Justice ANTONY DOMINIC\n\n Dated :13\/03\/2008\n\n O R D E R\n                         ANTONY DOMINIC, J.\n\n                   =W.P.(C)=No.=4887 = = = = = =\n                     = =    =    = =\n                                       OF 2008 - F\n                   = = = = = = = = = = = = = =\n\n               Dated this the 13th day of March, 2008\n\n\n                           J U D G M E N T\n<\/pre>\n<p>      The petitioner had executed the work of extension of<\/p>\n<p>agricultural line to Kallangari area in Thariyode and Kottathara<\/p>\n<p>Panchayat and has not been paid for the work done. The reason for<\/p>\n<p>non-payment as is disclosed by the Standing Counsel for the Board<\/p>\n<p>is that the records relating to the measurement of the work<\/p>\n<p>executed by the petitioner are not available with the Board. In my<\/p>\n<p>view, if records are not available, the Board could have re-measured<\/p>\n<p>the work and quantified the amount done and effected payment on<\/p>\n<p>that basis. Therefore, non-availability of the records cannot be a<\/p>\n<p>reason for denying payment to the petitioner.<\/p>\n<p>      2. Accordingly, I dispose of this writ petition directing that the<\/p>\n<p>respondents shall re-measure the quantum of work which the<\/p>\n<p>petitioner&#8217;s has executed, quantify the amount that is due on that<\/p>\n<p>basis and effect payment.      For this purpose if any document is<\/p>\n<p>W.P.(C) No. 4887 OF 2008<\/p>\n<p>                                  &#8211; 2 &#8211;\n<\/p>\n<p>required to be made available by the petitioner, the respondents will<\/p>\n<p>be free to call upon the petitioner to provide the same.<\/p>\n<p>       The entire process of measuring, quantifying and payment<\/p>\n<p>should be completed by the Board as expeditiously as possible, at<\/p>\n<p>any rate within 4 months from today.\n<\/p>\n<\/p>\n<p>                                                     ANTONY DOMINIC<br \/>\n                                                              JUDGE<br \/>\njan\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court A.K.
