Justice R.BASANT\n\n Dated :30\/05\/2007\n\n O R D E R\n                                   R.BASANT, J\n\n                         ------------------------------------\n\n                          Crl.M.C.No.1602 of 2007\n\n                         -------------------------------------\n\n                     Dated this the 30th day of May, 2007\n\n\n                                      ORDER\n<\/pre>\n<p>       Petitioner is the 6th accused in S.C.No.362 of 2006 on the file of<\/p>\n<p>the Additional Sessions Court, Ernakulam, where he faces allegations,<\/p>\n<p>inter   alia,   under   Section   308   I.P.C.     The   co-accused   have   all   been<\/p>\n<p>acquitted.  The petitioner was not available for trial and therefore the<\/p>\n<p>case  against   him   has  been  split   up.     According  to   the   petitioner,   his<\/p>\n<p>absence   was   not   wilful   and   he   is   willing   to   surrender   before   the<\/p>\n<p>learned  Sessions  Judge.    The  petitioner   apprehends   that  the  learned<\/p>\n<p>Sessions Judge may not consider his application for bail on merits, in<\/p>\n<p>accordance   with   law   and   expeditiously.     It   is   therefore   prayed   that<\/p>\n<p>directions   may   be   issued   under   Section   482   Cr.P.C   to   release   the<\/p>\n<p>petitioner   on   bail   when   he   so   appears   before   the   learned   Sessions<\/p>\n<p>Judge and applies for bail.\n<\/p>\n<\/p>\n<p>       2.     It   is   for   the   petitioner   to   appear   before   the   learned<\/p>\n<p>Sessions   Judge   and   explain   to   the   learned   Sessions   Judge   the<\/p>\n<p>circumstances   under   which   he   could   not   earlier   appear   before   the<\/p>\n<p>learned   Magistrate.     I   have   no   reason   to   assume   that   the   learned<\/p>\n<p>Sessions   Judge   would   not   consider   such   application   on   merits,   in<\/p>\n<p>accordance   with   law   and   expeditiously.     Every   court   must   do   the<\/p>\n<p>same.     No   special   or   specific   direction   appears   to   be   necessary.<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.1602 of 2007                     2<\/span><\/p>\n<p>Sufficient   general   directions   have   already   been   issued   in  <a href=\"\/doc\/147290035\/\">Alice<\/p>\n<p>George   v.   The   Deputy   Superintendent   of   Police<\/a>   [2003(1)   KLT<\/p>\n<p>339].\n<\/p>\n<\/p>\n<p>         6.    This   Crl.M.C   is,   in   these   circumstances,   dismissed.
