have given voluntary statement, which leclito <\/p>\n
motor vehicle and other articles _which includes.  1 blood
\nstained clothes. His plea for bail wa.s\u00b0rejecte’d.considering the
\nincriminating aspects noticetladurling iirnlrestigation. “iiThis is his<\/p>\n
second attempt.\n<\/p>\n
6. Lear\ufb02ned  ‘petitioner would contend
\nthat the p.e’titio.r_ie’:r  b’een.iarrestedi only suspiciously and
\nthere is no”‘eye.witness:’  He submits that merely<\/p>\n
because therehwasr 1itigati.oi1r_relating to land between him and<\/p>\n
–the deceased, the .petiti_o_r_1_er had been implicated. He refers to<\/p>\n
the c’o–mplain.t*\u00abin’– which the complainant has clearly averred<\/p>\n
thatrhe,wiasR_’not’j;;.ih a position to know who committed the<\/p>\n
crime. lri–iAtiailj.iz FIR was registered against the unknown<\/p>\n
if pVe.rsoI1,_’_buVt” later the name of the petitioner has been shown.<\/p>\n
 iifurther submits that there is no direct material against the<\/p>\n

Basavanagouda.\n<\/p>\n
7. Opposing all the contentions, the lVear_n’ed<\/p>\n
Government Pleader seeks rejection of the petition.<\/p>\n
8. Keeping in mind the ._ urged;\n<\/p>\n
examined the records. Firstly,  must  notice’dAi’thati’theriii<\/p>\n
comp1ainant~Eranna Mahadevappa\ufb01ngadi  beipresent
\nwith the deceased when ,_the p.Al’actiye i””incident’*’ occurred.<\/p>\n
According to his version, the ‘5c_\u00a2upa\ufb01’ts o_fdth’e…ma_ruti van tried<\/p>\n
to imbalance lhirnuitnore:fthar’1.once before he reached the village.
\nThey succeedediin  agai.nis’t__ithe motor cycle due to which<\/p>\n
the complainant’.ifel.l.  HeA.p’an:_i”cked and rushed from the spot<\/p>\n
leaving bi;-hin’d Basian=ag_o_iida. Only when on return he found<\/p>\n
Basan’agouda\u00ab.w’i.th*injuries and the motor vehicle had already<\/p>\n
left i   such statement, there is no direct<\/p>\n
indictment of the petitioner by name or identity. But what<\/p>\n
“tr’a.nspi;red later on, is of importance. The investigating officer<\/p>\n
  number plate of the vehicle No.K.A-25\/P680. After<\/p>\n
seizizig it, he veri\ufb01ed regarding the ownership, which led to one<\/p>\n
at\/X<\/p>\n
Krishna Hanurnanthappa Goudar, who gave categoric<\/p>\n
statement that it was the petitioner who had taken the vehicle<\/p>\n
on the pretext of fixing the CD. It would therefore show4’th:ati_at_<\/p>\n
relevant point of time, the vehicle was in the possession”ofg:’th\u00e9’.._. .<\/p>\n
petitioner.\n<\/p>\n
9. The second aspect noticeciiis  orirthe.\n<\/p>\n
the voluntary statement, his blood”–‘staine’d Vclothes been
\nseized along with axe. The seizure yoflo’iood.;staine’diclothes and
\naxe from the custody of the Vf3etit.ion_e;~ -out sufficiently<\/p>\n

said articles had’ sl1ibjelc’t.c–to FSIi,wthere is material directly
\npointing tovvards the.act,iof~._the=’accused and the incident in<\/p>\n
question, _Mere’ly nbeicause. his name is not mentioned in the<\/p>\n
