Case No. 4 of 2003, the appellants herein, are<br \/>\nstated to be still in jail. Learned counsel for those appellants have<br \/>\nsubmitted, on instructions, that the appellants were not pressing the<br \/>\nappeal on merits and restricting the prayer to reducing the sentence<br \/>\non the basis that maximum punishment for 07 years of rigorous<br \/>\nimprisonment was harsh and the appellants have already undergone<br \/>\nmajor part of that sentence during pendency of the trial and the<br \/>\npresent appeals.\n<\/p>\n<p>2.\tIt<br \/>\nwas submitted on behalf of the appellants and fairly conceded by<br \/>\nlearned A.P.P., Mr. Nanavati, that the amounts of fine imposed by the<br \/>\nimpugned orders were already paid and remaining period of<br \/>\nimprisonment for each of the appellants herein did not exceed<br \/>\napproximately six months; while the appeals were not likely to be<br \/>\nheard on merits within the next six months in view of pendency of and<br \/>\npriority accorded to appeals filed earlier. It was, on that basis,<br \/>\nsubmitted that the appeals would become infructuous and when the<br \/>\nappellants were giving up<br \/>\ntheir challenge to the judgement on merits on other grounds and were<br \/>\nnot reported to have any record of other offences before or after the<br \/>\norder of conviction, the court was required to take a lenient view<br \/>\nand consider the appellants to have been sufficiently punished, even<br \/>\nbefore the appeals could be heard on merits.\n<\/p>\n<p>3.\tLearned<br \/>\nA.P.P. having no objection, the prayer made on behalf of the<br \/>\nappellants to restrict the appeals only to the part of sentence is<br \/>\nacceded and in the aforesaid facts and circumstances, the prayer to<br \/>\nreduce the sentence to the imprisonment already undergone is granted.<br \/>\nAccordingly, reducing the sentence of each of the appellants herein<br \/>\nto the period of imprisonment already undergone, the sentence imposed<br \/>\nin the impugned judgement and order is modified accordingly, and<br \/>\npartly allowing the appeals the appellants are directed to be<br \/>\nreleased, if not required to be<br \/>\ndetained pursuant to any other case, for having undergone the<br \/>\nfull term of imprisonment as modified by this order.
