Justice K.BALAKRISHNAN NAIR\n\n Dated :12\/06\/2007\n\n O R D E R\n                           K.BALAKRISHNAN NAIR, J.\n\n                           ------------------------------\n\n                       W.P.(C) No.16489 of 2006-K\n\n                       -------------------------------------\n\n                   Dated this the 12th   day of June, 2007.\n\n\n                                 J U D G M E N T\n<\/pre>\n<p>           The   petitioner   challenges   Ext.P1   order   by  which   he   has   been<\/p>\n<p>transferred   out   to   Palakkad   and   in   his   place   the   5th   respondent   has<\/p>\n<p>been accommodated.  According to him, he has been harassed by the<\/p>\n<p>transfer because of his membership in a particular trade union.   The<\/p>\n<p>5th   respondent   belongs   to   a   rival   trade   union.     So,   the   petitioner<\/p>\n<p>submits, the transfer is vitiated by   malafides.   The learned Standing<\/p>\n<p>Counsel for the Water Authority, upon instruction, submitted that the<\/p>\n<p>petitioner   has   completed   his   normal   tenure   of   3   years   at<\/p>\n<p>Perinthalmanna.  Therefore, he was transferred.<\/p>\n<p>       2.     The   petitioner   may   file   a   representation   before   the   second<\/p>\n<p>respondent   claiming   suitable   posting.
