Justice K.T.SANKARAN\n\n Dated :20\/10\/2010\n\n O R D E R\n                       K.T.SANKARAN, J.\n                  ---------------------------------------------\n                   W.P.(C).No.30610 of 2010\n                  ---------------------------------------------\n             Dated this the 20th day of October, 2010\n\n\n\n                          JUDGMENT\n<\/pre>\n<p>       The case of the petitioners is the following : The first<\/p>\n<p>petitioner joined in service as primary school teacher on<\/p>\n<p>4.6.1987 and he was promoted as High School Assistant on<\/p>\n<p>5.6.2006. The second petitioner joined in service on 3.6.1985 as<\/p>\n<p>LPSA and he was promoted as HSA on 5.6.2006. The petitioners<\/p>\n<p>are working in the schools under the same corporate<\/p>\n<p>management. It is pointed out that Philomina Mathew, Jessy<\/p>\n<p>Luice and Kochurani, who joined later in service, and who are<\/p>\n<p>working in the schools under the same corporate management as<\/p>\n<p>primary school teachers, are getting more salary than the salary<\/p>\n<p>drawn by the petitioners. Pointing out this anomaly and praying<\/p>\n<p>for rectifying the same, the petitioners approached the District<\/p>\n<p>Educational Officer, who rejected their request. The petitioners<\/p>\n<p>filed appeals before the Deputy Director of Education, who<\/p>\n<p>dismissed the appeals as per             Exhibits P8(a) and P10 orders<\/p>\n<p>respectively in the case of the petitioners 1 and 2. Aggrieved by<\/p>\n<p><span class=\"hidden_text\">WP(C) No.30610\/2010             2<\/span><\/p>\n<p>the orders passed by the Deputy Director, the first petitioner has<\/p>\n<p>filed Exhibit P9 revision and the second petitioner has filed<\/p>\n<p>Exhibit P11 revision before the first respondent. Exhibits P9 and<\/p>\n<p>P11 are pending disposal.\n<\/p>\n<\/p>\n<p>     2.    The reliefs prayed for in the Writ Petition are the<\/p>\n<p>following :\n<\/p>\n<blockquote><p>                 &#8220;(i) issue a writ of certiorari or any other<\/p>\n<p>           appropriate writ, order or direction, quashing<\/p>\n<p>           the operation and all further proceedings in<\/p>\n<p>           pursuance to Exhibits P8(a) and P10;<\/p>\n<\/blockquote>\n<blockquote><p>                 (ii)  issue a writ of mandamus or any<\/p>\n<p>           other appropriate writ, order or direction,<\/p>\n<p>           commanding the first respondent to consider<\/p>\n<p>           and dispose of Exhibits P9 and P11 revision<\/p>\n<p>           petitioners, forthwith ;\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>                 (iii) issue a writ of mandamus or any<\/p>\n<p>           other appropriate writ, order or direction,<\/p>\n<p>           commanding the respondents to sanction and<\/p>\n<p>           disburse higher scale of pay to the petitioners,<\/p>\n<p>           over and above had they been continued as<\/p>\n<p>           Primary School Teachers ;\n<\/p><\/blockquote>\n<blockquote><p><span class=\"hidden_text\">WP(C) No.30610\/2010             3<\/span><\/p>\n<\/blockquote>\n<blockquote><p>                 (iv) issue a writ of mandamus or any<\/p>\n<p>           other appropriate writ, order or direction,<\/p>\n<p>           commanding the respondents not to reduce the<\/p>\n<p>           salary and allowances of the petitioners, for the<\/p>\n<p>           reason of having accepted the promotion to the<\/p>\n<p>           post of HSA;\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>                 (v)  issue such other writ, order or<\/p>\n<p>           direction, which may deem fit in the facts and<\/p>\n<p>           circumstances of the case.&#8221;<\/p><\/blockquote>\n<p>     3.    The learned counsel for the petitioners submitted that<\/p>\n<p>since Exhibits P9 and P11 are pending disposal, the petitioners<\/p>\n<p>would be satisfied for the present, if those revision petitions are<\/p>\n<p>directed to be disposed of expeditiously.<\/p>\n<p>     Accordingly, the Writ Petition is disposed of as follows :<\/p>\n<p>     (a)   The first respondent shall consider and dispose of<\/p>\n<p>           Exhibits P9 and P11 revisions, as expeditiously as<\/p>\n<p>           possible and at any rate within a period of three<\/p>\n<p>           months from the date of receipt of a copy of the<\/p>\n<p><span class=\"hidden_text\">WP(C) No.30610\/2010              4<\/span><\/p>\n<p>           judgment, after affording an opportunity of being<\/p>\n<p>           heard to the petitioners, the Corporate Manager and<\/p>\n<p>           any other affected party.\n<\/p>\n<\/p>\n<p>    (b)    The petitioners shall produce a copy of the Writ<\/p>\n<p>           Petition and certified copy of the judgment before the<\/p>\n<p>           first respondent.\n<\/p>\n<\/p>\n<p>                                              K.T.SANKARAN<br \/>\n                                                   JUDGE<br \/>\ncsl<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Tomy Antony vs State Of Kerala on 20 October, 2010 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C).No. 30610 of 2010(A) 1.
