Justice P.N.RAVINDRAN\n\n Dated :07\/10\/2008\n\n O R D E R\n                     P.N.RAVINDRAN, J\n              -----------------------------\n            W.P.(C) NO: 3959 of 2008\n              -----------------------------\n            Dated this 7th day of October, 2008\n\n                         JUDGMENT\n<\/pre>\n<p>    Heard Sri.K.P.Rajesh the learned counsel appearing for<\/p>\n<p>the  petitioner  and   Sri.Ashok   M.Cherian  the  learned<\/p>\n<p>standing  counsel  appearing      for   the  Kerala State<\/p>\n<p>Electricity Board, hereinafter referred to as the &#8220;Board&#8221;<\/p>\n<p>for short. The petitioner is a casual sweeper in the<\/p>\n<p>service of the Board.     He claims regularization in the<\/p>\n<p>light of Ext.P5 Government Order dated 25-11-2005.He  also<\/p>\n<p>relies on Ext.P6 order dated      17-7-2007 passed by the<\/p>\n<p>Board regularizing the services of six part time    casual<\/p>\n<p>sweepers.\n<\/p>\n<p>    2. The first respondent has filed a counter affidavit<\/p>\n<p>contending inter alia that Ext.P5 Government Order    does<\/p>\n<p>not apply to the Board and that in view of the special<\/p>\n<p>rules,  the   service   of   the   petitioner  cannot   be<\/p>\n<p>regularized.  The  learned   counsel  for   the petitioner<\/p>\n<p>submits that pursuant to the directions issued by this<\/p>\n<p>Court in O.P.No.16733 of 1998, the services of six persons<\/p>\n<p>working in the Board on contract basis as part time<\/p>\n<p>W.P.(C) NO: 3959 of 2008<br \/>\n<span class=\"hidden_text\">                           2<\/span><\/p>\n<p>sweepers were regularised by Ext.P6.  The learned counsel<\/p>\n<p>for the petitioner submits that the petitioner   is also<\/p>\n<p>similarly situate as the said six persons.   The learned<\/p>\n<p>counsel for the Board submitted that in the event of the<\/p>\n<p>petitioner filing  a representation before the Secretary<\/p>\n<p>of the Board producing a copy of Ext.P6, the Board will<\/p>\n<p>consider the same and take a decision thereon at the<\/p>\n<p>earliest.\n<\/p>\n<p>  3.  The writ petition is therefore disposed of with a<\/p>\n<p>direction  to  the  petitioner  to  file  an  appropriate<\/p>\n<p>representation before the Secretary of the Board claiming<\/p>\n<p>regularization,   within two weeks from today.
