DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 21\/03\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\tRule.\n<\/p>\n<p>Learned APP, waives service of notice of Rule for respondent &#8211; State.\n<\/p>\n<p>2.\tThis<br \/>\napplication is filed under Section 438 of the Code of Criminal<br \/>\nProcedure in connection with first information report registered at<br \/>\nCR No.I-8 of 2011 with Vadgam Police Station, District: Banaskantha,<br \/>\nfor the offences punishable under Sections 498(A), 323, 506(2), 114<br \/>\nand 306 of the Indian Penal Code.\n<\/p>\n<p>3.\tLearned<br \/>\ncounsel for the applicant submits that  the applicant aged about 19<br \/>\nyears and studying in ITI against whom allegations have been levelled<br \/>\nand a brief mention is made in dying declaration by the victim along<br \/>\nwith other two female co-accused out of which grandmother is enlarged<br \/>\nby learned Sessions Judge and considering the above aspect, the<br \/>\napplicant may be granted anticipatory bail.\n<\/p>\n<p>4.\tHeard<br \/>\nLearned APP for the respondent &#8211; State.\n<\/p>\n<p>5.\tHaving<br \/>\nheard learned counsel for the parties and perusing the record of the<br \/>\ncase and taking into consideration the facts of the case,  I am<br \/>\ninclined to grant anticipatory bail to the applicant.  This Court has<br \/>\nalso taken into consideration the law laid down by the Apex Court in<br \/>\nthe case of <a href=\"\/doc\/1108032\/\">Siddharam Satlingappa Mhetre v. State of<br \/>\nMaharashtra &amp; Ors. Reported<\/a> in [2011]1 SCC 694, wherein<br \/>\nthe Apex Court reiterated the law laid down by the Constitutional<br \/>\nBench in the case of Shri Gurubaksh Singh Sibbia &amp; Ors.<br \/>\nReported in [1980]2 SCC 565.\n<\/p>\n<p>6.\tLearned<br \/>\ncounsel for the parties do not press for further reasoned order.\n<\/p>\n<p>7.\tIn<br \/>\nthe result, this application is allowed by directing that in the<br \/>\nevent of the applicant herein being arrested pursuant to FIR being CR<br \/>\nNo.I-8 of 2011 with Vadgam Police Station, District: Banaskantha, the<br \/>\napplicant shall be released on bail on furnishing a bond of<br \/>\nRs.10,000\/- (Rupees Ten Thousand only) with one surety of like amount<br \/>\non following conditions :-\n<\/p>\n<p>[a]\tshall<br \/>\ncooperate with the investigation and make himself available for<br \/>\ninterrogation whenever required.\n<\/p>\n<p>[b]\tshall remain<br \/>\npresent at concerned Police Station on  25.3.2011 between 11:00 am to<br \/>\n2:00 pm:\n<\/p>\n<p>[c]\tshall not<br \/>\nhamper the investigation in any manner nor shall directly or<br \/>\nindirectly make any inducement, threat or promise to any witness so<br \/>\nas to dissuade them from disclosing such facts to the Court or to any<br \/>\nPolice Officer;\n<\/p>\n<p>[d]\tshall at the<br \/>\ntime of execution of bond, furnish the address to the Investigating<br \/>\nOfficer and the Court concerned and shall not change the residence<br \/>\ntill the final disposal of the case or till further orders;\n<\/p>\n<p>[e] \twill not<br \/>\nleave India without the permission of the Court and, if is holding a<br \/>\nPassport, shall surrender the same before the trial Court immediately<\/p>\n<p>[f]\tIt would be<br \/>\nopen to the Investigating Officer to file an application for remand,<br \/>\nif he considers it just and proper and the concerned Magistrate would<br \/>\ndecide it on merits.\n<\/p>\n<p>[g]\tdespite this<br \/>\norder, it would be open for the Investigating Agency to apply to the<br \/>\ncompetent Magistrate, for police remand of the applicant. The<br \/>\napplicant shall remain present before the learned Magistrate on the<br \/>\nfirst date of hearing of such application and on all subsequent<br \/>\noccasions, as may be directed by the learned Magistrate. This would<br \/>\nbe sufficient to treat the accused in the judicial custody for the<br \/>\npurpose of entertaining application of the prosecution for police<br \/>\nremand. This is, however, without prejudice to the right of the<br \/>\naccused to seek stay against an order of remand, if ultimately<br \/>\ngranted, and the power of the learned Magistrate to consider such a<br \/>\nrequest in accordance with law. It is clarified that the applicant,<br \/>\neven if, remanded to the police custody, upon completion of such<br \/>\nperiod of police remand, shall be set free immediately, subject to<br \/>\nother conditions of this anticipatory bail order.\n<\/p>\n<p>8.\tRule<br \/>\nmade absolute.
