Justice V.GIRI\n\n Dated :31\/10\/2008\n\n O R D E R\n                            V.GIRI,J.\n                      -------------------------\n                 W.P ( C) No.30606 of 2008\n                     --------------------------\n             Dated this the 31st October, 2008\n\n                       J U D G M E N T\n<\/pre>\n<p>      Petitioner had prosecuted a B.Tech course from the<\/p>\n<p>Institute of Engineering and Technology, University<\/p>\n<p>Campus, Calicut. According to her, the marks awarded to<\/p>\n<p>her in one of the papers in 4th Semester Examination was<\/p>\n<p>inadequate and therefore she sought for revaluation of the<\/p>\n<p>same. She was awarded only 59% marks. Therefore, she<\/p>\n<p>sought for revaluation with a hope that additional one<\/p>\n<p>mark would enable her to be treated as having passed out<\/p>\n<p>in  First Class.   Later, after completion of the B.Tech<\/p>\n<p>course, petitioner joined the Masters&#8217; Degree in Anna<\/p>\n<p>University in Chennai where she is             continuing to<\/p>\n<p>prosecute her studies.       She sought for permission to<\/p>\n<p>appear in the 4th semester examination          again.  This<\/p>\n<p>request was rejected vide Exhibit P4 finding that<\/p>\n<p>petitioner is already undergoing M.Tech course. This<\/p>\n<p>writ petition was filed essentially seeking the following<\/p>\n<p>W.P ( C) No.30606 of 2008<br \/>\n<span class=\"hidden_text\">                                2<\/span><\/p>\n<p>relief:\n<\/p>\n<blockquote><p>            &#8220;a)  Issue a writ of mandamus or other<\/p>\n<p>      appropriate writ, order or direction and direct<\/p>\n<p>      the respondents to revalue the answer sheets of<\/p>\n<p>      the petitioner in Engineering Mathematics<\/p>\n<p>      (EC2K 401), Pulse Circuit (EC2K 402), Electronic<\/p>\n<p>      Circuits (EC2K 404) and Micro Processors &amp;<\/p>\n<p>      Micro Controllers (EC2K 405) of 4th semester<\/p>\n<p>      examination of B.Tech and publish the same<\/p>\n<p>      forthwith.&#8221;<\/p><\/blockquote>\n<p>      2.    A counter affidavit has been filed on behalf of<\/p>\n<p>respondents.    Paragraphs,3,4 and 5 of the said counter<\/p>\n<p>affidavit reads as follows:\n<\/p>\n<blockquote><p>      &#8220;3.   It is submitted that the petitioner has<br \/>\n      made an application for revaluation of 4 papers<br \/>\n      of B.Tech IV Semester June 2005 examination<br \/>\n      viz EC 2K 401, 402 404 and 405. The University<br \/>\n      revalued the answer sheets of the petitioner<br \/>\n      except    EC     2K  401    and   the    results<br \/>\n      communicated to the petitioner. It is submitted<br \/>\n      that the revaluation in relation to the answer<br \/>\n      script of EC 2K 401 could not be conducted by<br \/>\n      the University since it could not be traced out<br \/>\n      and this fact was intimated to the petitioner as<br \/>\n      well.\n<\/p><\/blockquote>\n<p>W.P ( C) No.30606 of 2008<br \/>\n<span class=\"hidden_text\">                                  3<\/span><\/p>\n<p>            4.    It is submitted that the petitioner was<br \/>\n      an average student scored marks of 41, 33, 40<br \/>\n      and 41 out of 100 respectively for the 4 papers<br \/>\n      applied for revaluation. In 3 papers revalued<br \/>\n      there is no change as well. The petitioner is<br \/>\n      presently completed M.Tech course as well.<\/p>\n<p>            5.   It is submitted that the relief sought<br \/>\n      for by the petitioner to revalue the answer<br \/>\n      scripts of the paper EC 2K 401 is not practically<br \/>\n      possible since it could not be traced out. At this<br \/>\n      belated stage the petitioner cannot            seek<br \/>\n      revaluation of the answer             scripts and<br \/>\n      publcation of the results since the mark list<br \/>\n      already been published on 07\/01\/2006 and the<br \/>\n      application     for  revaluation   submitted    on<br \/>\n      12\/01\/2006. At this distance of time it could not<br \/>\n      be practically possible for the University to trace<br \/>\n      out the answer scripts and conduct revaluation.&#8221;<\/p>\n<p>      3.    No doubt, the answer sheets in its entirety of any<\/p>\n<p>student ought to be retained by the University at least for a<\/p>\n<p>period of    two years.    But I am not inclined to further<\/p>\n<p>proceed with this matter in circumstances where the<\/p>\n<p>petitioner cannot be considered as seriously aggrieved by<\/p>\n<p>the inability on the part of the University to revalue one of<\/p>\n<p>her answer scripts. I also take note of the fact that the<\/p>\n<p>petitioner had sought revaluation of four papers in the 4th<\/p>\n<p>semester examination and in respect of three of the papers,<\/p>\n<p>W.P ( C) No.30606 of 2008<br \/>\n<span class=\"hidden_text\">                                4<\/span><\/p>\n<p>the revaluation did not yield any improved marks for the<\/p>\n<p>petitioner. Petitioner is prosecuting M.Tech course and<\/p>\n<p>the difference of one mark, which she claims, will enable<\/p>\n<p>her to be treated as having passed the B.Tech course in<\/p>\n<p>First Class may not make much of difference either in the<\/p>\n<p>prosecution of further studies or in her career.       If the<\/p>\n<p>petitioner has been consistent in performing well in all<\/p>\n<p>other examinations and true to her claim she is also doing<\/p>\n<p>well in M.Tech degree then it will always be open to her to<\/p>\n<p>point out the lack of one mark in one of the papers as an<\/p>\n<p>aberration for which she is not responsible.
