KHARE\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     Leave granted.\n<\/p>\n<p>     This appeal  is directed against the judgment and order<br \/>\nof a  Division Bench  of the  High Court  of  Judicature  at<br \/>\nMadras in  Wrist Petition No. 17333 of 1995 dated 17th July,<br \/>\n1997.\n<\/p>\n<p>     After hearing  learned  counsel  for  the\tparties\t and<br \/>\nexamining the record we are satisfied that the matter before<br \/>\nthe High  Court was  one of  public interest and required an<br \/>\nin-depth examination by the court. The Division Bench of the<br \/>\nHigh Court,  it appears to us, failed to appreciate the true<br \/>\nsignificance of\t the matter regarding the need to arrest the<br \/>\nunabated pollution,  which had\tbecome a  health hazard\t and<br \/>\nenvironmental enemy  because of\t discharge of  objectionable<br \/>\neffluents  from\t  the  distillery  into\t Bhavani  River\t and<br \/>\nadjoining areas.  The High Court feel in error to dispose of<br \/>\nthe writ  petition merely  on the  consent of the Tamil Nadu<br \/>\nPollution Control  Board. Matters  like this,  which involve<br \/>\ngreater public\tinterest  should  not  normally\t be  decided<br \/>\nmerely on  consent of  the Pollution  Control Board.  We are<br \/>\nsomewhat unhappy  about the  manner in\twhich the  Pollution<br \/>\nControl Board  gave  its  consent  unmindful  of  the  grave<br \/>\nconsequences, which  have been amply demonstrated before us.<br \/>\nThe order of the High Court, therefore, cannot be sustained.<br \/>\nWe, accordingly,  allow this  appeal and set aside the order<br \/>\nof the High Court and remand the writ petition to it for its<br \/>\nfresh disposal in accordance with law.\n<\/p>\n<p>     During the\t pendency of  the proceedings in this court,<br \/>\ncertain affidavits  and undertakings were filed on behalf of<br \/>\nthe industry  respondent No. 6, and on 29th January, 1998 we<br \/>\ngave certain  directions including  the\t direction  for\t the<br \/>\nclosure of  the operation  of the Industry (respondent No.6)<br \/>\non or  before  2nd  February,  1998  because  of  continuing<br \/>\npollution from\tits distillery\tand sugar  division. We also<br \/>\ndirected inspection of the industry and the site adjacent to<br \/>\nit by  NEERI, who  was also asked to submit a report to this<br \/>\nCourt  whether\tthe  pollution\tcontrol\t devices  have\tbeen<br \/>\ninstalled by  the Industry and proper steps taken to control<br \/>\npollution in  accordance with  the provisions  of the  Water<br \/>\n(Prevention and Control of Pollution) Act, 1974 (hereinafter<br \/>\nAct)  or  not.\tNEERI  was  also  directed  to\tinspect\t the<br \/>\nsurrounding areas  with a  view to assess damage, caused due<br \/>\nto discharge of effluent by the Industry and to indicate the<br \/>\ncost of restitution.\n<\/p>\n<p>     Pursuant  to  the\tdirections  issued  by\tus  on\t29th<br \/>\nJanuary, 1998,\tNEERI has  submitted two  reports. The first<br \/>\ninspection report  was submitted on 9th March, those reports<br \/>\nand since  we are  remanding the  writ perused those reports<br \/>\nand since  we are  remanding the  writ petition\t to the High<br \/>\nCourt for  its disposal,  it appears  appropriate to  us, to<br \/>\nrequest the  High Court\t to consider  those reports  and the<br \/>\nsuggestions made  therein while\t passing orders\t in the Writ<br \/>\nPetition from time to time.