Justice R.BASANT\n\n Dated :10\/07\/2007\n\n O R D E R\n                              R.BASANT, J.\n\n                           ----------------------\n\n                        Crl.M.C.No.2213 of 2007\n\n                       ----------------------------------------\n\n                 Dated this the 10th   day of July 2007\n\n\n                                  O R D E R\n<\/pre>\n<p>      The   petitioner   faces   indictment   in   a   prosecution   under<\/p>\n<p>Section   138  of   the  Negotiable   Instruments   Act.    Consequent   to<\/p>\n<p>his   non-appearance   before   the   learned   Magistrate,   the   learned<\/p>\n<p>Magistrate has issued coercive processes to secure the presence<\/p>\n<p>of the petitioner.\n<\/p>\n<p>      2.    According   to   the   petitioner,   he   is   innocent   of   the<\/p>\n<p>allegations raised.  According to him, his absence was not wilful<\/p>\n<p>and   was   due   to   reasons   beyond   his   control.     The   petitioner<\/p>\n<p>submits   that   he   is   willing   to   co-operate   with   the   court   for<\/p>\n<p>expeditious   disposal.     He   is   willing   to   surrender   before   the<\/p>\n<p>learned Magistrate.   But he apprehends that his application for<\/p>\n<p>bail may not be considered by the learned Magistrate on merits,<\/p>\n<p>in  accordance with law and expeditiously.   He, therefore, prays<\/p>\n<p>that  directions  under   Section   482  Cr.P.C.  may  be  issued   to  the<\/p>\n<p>learned   Magistrate   to   release   the   petitioner   on   bail   when   he<\/p>\n<p>appears and applies for bail.\n<\/p>\n<p>      3.    It   is   for   the   petitioner   to   appear   before   the   learned<\/p>\n<p>Magistrate   and   explain   to   the   learned   Magistrate,   the<\/p>\n<p>circumstances   under   which   he   could   not   earlier   appear   before<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.2213\/07                       2<\/span><\/p>\n<p>the learned Magistrate.\n<\/p>\n<p>       4.    I find absolutely no reason to assume that the learned<\/p>\n<p>Magistrate would not consider the application for bail to be filed<\/p>\n<p>by   the   petitioner   on   merits,   in   accordance   with   law   and<\/p>\n<p>expeditiously.     Every   court   must   do   the   same.     No   special   or<\/p>\n<p>specific   directions   appear   to   be   necessary.     Sufficient   general<\/p>\n<p>directions   have   been   issued   in  <a href=\"\/doc\/147290035\/\">Alice   George   vs.   Deputy<\/p>\n<p>Superintendent of Police<\/a> [2003(1)KLT 339].\n<\/p>\n<p>       5.
