(C) No.22245 of 2008)\n\n\nAllahabad Bank                                                ...Appellant(s)\n\n\n                                   Versus\n\n\nManoj Khanna &amp; Ors.                                          ...Respondent(s)<\/pre>\n<pre>                              O    R   D    E    R\n\n\n       Leave granted.\n<\/pre>\n<p>       Heard learned counsel for the parties.<br \/>\n       The   Trial    Court       decreed       the   suit   for   recovery   of<br \/>\narrears of rent.     Against the said order, the appellant filed<br \/>\nregular appeal along with an application for condonation of<br \/>\ndelay of fifty eight days in filing the same.                        The lower<br \/>\nappellate court rejected the application for condonation of<br \/>\ndelay and dismissed the appeal as barred by time.                     The said<br \/>\norder has been confirmed by the High Court in second appeal.<br \/>\nHence, this appeal by special leave.\n<\/p>\n<p>       Having     heard   learned      counsel        for    the   parties    and<br \/>\nperused the records, we are of the view that, in the facts<br \/>\nand circumstances of the case, lower appellate court should<br \/>\nhave condoned the delay in filing the appeal.\n<\/p>\n<p>       Accordingly, the appeal is allowed, impugned orders<br \/>\npassed by the lower appellate court as well as the High Court<br \/>\nare set aside, delay in filing the appeal before the lower<br \/>\nappellate court    is condoned and the matter is remitted to it<br \/>\n                                                                        &#8230;2\/-\n<\/p>\n<p>                           &#8211; 2 &#8211;\n<\/p>\n<p>to decide the regular appeal on merits in accordance with law<br \/>\nafter giving opportunity of hearing to the parties.\n<\/p>\n<p>       Let hearing of the appeal be expedited.\n<\/p>\n<p>                                     &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;.J.\n<\/p>\n<p>                                     [B.N.
