{"id":412,"date":"2010-09-13T00:00:00","date_gmt":"2010-09-12T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/i-g-education-mahavidyalaya-vs-national-council-for-teachers-on-13-september-2010"},"modified":"2015-11-10T21:04:20","modified_gmt":"2015-11-10T15:34:20","slug":"i-g-education-mahavidyalaya-vs-national-council-for-teachers-on-13-september-2010","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/i-g-education-mahavidyalaya-vs-national-council-for-teachers-on-13-september-2010","title":{"rendered":"I G Education Mahavidyalaya vs National Council For Teachers &#8230; on 13 September, 2010"},"content":{"rendered":"<div class=\"docsource_main\">Madhya Pradesh High Court<\/div>\n<div class=\"doc_title\">I G Education Mahavidyalaya vs National Council For Teachers &#8230; on 13 September, 2010<\/div>\n<pre>                      W.P.No.11781\/2010\n\n  I.G.Education Mahavidyalaya                    National Council for Teacher\n  Bagdona, Bhopal                                Education and another\n\n\n\n\n13.9.2010\n      Shri Manoj Chansoriya, counsel for petitioner.\n      Shri K.K.Singh, counsel for respondents.<\/pre>\n<p>      The petitioner has sought following reliefs :-\n<\/p>\n<blockquote><p>              &#8220;(i)     It is, therefore, prayed that this Hon&#8217;ble<br \/>\n              Court kindly be pleased to direct the respondent<br \/>\n              no.2 strictly to comply with the order of<br \/>\n              Appellate Authority dated 10-02-2010 by<br \/>\n              finalizing pending application dated 20-09-2007<br \/>\n              in respect of grant of recognition within a period<br \/>\n              of 30 days by issuing writ in the nature of<br \/>\n              mandamus and other appropriate writs.\n<\/p><\/blockquote>\n<blockquote><p>              (ii)     Kindly be pleased to issue any other writ<br \/>\n              or directions which this Hon&#8217;ble Court may deem<br \/>\n              fit and proper in the facts and circumstances of<br \/>\n              the case including cost of the litigation may<br \/>\n              kindly be awarded in favour of the petitioner.&#8221;\n<\/p><\/blockquote>\n<p>      At the outset learned counsel for petitioner submitted that as<br \/>\nper order Annexure P-9 dated 10.2.2010 passed by National Council<br \/>\nfor Teacher Education, respondent no.1 the matter of petitioner<br \/>\nought to have been decided by respondent no.2 within a period of<br \/>\nthirty days from the date of receipt of order Annexure P-9, but inspite<br \/>\nof lapse of nearabout 7 months the order has not been passed. It is<br \/>\nsubmitted that respondents be directed to decide the matter in<br \/>\ncompliance of remand order Annexure P-9 dated 10.2.2010 within a<br \/>\nperiod of thirty days from today.\n<\/p>\n<p>      Learned counsel for respondents submitted that he has no<br \/>\nobjection if the respondent no.2 is directed to decide the matter in<br \/>\ncompliance of order Annexure P-9 dated 10.2.2010.                   From the<br \/>\nperusal of Annexure P-9, it appears that it is a matter of grant of<br \/>\nrecognition for conducting B.Ed., courses.            The appellate Authority<br \/>\nrespondent no.1 remanded the matter on 10.2.2010 with direction to<br \/>\nrespondent no.2 to decide the matter within thirty days from the date<br \/>\nof receipt of order, but till date the matter has not been decided.<\/p>\n<pre>\n                        W.P.No.11781\/2010\n\n     I.G.Education Mahavidyalaya            National Council for Teacher\n     Bagdona, Bhopal                        Education and another\n\n\n\n\n<\/pre>\n<p>         In view of aforesaid, we dispose of this petition with following<br \/>\ndirections :-\n<\/p>\n<p>1.       The respondent no.2 is directed to decide the matter<br \/>\nexpeditiously in compliance of order Annexure P-9 dated 10.2.2010<br \/>\npassed by respondent no.1 in appeal no.89-463\/2009-Appeal<br \/>\nexpeditiously as far as possible within a period of thirty days from the<br \/>\ndate of communication of this order, after extending an opportunity<br \/>\nof hearing to the petitioner to submits its case before respondent<br \/>\nno.2.\n<\/p>\n<p>2.
