Shah with learned advocate Mr.Asit B.<br \/>\nJoshi on behalf of petitioner.\n<\/p>\n<p>\tA<br \/>\ndetailed representation has been made by petitioner to respondent<br \/>\nherein dated 11.3.2010 which remained unanswered and not decided till<br \/>\ndate by respondent.\n<\/p>\n<p>\tLearned<br \/>\nadvocate Mr.Shah submitted that claim of petitioner in respect to<br \/>\ncommercial plot No.95\/2 situated at Ankleshwar  where auction notice<br \/>\ndated 4.9.2010 is placed on record. He also submitted that if this<br \/>\nplot in question where claim is made by petitioner if it is to be<br \/>\nsold in auction, then entire representation become infructuous and<br \/>\nright of petitioner will adversely affected. Therefore, he submitted<br \/>\nthat petitioner will make separate application to concerned<br \/>\nrespondent to wait upto auction the commercial plot No.95\/2 as<br \/>\nadvertised in auction notice dated 4.9.2010 and some suitable<br \/>\ndirection may be issued to respondent Corporation, so they may decide<br \/>\nthe representation made by petitioner within some reasonable time.\n<\/p>\n<p>\tConsidering<br \/>\nthe submissions made by learned advocate Mr.Shah and also considering<br \/>\nthe earlier order passed by this Court in SCA No.9213\/2010 dated<br \/>\n6.8.2010, it is directed to respondent herein to consider<br \/>\nrepresentation dated 11.3.2010 and examine the grievance of present<br \/>\npetitioner on the basis of record and then, to pass appropriate<br \/>\nreasoned order in accordance with law, within a period of two months<br \/>\nfrom date of receiving copy of present order and communicate the<br \/>\ndecision to petitioner immediately.\n<\/p>\n<p>\tIt<br \/>\nis open for  respondent herein, in case if any assistance is required<br \/>\nor some further details is required from petitioner, then  respondent<br \/>\n  Corporation may call the petitioner personally for such details.\n<\/p>\n<p>\tIt<br \/>\nis open for petitioner to make such application in respect to<br \/>\nadvertisement dated 4.9.2010 for auctioning commercial plot No.95\/2<br \/>\nwith a request to wait till the representation is decided by<br \/>\nrespondent herein.\n<\/p>\n<p>\tAs<br \/>\nand when such request is made by petitioner, the concerned authority<br \/>\nmay consider it sympathetically, so question of considering<br \/>\nrepresentation, that exercise may not become infructuous.\n<\/p>\n<p>\tIn<br \/>\nview of aforesaid observations and directions, present petition is<br \/>\ndisposed of without expressing any opinion on merits.
