1.\t\tThe
\ncase of the petitioner is that he is being summoned by the Police
\nOfficer of the Gorva Police Station, for which a ‘Summons’ has been
\nissued, which is produced at  Annexure-H .\n<\/p>\n
Upon perusal of the said document, it clearly emerges that the
\nsummons is issued under the purported exercise of powers under
\nSection 156 of the Code of Criminal Procedure, by the Police
\nInspector, Gorva, Vadodara. It is stated in the said document that
\none Dr. Sarla Brijsunder Patra has filed a complaint against the
\npetitioner, in the office of Commissioner of Police, Vadodara.
\nSince, he is inquiring into the said application, it is necessary to
\nrecord the statement of the petitioner. The petitioner should,
\ntherefore, remain present before the Gorva Police Station, for giving
\nhis statement within two days of the receipt
\nof the said summons.\n<\/p>\n
2.\t\tSection
\n160 of the Code of Criminal Procedure pertains to Police Officer’s
\npower to require attendance of witnesses. It reads as follows:\n<\/p>\n

\nPolice officer’s power to require attendance of witnesses.
\n(1) Any police officer, making an investigation under this Chapter
\nmay, by order in writing, require the attendance before himself of
\nany person being within the limits of his own or any adjoining
\nstation who, from the information given or otherwise, appears to be
\nacquainted with the facts and circumstances of the case; and such
\nperson shall attend as so required: Provided that no male person
\nunder the age of fifteen years or woman shall be required to attend
\nat any place other than the place in which such male person or woman
\nresides. (2)The State Government may, by rules made in this behalf,
\nprovide for the payment by the police officer of the reasonable
\nexpenses of every person, attending under sub-section (1) at any
\nplace other than his residence.\n<\/p>\n
3.\t\tUpon
\nperusal of the said Section, in particular, sub-Section 1 thereof, it
\nbecomes clear that any Police Officer, who is making investigation
\nunder Chapter XII, may be, by an order in writing, require attendance
\nof any person before him, who appears to be acquainted with
\nthe facts and circumstances of the case.\n<\/p>\n
4.\t\tChapter
\nXIV of the Code of Criminal Procedure pertains to the information to
\nthe police and their powers to investigate.  Section 154 of the Code
\npertains to information in cognizable cases.  Section 155 provides
\nthat every information relating to the commission of a cognizable
\noffence, if given orally to an officer in charge of a police station,
\nshall be reduced to writing by him or under his direction.  Section
\n156 provides that any officer in charge of a police station may,
\nwithout the order of a Magistrate, investigate any cognizable case
\nwhich a Court having jurisdiction over the local area within the
\nlimits of such police station would have power to inquire into or try
\nunder the provisions of Chapter XIII.  Section 157 pertains to
\nprocedure for investigation.\n<\/p>\n
5.\t\tIn
\nthe present case, it is an admitted position that neither a complaint
\nof having committed a cognizable offence has been made against the
\npetitioner nor an FIR thereof, is registered by the police. In that
\nview of the matter it cannot be stated that the police officer is
\nmaking investigation under Chapter XII of the Code.\n<\/p>\n
6.\t\tHe,
\ntherefore, could not have issued the impugned summons to the
\npetitioner. Under the similar circumstances, previously, I had an
\noccasion to pass an order in the case of  Hasmukhbhai
\nRanchodbhai Patel-Amar Enterprise VS. State of Gujarat & Others
\nin Special Criminal Application No.1061 of 2010, making following
\nobservations:\n<\/p>\n
 \t\tCounsel
\nfor the petitioner submitted that in absence of any police complaint,
\nthe petitioner cannot be summoned under section 160 of Cr.P.C. for
\nrecording his statement. He further submitted that   purely under
\npressure from the father of respondent No.3 who is a retired  police
\nofficer, the Police Inspector, respondent No.2 herein is pressurizing
\nthe petitioner into settling civil dispute through police  machinery.<\/p>\n
\n \n\n\n \n \n\n\n \n\n\nxxx\t\n              xxx             xxx\n \n\n\n \n \n\n\n \n\n\n\t\tThe\n<\/pre>\n
power to require attendance of any person  vested in the police
\nofficer under sub-section (1) of section 160 flows from the fact that
\nhe is making an investigation under Chapter XXII of Cr.P.C.  Such
\ninvestigation must relate to information of a cognizance  offence as
\nreferred to in section 154 of the Cr.P.C.  In the present case,  when
\nadmittedly, no FIR is registered, compelling the presence of the
\npetitioner under section 160 of Cr.P.C. does not arise.   No other
\nprovision is pointed out to suggest that in absence of  complaint
\nalso, presence of a person can be compelled.  I have therefore based
\nmy conclusion on section 160 which is referred to in the impugned
\nsummons.\n<\/p>\n
7.\t\tIn
\nthe result, the impugned communication  Annexure-H ,
\ndated 29.08.2010, issued to the petitioner, by the Police Inspector,
\nGorva Police Station, Vadodara, is QUASHED.\n<\/p>\n
8.\t\tIt is,
\nhowever, made clear that if, at any point of time, an FIR is
\nregistered by the concerned police station, with respect to which
\nattendance of the petitioner is necessary, it is always open to the
\nInvestigating Officer to summon the petitioner.  This is without
\nprejudice to the defence of the petitioner.\n<\/p>\n
9.\t\tWith the
\nabove observations and directions, this petition is disposed of.
\nDirect service is permitted.\n<\/p>\n