\n<\/p>\n<p>     Mr. Venugopal, learned Senior counsel appearing for the<br \/>\nIndustry, submits  that remedial  steps\t have  already\tbeen<br \/>\ntaken as  suggested by\tthis Court  as well  as by NEERI and<br \/>\nthat  Pollution\t to  prevent  pollution\t of  water  and\t the<br \/>\nIndustry may, therefore, be permitted to operate.\n<\/p>\n<p>     Mr. Harish\t Salve, learned\t amicus curiae\ton the other<br \/>\nhand submits that all steps required to check pollution have<br \/>\nnot been taken and in support of his submission, relies upon<br \/>\nthe two reports submitted by NEERI to this Court.\n<\/p>\n<p>     The High Court may, therefore:\n<\/p>\n<p>     1.\t   Consider in consultation with<br \/>\n     NEERI, whether  the Industry may be<br \/>\n     permitted to  have a  test\t run  or<br \/>\n     become operational and, if so, with<br \/>\n     what  further   safeguards\t  and\/or<br \/>\n     remedial measures\tto be taken. For<br \/>\n     this  purpose  NEERI  shall  appear<br \/>\n     before the High Court of Madras and<br \/>\n     inform  the   Court  regarding  the<br \/>\n     viability of  the Industry starting<br \/>\n     either  the   test\t  run\tor   its<br \/>\n     operation.\t The   High  Court  may,<br \/>\n     thereafter, pass appropriate orders<br \/>\n     regarding the lifting of the ban on<br \/>\n     operations\t which\twas  imposed  by<br \/>\n     this Court\t on operations which was<br \/>\n     imposed by this Court on 26.1.1998.\n<\/p>\n<p>     2.\t  The High Court may also direct<br \/>\n     supervision by  any of the agencies<br \/>\n     including NEERI  or  the  Pollution<br \/>\n     Control Board,  with a  view to see<br \/>\n     that the  Industry does  not  cause<br \/>\n     any type  of pollution,  in case it<br \/>\n     is permitted to become operational.\n<\/p>\n<p>     3.\t  The  High   Court  shall  also<br \/>\n     examine the question of restitution<br \/>\n     of the  areas damaged on account to<br \/>\n     the pollution  already caused.  The<br \/>\n     costs  of\t the  pollution\t already<br \/>\n     caused.   The    costs    of    the<br \/>\n     restitution shall\tbe borne by M\/s.\n<\/p>\n<p>     was requested to submit its report.\n<\/p>\n<p>     4.\t   The\tHigh Court shall monitor<br \/>\n     the  case\ttill  such  time  as  is<br \/>\n     considered necessary by it .\n<\/p>\n<p>     The High  Court may  appoint amicus curiae to assist it<br \/>\nfor disposal  of the  case and burden the Industry with such<br \/>\ncosts as it may deem  fit.\n<\/p>\n<p>     The parties, through their learned counsel are directed<br \/>\nto appear  before the  High Court on 6th August, 1998. NEERI<br \/>\nshall also  be requested  to appear before the High Court on<br \/>\nthe same  date to  give its  opinion  on  technical  matters<br \/>\nregarding the operational viability of the Industry.\n<\/p>\n<p>     In so  for as  the costs  in this\tCourt are concerned,<br \/>\nlearned\t amicus\t  curiae,  Mr.\t Harish\t Salve\tassisted  by<br \/>\nMr.S.Muralidhar\t Services   Committee.\tWe   appreciate\t the<br \/>\ngesture show  by the  learned counsel. We also wish to place<br \/>\non record  our appreciation  for the  assistance rendered by<br \/>\nMr.Harish Salve, Senior Advocate and Mr.S.Muralidhar in this<br \/>\nCourt.\n<\/p>\n<p>     The Industry  M\/s.Sakthi Sugars  Ltd., Tamil Nadu shall<br \/>\npay a  sum of  Rs. 20,000\/-  by way of costs, which shall be<br \/>\ndeposited in the account of the Supreme Court Legal Services<br \/>\nCommittee within one week.\n<\/p>\n<p>     The Registry  shall transmit the complete record of the<br \/>\ncase to\t the High Court without any delay.
