The respondents are served and we find only<br \/>\nrespondent No.4 appearing.\n<\/p>\n<p>2.          On the express statement of learned counsel for the<br \/>\npetitioner that the writ petition would be argued today itself<br \/>\nwe dispose of the application and for the reason stated therein<br \/>\nrecall the order dated 4.4.2011 dismissing the writ petition in<br \/>\ndefault.\n<\/p>\n<p>3.          The writ petition is restored for hearing on merits.<br \/>\nWP(C) No.12899\/2005\n<\/p>\n<p>1. Inartistically   drafted   Original   Application   has<br \/>\nresulted in the Central Administrative Tribunal losing focus and<br \/>\nhence a decision which requires to be set aside and matter<br \/>\nremanded to the Tribunal for fresh adjudication.\n<\/p>\n<p>3.          As India moves in the 2nd decade of the 21st Century<br \/>\nand 2nd generation legal reforms are being pushed by the<br \/>\nGovernment; with the history of the bar in India dating back to<br \/>\nwhen the Chartered High Courts were set up in this country in<br \/>\nthe mid 18th Century; we hope and expect that the decision of<br \/>\nthe Supreme Court which requires pleadings in Courts in India<br \/>\nto be construed liberally as if they are pleadings at a mufasil<br \/>\nCourt is got reversed by the bar itself, for the reason, we find<br \/>\nsuch a low standard to be an insult upon an organization which<br \/>\nprofesses to compete at the International level and surely it is<br \/>\nnot to be expected that in the modern world, a professional<br \/>\nbody expected to have high standards would be forging tools<br \/>\nakin to a blacksmith in the village working with primitive<br \/>\nimplements.\n<\/p>\n<p>4.          Shiv Swarup Sharma is an officer of the Indian<br \/>\nCustom and Central Excise Group \u201eA\u201f Service, which service he<br \/>\nentered as a direct recruit.\n<\/p>\n<p>5.          In May 1991 he was promoted as a Deputy<br \/>\nCommissioner, a post which has been re-designated as Joint<br \/>\nCommissioner. He thought that the promotion was pursuant<br \/>\nto a regular DPC. The department took the stand that it was<br \/>\nan ad-hoc promotion and not a regular promotion.\n<\/p>\n<p>6.          A regular DPC met in the year 2002 wherein he was<br \/>\ndeclared unfit for promotion and the result was that persons<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No.12899\/2005                        Page 2 of 6<\/span><br \/>\n junior to him were promoted as Joint Commissioner on regular<br \/>\nbasis.\n<\/p>\n<p>7.          He filed a representation in which he urged 2<br \/>\npoints. Firstly, that he had been promoted in the year 1991<br \/>\npursuant to a regular DPC and thus the question of his re-<br \/>\npromotion could not be considered. Secondly, he questioned<br \/>\nthe DPC which met in March 2002 and considered his service<br \/>\nrecords which were adverse, as pleaded by him, and not<br \/>\ncommunicated to him.\n<\/p>\n<p>8.          The representation was rejected on 4.11.2003 and<br \/>\nby the time Shiv Swarup Sharma filed OA 2785\/2003 before<br \/>\nthe Tribunal, further promotion was effected to the post of<br \/>\nCommissioner.\n<\/p>\n<p>9.          In the Original Application, Shiv Swarup Sharma<br \/>\nstated that the stand of the department of his promotion in the<br \/>\nyear 1991 being ad-hoc was not correct.           Alternatively, he<br \/>\nquestioned the DPC which met in March 2002, assessing his<br \/>\nsuitability with reference to his adverse service record, which<br \/>\nstatedly was not communicated to him.              So alleging, he<br \/>\npleaded that he would be entitled to be treated as promoted<br \/>\nas Joint Commissioner w.e.f. the date he was superseded and<br \/>\nthus would be entitled to be promoted as a Commissioner.\n<\/p>\n<p>10.         Making      aforesaid   pleadings,   albeit    inchoately,<br \/>\nprayer made was as under:-\n<\/p>\n<blockquote><p>      &#8220;I.   Quash and set aside the impugned order dated<br \/>\n      4.11.2003, vide which the representation of the<br \/>\n      applicant has been illegally rejected.  Direct the<br \/>\n      respondents to hold that the DPC of 1991 was a<br \/>\n      regular DPC.\n<\/p><\/blockquote>\n<blockquote><p>      II.   Direct the respondents consequently to consider<br \/>\n      the   applicant for promotion to the post of<br \/>\n<span class=\"hidden_text\">W.P.(C) No.12899\/2005                        Page 3 of 6<\/span><br \/>\n       Commissioner on the basis of records after 1991,<br \/>\n      w.e.f. the date his immediate junior was promoted and<br \/>\n      with all other consequential benefits.