n<p>consider   his   claim   in   accordance   with   law.     By   Ext.P1,<\/p>\n<p>pension   and   gratuity     was   sanctioned   in   favour   of   the<\/p>\n<p>petitioner.     At   the   same   time,     commutation     of   family<\/p>\n<p>pension was not sanctioned.  Petitioner submitted  Ext.P2,<\/p>\n<p>aggrieved     by   the   non   sanctioning   of     commutation   of<\/p>\n<p>pension and certain other benefits.  By Ext.P3,   petitioner<\/p>\n<p>was   directed   to   apply   for   commutation   of   pension   after<\/p>\n<p>sanction from the Medical Board.\n<\/p>\n<\/p>\n<p>2.    It is obvious that the petitioner&#8217;s request is pending<\/p>\n<p>consideration.   In my view, there is nothing   illegal about<\/p>\n<p>the  requirement of a sanction  from the  Medical Board in<\/p>\n<p>W.P.(C).35323\/2007<\/p>\n<p><span class=\"hidden_text\">                                  2<\/span><\/p>\n<p>the   matter   of   commutation   of   pension.     Therefore,<\/p>\n<p>petitioner   shall   subject   himself   for   medical   examination<\/p>\n<p>and produce a certificate from the Medical  Board.   This<\/p>\n<p>shall be done within a period of six  weeks  from the date<\/p>\n<p>of   receipt   of   a   coy   of   this   judgment   and   thereupon,<\/p>\n<p>petitioner&#8217;s  request  of commutation  of pension shall be<\/p>\n<p>considered   and     appropriate   orders   be   passed       within<\/p>\n<p>two months thereafter.  Claim made by the petitioner  for<\/p>\n<p>other benefits,     under Ext.P2   shall also   be looked into<\/p>\n<p>and   appropriate     decision     be   taken     by   the   first<\/p>\n<p>respondent within  the same period.<\/p>\n<p>        With   the   above   observations,   writ   petition   is<\/p>\n<p>disposed of.\n<\/p>\n<\/p>\n<p>                                       V.GIRI,<\/p>\n<p>                                       Judge<\/p>\n<p>mrcs<\/p>\n<p>W.P.(C).35323\/2007<\/p>\n<p><span class=\"hidden_text\">                      3<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court K.J.
