     Accused in C.C.236\/90 on the files of the Chief<\/p>\n
Judicial Magistrate Court, Kozhikode, is the petitioner<\/p>\n
in this Criminal Revision Petition.             He was<\/p>\n
prosecuted, convicted and sentenced for the offence<\/p>\n
punishable under Section 138 of the Negotiable<\/p>\n
Instruments Act.\n<\/p>\n<\/p>\n
2.   The case of the prosecution was that            the<\/p>\n
complainant was running a stationary shop at Jail<\/p>\n
Road, Calicut and his friend Ramadas was running<\/p>\n
another   stationary    shop.        The office of S.K.S<\/p>\n
Travels is on the opposite side of the said shops.<\/p>\n
S.K.S Travels operates bus service from Kozhikode<\/p>\n
to Bangalore.    On 22.10.1989, bus No.CAK 5200<\/p>\n
belonging to S.K.S.Travels hit the aforementioned<\/p>\n
shops and the complainant and the neighbouring<\/p>\n
shop     owner   suffered considerable damage on<\/p>\n
account of loss of articles. Ext.P1 agreement was<\/p>\n

therefore, drawn up in which the Manager of S.K.S<\/p>\n
Travels had agreed to compensate the complainant<\/p>\n
and Mr.Ramadas for damage that had been caused<\/p>\n
to them.       The damage was not then    assessed.<\/p>\n
Therefore, the figure was not mentioned.       But<\/p>\n
contrary to the undertaking so given, complainant<\/p>\n
and Mr.Ramadas       were   not compensated.    On<\/p>\n
23.12.1989, the complainant        and his friend<\/p>\n
Ramadas blocked the running of the bus belonging<\/p>\n
to S.K.S Travels. Therefore, there was delay in the<\/p>\n
commencing of the service.        Passengers were<\/p>\n
waiting for the bus. One of them was the daughter-<\/p>\n
in-law of PW2, who was then the senior executive<\/p>\n
president of     Gwaliyor Rayons, Mavoor.  He had<\/p>\n
intervened and persuaded the parties to settle the<\/p>\n
dispute. Claim was agreed to be settled for an<\/p>\n
amount of Rs.40,000\/- to be paid to the complainant<\/p>\n
and his friend Ramadas. Rs.5,000\/- was paid in<\/p>\n
cash     and Ext.P2   cheque  was    issued for the<\/p>\n
balance amount. The accused said that he owed<\/p>\n
money to S.K.S travels and therefore, he issued<\/p>\n

Ext.P2 cheque.      Entries in Ext.P2 cheque     was<\/p>\n
actually     written  by PW2, Mr.Sabu. Cheque on<\/p>\n
presentation      was dishonoured    and later   the<\/p>\n
complaint      was lodged, after complying with the<\/p>\n
statutory formalities. The defence taken by the<\/p>\n
accused was that he did not owe any money, nor<\/p>\n
does the complainant have any such case. Cheque<\/p>\n
in question      was issued  only  as a measure of<\/p>\n
security,      to enable  S.K.S Travels to pay the<\/p>\n
amount due to the complainant and Mr.Ramadas.<\/p>\n
3.    The Courts below declined to accept the case<\/p>\n
of the accused and proceeded       to   convict  and<\/p>\n
sentence him for the offence punishable under<\/p>\n
Section 138 of the Negotiable Instruments Act.<\/p>\n
Hence this Revision.\n<\/p>\n<\/p>\n
4.    I heard Mr.V.V.Surendran, learned counsel for<\/p>\n
the petitioner.      In spite of notice, there is no<\/p>\n
appearance on behalf of the first respondent.      I<\/p>\n
have gone through the evidence adduced. Even the<\/p>\n

complainant      does not  have   a   case  that the<\/p>\n
accused had owed any money to the complainant or<\/p>\n
his friend Ramadas. The cheque in question was<\/p>\n
issued as a self drawer cheque. If the version of<\/p>\n
the accused is accepted, then it will mean that the<\/p>\n
accused had issued the cheque, as a measure of<\/p>\n
guarantying payment of the amount         to   S.K.S<\/p>\n
Travels. No doubt, issuance of a cheque by a third<\/p>\n
party,     for discharge of liability  incurred   by<\/p>\n
another person,       would also    be supported by<\/p>\n
adequate consideration, in the sense        that the<\/p>\n
liability     of S.K.S Travels  would also     be a<\/p>\n
consideration for a cheque issued by the accused.<\/p>\n
But, I find force in the contention raised by the<\/p>\n
learned counsel for the petitioner that the actual<\/p>\n
amount that had to be paid as compensation to the<\/p>\n
complainant and Mr.Ramadas         was not assessed<\/p>\n
on the date of issuance of the cheque.      Only an<\/p>\n
approximate figure was mentioned even by PW1.<\/p>\n
Therefore, issuance of cheque on 23.12.2008 may<\/p>\n
not have been treated as one for discharge of a<\/p>\n

liability which had then been incurred by the<\/p>\n
accused vis-a-vis the complainant. In my view,<\/p>\n
these aspects have not been correctly appreciated<\/p>\n
by the Courts below.          Therefore,   the matter<\/p>\n
requires a re-consideration by the Court below. I<\/p>\n
take note of the contention of the learned counsel<\/p>\n
for the petitioner that neither the complainant nor<\/p>\n
Mr.Ramadas are currently available and they are<\/p>\n
not really interested in prosecuting the matter.<\/p>\n
5.    For all these reasons,        Criminal Revision<\/p>\n
Petition is allowed. Orders passed by the Courts<\/p>\n
below are set aside and the case is remitted back to<\/p>\n
the trial Court       for fresh consideration.  If an<\/p>\n
application is made by the complainant for adducing<\/p>\n
any fresh evidence,      that shall be considered in<\/p>\n
accordance with law by the Court below. So also<\/p>\n
any motion made by the accused          for additional<\/p>\n
evidence      shall also be dealt with  by the Court<\/p>\n
below in accordance with law.\n<\/p>\n