\n<\/p><\/blockquote>\n<blockquote><p>      III. Any other relief, which this Hon\u201fble Tribunal may<br \/>\n      deem fit and proper in the circumstances of the case,<br \/>\n      may also be passed in favour of the applicant.\n<\/p><\/blockquote>\n<blockquote><p>      IV. Cost of the proceedings be awarded in favour of<br \/>\n      the applicant and against the respondents.&#8221;\n<\/p><\/blockquote>\n<p>11.         Relevant would it be to note that the prayer clause<br \/>\nis equally inartistically worded.\n<\/p>\n<p>12.         After   praying   that   the   rejection   order   dated<br \/>\n14.11.2003 be quashed, it ought to have been prayed that a<br \/>\nReview DPC be directed to be held, at which DPC the record<br \/>\nwhich was adverse to him and which was considered by the<br \/>\nDPC which met in March 2002, should be ignored. It further<br \/>\nhad to be prayed that if at the Review DPC he was held fit to<br \/>\nbe promoted, directions should be issued that he should be so<br \/>\npromoted with all consequential benefits and thereafter it<br \/>\nought to have been prayed that one of the consequential<br \/>\nbenefits would be a direction to promote the petitioner to the<br \/>\npost of Commissioner with effect from the date persons junior<br \/>\nto him were promoted.\n<\/p>\n<p>13.         The result of the inartistically drafted pleadings and<br \/>\nthe prayer, is that the Tribunal, after noting the relevant facts<br \/>\nand opining that petitioner\u201fs promotion in the year 1991 was<br \/>\nad-hoc and that the DPC which met in March 2002 was the first<br \/>\nDPC which met, non suited the petitioner by returning a<br \/>\nfinding in para 13 of the impugned order which reads as<br \/>\nunder:-\n<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No.12899\/2005                        Page 4 of 6<\/span><\/p>\n<blockquote><p>       &#8220;13. A fatal law that occurs is that though the<br \/>\n      applicant assails the order and claims the relief that<br \/>\n      he should be promoted as Commissioner in his<br \/>\n      Department from the date his juniors were promoted<br \/>\n      but he does not challenge the order that had earlier<br \/>\n      been passed ignoring him from promotion to the post<br \/>\n      of Joint Commissioner which was earlier known as<br \/>\n      Deputy Commissioner in the Department. This is a<br \/>\n      fatal flaw. The post of the Joint Commissioner is a<br \/>\n      feeder post to the post of Commissioner. In the<br \/>\n      absence of challenge to that, indeed the applicant<br \/>\n      cannot succeed because necessarily he must get<br \/>\n      himself promoted as Joint Commissioner in the first<br \/>\n      instance.&#8221;\n<\/p><\/blockquote>\n<p>14.         It is apparent that since the Tribunal has held that<br \/>\nthe petitioner had not questioned the promotion to the post of<br \/>\nJoint Commissioner, he could       not have questioned      the<br \/>\npromotion to the post of Commissioner. The reason is: if the<br \/>\npetitioner misses the bus at point \u201eA\u201f and qua his missing the<br \/>\nbus raises no grievance, he has to trail behind in the journey<br \/>\nthereafter and cannot question his missing the bus at point \u201eB\u201f.\n<\/p>\n<p>15.         But, as noted hereinabove, we find that the<br \/>\npetitioner has questioned his supersession for the post of Joint<br \/>\nCommissioner and in respect whereof we find that Grounds \u201eB\u201f<br \/>\nand \u201eF\u201f have been specifically averred after the narration of<br \/>\nfacts in the Original Application.      That apart, when the<br \/>\npetitioner prayed in the relief clause that the impugned order<br \/>\ndated 4.11.2003 be set aside, it was but natural that he was<br \/>\nquestioning his supersession to the post of Joint Commissioner.\n<\/p>\n<p>16.         Meaningfully read, on the standards of pleadings at<br \/>\na mufasil level, which we require as the standard to be<br \/>\nadopted to give meaning to a pleadings, we find that the<br \/>\npetitioner has challenged his supersession to the post of Joint<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No.12899\/2005                     Page 5 of 6<\/span><br \/>\n Commissioner. Accordingly, finding that the Tribunal has not<br \/>\ndealt with the challenge raised by the petitioner to his being<br \/>\nsuperseded as a Joint Commissioner, we dispose of the writ<br \/>\npetition setting aside the impugned order dated 22.11.2004.\n<\/p>\n<p>17.         OA No.2785\/2007 is restored for adjudication by the<br \/>\nTribunal.\n<\/p>\n<p>18.         No costs.\n<\/p>\n<p>19.
