ANJANA PRAKASH<\/p>\n<p>Anjana Prakash, J.         The appellant has been convicted under Section<\/p>\n<p>               304 Part II IPC and sentenced to RI for ten years by a<\/p>\n<p>               judgment dated 18.01.1995 passed by the 6th Additional<\/p>\n<p>               Sessions Judge, Siwan in S.Tr. No. 269 of 1993.<\/p>\n<p>                         The case of the prosecution is that on 16.08.1992<\/p>\n<p>               while the villagers were watching a video show the electricity<\/p>\n<p>               was disconnected on account of which the accused persons<\/p>\n<p>               came out from their house and began to abuse to which the<\/p>\n<p>               informant&#8217;s brother Krishna Ram protested at which the<\/p>\n<p>               appellant is said to have given single &#8220;Chhura&#8221; blow on the<\/p>\n<p>               stomach of the deceased who later died. The charge-sheet<\/p>\n<p>               was submitted under Section 302\/34 IPC and the appellant<\/p>\n<p>               and others were also charged under Section 302\/34 IPC but<\/p>\n<p>               convicted as noted above.\n<\/p>\n<p>                         The prosecution in all examined eight witnesses<\/p>\n<p>               out of whom P.W 1, P.W. 2, P.W. 3, P.W. 7 and P.W. 8 are<\/p>\n<p>               formal witnesses whereas P.W. 4 is the informant and P.W. 6<\/p>\n<p>               is the Doctor who held the post-mortem examination. P.W. 5<\/p>\n<p>               is the full brother of the deceased and even though he<br \/>\n<span class=\"hidden_text\">                                            2<\/span><\/p>\n<p>                    deposed on the manner of occurrence as an eye witness he<\/p>\n<p>                    was disbelieved by the Trial Court.\n<\/p>\n<p>                               The conviction of the appellant solely relied on eye-<\/p>\n<p>                    witness of P.W. 4, the informant. The same is being assailed<\/p>\n<p>                    by the counsel for the appellant on the ground that in cross-<\/p>\n<p>                    examination he has stated that when he came to the place of<\/p>\n<p>                    occurrence he had seen his brother injured with and,<\/p>\n<p>                    therefore, he is not an eye-witness.<\/p>\n<p>                               However, this Court is not inclined to take out a<\/p>\n<p>                    single sentence of P.W. 4 in judging the eye-witness account<\/p>\n<p>                    given by him and, therefore, this Court is not inclined to<\/p>\n<p>                    reject him as an eye-witness.\n<\/p>\n<p>                               In view of the consistent statement of P.W. 4 as<\/p>\n<p>                    well as the Doctor who corroborated the injuries sustained by<\/p>\n<p>                    the deceased, I am not inclined to interfere in the judgment<\/p>\n<p>                    under appeal.\n<\/p>\n<p>                               However, in the facts of the case the conviction of<\/p>\n<p>                    the appellant is converted to one under Section 326 IPC and<\/p>\n<p>                    he is sentenced to a period already undergone by him. The<\/p>\n<p>                    appeal is dismissed with the modifications as noted above.<\/p>\n<p>                               Further, the appellant (if alive) is directed to pay a<\/p>\n<p>                    sum of Rs. 2,500\/- to the family of the deceased within a<\/p>\n<p>                    period of eight weeks of receipt of notices from the Trial Court<\/p>\n<p>                    and in case he fails to do so he shall undergo an<\/p>\n<p>                    imprisonment of six months RI.\n<\/p>\n<\/p>\n<p>                                                     (Anjana Prakash, J.)<\/p>\n<p>Patna High Court,<br \/>\nPatna,<br \/>\nDated, the 18th April, 2011.\n<\/p>\n<p>NAFR\/Vikash\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court Krishna Ram vs State Of Bihar on 18 April, 2011 Author: Smt.
