Civil Application No. 368 of 2011, this  Court on 06.05.2011,<br \/>\nhas passed following order:-\n<\/p>\n<p>1.\tThe present<br \/>\napplication under Section 24 of the Code of Civil Procedure has been<br \/>\npreferred by the applicant-original plaintiff of Special Civil Suit<br \/>\nNo. 86\/2006 for an appropriate order of transferring the proceedings<br \/>\nof Regular Civil Appeal No. 26\/2010 pending in the Court of learned<br \/>\nDistrict Judge, Bhavnagar, which is filed by the present respondents<br \/>\nnos. 3 and 4, to this Court to be heard alongwith First Appeal No.<br \/>\n1199\/2010.\n<\/p>\n<p>2.\tAt the outset, it is<br \/>\nrequired to be noted that by the judgment and decree dated<br \/>\n04\/03\/2010, the learned trial Court partly decreed Special Civil Suit<br \/>\nNo. 86\/2006.  Being aggrieved and dissatisfied with the judgment and<br \/>\ndecree passed by the learned trial Court in partly decreeing the<br \/>\nsuit, respondents nos. 3 and 4 herein have instituted Regular Civil<br \/>\nApplication No. 26\/2010 before the learned District Court, Bhavnagar.<br \/>\n Being aggrieved and dissatisfied with the judgment and decree passed<br \/>\nby the learned trial Court in not decreeing the entire suit, the<br \/>\napplicant-original plaintiff has instituted First Appeal No.<br \/>\n1199\/2010 before this Court to consider the claim in the suit at Rs.<br \/>\n5,40,000\/- and, therefore, the judgment and decree passed by the<br \/>\nlearned trial Court is now the subject matter of two Appeals before<br \/>\ntwo different Courts and, therefore, to avoid any conflicting<br \/>\nfindings the proceedings pending in the Court of learned District<br \/>\nJudge, Bhavnagar are required to be transferred to this Court as the<br \/>\nproceedings of First Appeal No. 1199\/2010 pending before this Court<br \/>\ncannot be transferred to the District Court.  Both the Appeals arise<br \/>\nout of the same judgment and decree and, therefore, they are required<br \/>\nto be heard by one Court only so as to avoid any conflicting<br \/>\ndecisions and findings.\n<\/p>\n<p>3.\tIt appears that<br \/>\ninitially the suit was valued at Rs. 2,40,000\/-.  However,<br \/>\nsubsequently vide order dated 04\/03\/2010 the applicant-original<br \/>\nplaintiff was directed to pay the Court fees of Rs. 5,40,00\/- and,<br \/>\ntherefore, for all purpose and jurisdiction, the claim is required to<br \/>\nbe considered at Rs. 5,40,000\/- and, therefore, as such appeal field<br \/>\nby respondents nos. 3 and 4 herein was required to be instituted<br \/>\nbefore this Court only.\n<\/p>\n<p>4.\tIn view of the above<br \/>\nand considering the aforesaid facts and circumstances of the case,<br \/>\nthe proceedings before the learned District Court, Bhavnagar, being<br \/>\nRegular Civil Appeal No. 26\/2010, is required to be transferred to<br \/>\nthis Court to be heard alongwith First Appeal No. 1199\/2010.  In view<br \/>\nof the above, the present application is allowed and it is ordered to<br \/>\ntransfer the proceedings of Regular Civil Appeal No. 26\/2010 pending<br \/>\nin the Court of learned District Judge, Bhavnagar to this Court to be<br \/>\nheard alongwith First Appeal No. 1199\/2010.  The learned Principal<br \/>\nDistrict Judge, Bhavnagar is hereby directed to transfer the<br \/>\nproceedings of Regular Civil Appeal no. 26\/2010 to this Court<br \/>\nimmediately on or before 15\/06\/2011 and on receipt of the same,<br \/>\nRegistry is directed to see that the Regular Civil Appeal No. 26\/2010<br \/>\nis heard alongwith First Appeal No. 1199\/2010.  Rule is made absolute<br \/>\naccordingly.\n<\/p>\n<p>4.\tDirect service is<br \/>\npermitted.\n<\/p>\n<p>5.\tRegistry is directed<br \/>\nto send the writ of this order to the learned Principal District<br \/>\nJudge, Bhavnagar on or before 11\/05\/2011.\n<\/p>\n<p>2.\t\tOffice<br \/>\nis directed to comply with the above order.
