SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 26\/07\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>\tBy<br \/>\n\tway of this petition under Sec.482 of the Code of Criminal Procedure<br \/>\n\t  the petitioner  &#8211; original<br \/>\n\taccused has prayed for the following main reliefs in para 7 :-\n<\/p>\n<p>&#8220;(B).\t\tThe<br \/>\nHon&#8217;ble Court be pleased to grant permanent exemption to petitioner<br \/>\n from personal appearance and permit the petitioner<br \/>\n to record her plea and contest her case through counsel,<br \/>\npending before Addl. Sr. Civil Judge and J.M.F.C., Bhavnagar in<br \/>\nCriminal Case No.4650\/2010;\n<\/p>\n<p>(C).\t\t The<br \/>\nHon&#8217;ble Court be pleased to quash the arrest warrant or convert it<br \/>\ninto bailable warrant isused in Criminal Case No.4650\/2010 on<br \/>\n27.6.2011 pending  before Addl. Sr. Civil Judge and J.M.F.C. at<br \/>\nBhavnagar.\n<\/p>\n<p>(D).\t\tPending<br \/>\nadmission hearing and till final disposal of the present petition,<br \/>\nthe Hon&#8217;ble Court be pleased  to stay the operation of arrest warrant<br \/>\nissued in pursuance to order dated 27\/6\/2011 by the trial court in<br \/>\nCriminal Case No.4650\/2010 at Bhavnagar.&#8221;\n<\/p>\n<p>\tThe<br \/>\n\tlearned advocate appearing on<br \/>\n\tbehalf of the petitioner  has stated at the bar that he does<br \/>\n\tnot press the present petition in terms of para 7(C) and 7(D).<br \/>\n\tTherefore, present petition is dismissed as not pressed so far as<br \/>\n\tthe prayer in terms of para 7(C) and 7(D).\n<\/p>\n<p>\tSo<br \/>\n\tfar as the prayer in terms of para 7(B) is concerned Mr.Manish Shah,<br \/>\n\tlearned advocate appearing on<br \/>\n\tbehalf of the petitioner  has stated at the bar that the<br \/>\n\tpetitioner  shall remain<br \/>\n\tpresent before the concerned Magistrate pursuant to the Non-Bailable<br \/>\n\tWarrant on 5\/8\/2011, however, he has requested that suitable<br \/>\n\tdirections be issued directing the learned Magistrate to record the<br \/>\n\tplea of the petitioner  on<br \/>\n\tthe very day and liberty be reserved in favour of the petitioner<br \/>\n\t to submit appropriate application for permanent exemption<br \/>\n\tand the learned Magistrate  may be directed to consider the same on<br \/>\n\tsuitable terms and directions. With above liberty, he does not<br \/>\n\tpress the present petition.\n<\/p>\n<p>\tIn<br \/>\n\tview of the above statement made by Mr.Manish Shah, learned<br \/>\n\tadvocate appearing on behalf of the petitioner  present<br \/>\n\tpetition is dismissed as not pressed even with respect to prayer in<br \/>\n\tterms of para 7(B).
