Justice A.K.BASHEER\n\n Dated :25\/03\/2008\n\n O R D E R\n                            A.K.BASHEER, J.\n           - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n                      Crl.M.C.No.4052 OF 2003\n           - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n             Dated this the 25th day of March 2008\n\n                                    ORDER\n<\/pre>\n<p>     In this petition filed under Section 482 of the Code of<\/p>\n<p>Criminal Procedure, petitioner who is the complainant in a<\/p>\n<p>prosecution under Section 138 of the Negotiable Instruments<\/p>\n<p>Act takes exception to the inaction of respondents 3 and 4 in<\/p>\n<p>executing the non-bailable warrant issued by the trial court<\/p>\n<p>against respondent no.2\/accused.<\/p>\n<p>     2. The grievance of the petitioner appeared to be that<\/p>\n<p>respondents 3 and 4 had not been taking effective steps to<\/p>\n<p>apprehend and produce the accused before the court in spite<\/p>\n<p>of pendency of non-bailable warrant issued by the court.<\/p>\n<p>Learned Government Pleader, after getting instruction,<\/p>\n<p>submits that respondent No.2\/accused had been arrested and<\/p>\n<p>produced before the court on January 30, 2004. In that view<\/p>\n<p>of the matter, no further orders are necessary in this Criminal<\/p>\n<p>M.C.\n<\/p>\n<p>Crl.M.C.No.4052 OF 2003<br \/>\n                            :: 2 ::\n<\/p>\n<\/p>\n<p>     3. However, learned counsel for the petitioner submits<\/p>\n<p>that the accused had again jumped bail and he is still at large.<\/p>\n<p>The further grievance is that Police officers are yet again<\/p>\n<p>guilty of laches in as much as the accused has not been<\/p>\n<p>apprehended so far.\n<\/p>\n<p>     4. It will be open to the petitioner to pursue the matter<\/p>\n<p>before the trial court.
