\tRule. Mr.L.B.Dabhi,
\n\tlearned Additional Public Prosecutor, waives service of notice of
\n\tRule on behalf of the respondent-State of Gujarat.\n<\/p>\n
\tThis application has been
\n\tfiled under Section 438 of the Code of Criminal Procedure for grant
\n\tof anticipatory bail as the applicant apprehends his arrest in
\n\tconnection with FIR, being C.R.No.I-68\/2008 registered with
\n\tSantrampur Police Station, Panchmahal, for offences punishable under
\n\tSections 409, 406, 420, 120B, 465, 466, 467, 471 and 114, of the
\n\tIndian Penal Code.\n<\/p>\n
\tThe allegation against
\n\tthe applicant is that he, along with the other co-accused persons,
\n\tis involved in misappropriation of a huge amount from the funds of
\n\tthe concerned Cooperative Society.\n<\/p>\n
\tMr.V.J.Shah, learned
\n\tcounsel for the applicant, has submitted that the applicant is
\n\tinnocent and has been falsely implicated. That in fact, the main
\n\taccused person, i.e. accused No.1, had made a false subscription of
\n\tthe balance amount on different dates and, by creating bogus
\n\taccounts, an amount of Rs.12,38,742\/- in all, is alleged to have
\n\tbeen misappropriated. That the present applicant is working as a
\n\tClerk and not as a Manager in the Cooperative Society, as alleged.
\n\tThat now the main accused person, i.e. Dhavalbhai Dilipbhai Parikh
\n\thas deposited the full amount of Rs.12,38,742\/- with the Cooperative
\n\tSociety and has been granted bail, by order dated 15.01.2009
\n\trendered in Criminal Misc. Application No.16416 of 2008. That even
\n\totherwise, there is no evidence on record to connect the applicant
\n\twith the commission of the above-mentioned offence and as the
\n\tapplicant has been falsely implicated, the Court may exercise
\n\tdiscretion in his favour.\n<\/p>\n
\tOn the other hand,
\n\tMr.L.B.Dabhi, learned Additional Public Prosecutor, has opposed the
\n\tgrant of bail to the applicant.\n<\/p>\n
\tI have heard the learned
\n\tcounsel for the respective parties, perused the averments made in
\n\tthe application, contents of the FIR and other documents on record.\n<\/p>\n
\tConsidering the aspect
\n\tthat the direct involvement of the applicant is, prima facie, not
\n\tclearly borne out from the material on record and also that the
\n\tapplicant appears to be a Clerk and not a Manager of the Credit
\n\tCooperative Society, as alleged, and taking into consideration the
\n\tfact that the amount of Rs.12,38,742\/- has been deposited by the
\n\tmain accused person, the application deserves to be considered. It
\n\tis, accordingly allowed.\n<\/p>\n
In
\n\tthe event of the arrest of the applicant in connection with FIR,
\n\tbeing C.R.No.I-68\/2008 registered with Santrampur Police Station,
\n\tPanchmahal,  the applicant shall be released on bail, on his
\n\texecuting a bond of Rs.10,000\/- (Rupees Ten Thousand only) with one
\n\tsolvent surety of the like amount, to the satisfaction of the
\n\tconcerned police officer and on conditions that the applicant shall;\n<\/p>\n
a)\tremain present before
\nthe Investigating Officer of the concerned Police Station, on
\n03.04.2009 between 11:00 am to 5:00 pm.<\/p>\n
b)\tremain present before
\nthe trial Court regularly, as and when directed, on the dates fixed;\n<\/p>\n
c)\tmake himself available
\nfor interrogation by the concerned police officer, whenever and
\nwherever required.\n<\/p>\n
d)\tnot directly or
\nindirectly make any inducement, threat or promise to any person
\nacquainted with the facts of the case so as to dissuade him\/her from
\ndisclosing such facts to the Court or to any Police Officer;\n<\/p>\n
e)\tnot obstruct or hamper
\nthe police investigation and not play mischief with the evidence
\ncollected or yet to be collected by the police;\n<\/p>\n
f)\tat the time of
\nexecution of bond, furnish his residential address to the
\nInvestigating Officer and the Courts concerned, and shall not change
\nhis residence as far as possible till the final disposal of the case
\nor till further orders;\n<\/p>\n
g)\tnot leave India without
\nthe permission of the Court and, if having Passport, shall deposit
\nthe same before the trial Court within a week;\n<\/p>\n
It
\n\twould be open to the Investigating Officer to file an application
\n\tfor remand if he considers it proper and just, and the learned
\n\tMagistrate would decide it on merits.\n<\/p>\n
This
\n\torder will hold good if the applicant is arrested at any time within
\n\t90 days from today. The order for release on bail will remain
\n\toperative only for a period of TEN days from the date of his arrest.
\n\tThereafter it will be open to the applicant to make a fresh
\n\tapplication for being enlarged on bail in usual course which when it
\n\tcomes before the competent Court, will be disposed of in accordance
\n\twith law, having regard to all the attending circumstances and the
\n\tmaterials available at the relevant time, uninfluenced by the fact
\n\tthat anticipatory bail was granted.\n<\/p>\n
It
\n\tis made clear that no observation made by this Court  be construed
\n\tas having any bearing on the merits of the case, at the time of
\n\ttrial. The trial Court will proceed in accordance with law,
\n\tunaffected and uninfluenced by any observation contained in this
\n\torder.\n<\/p>\n
Rule
\n\tis made absolute. Direct service is permitted.\n<\/p>\n
